I've been selling for 5+ years, and would never ever give such a bad description as this seller has.
I bid on a hanging spaghetti swag lamp.
The auction description reads:

In the photo it looks a little dusty. I just received it, and don't want to even touch it because it is absolutely disgusting. It is covered in dirt, and the lamp isn't even a true spaghetti lamp from the 60's. I expected it to be the typical lucite that spaghetti lamps are made of, but Nooooo... It is rope that was spray painted red. It is by far the biggest piece of crap I ever received from anyone. This should be thrown away or at best, sold at a garage sale for 50 cents. I wouldn't dream of selling something like this on ebay. It is absolutely worthless.
I emailed them and told them the condition was completely unacceptable and the description wasn't even close to what they shipped me. I seriously hope they send me a refund for the item and for the shipping costs. This isn't what I was expecting at all.

i just looked at the auction and the lamp looks like someone wound string around a blown up balloon then spray painted it and burst the balloon inside. we used to do this with string and paper mache.
there is no way i would have thought lucite looking at that picture...it looks like junk and that is what you got.
if they don't refund, join the other 16 people that have given them negs...they deserve it.

I just love this guy. He now threatens me with negative feedback if I leave him a negative. I never mentioned leaving any sort of feedback as a condition. I had hoped it wouldn't come to that.
He offered a partial refund, but his last sentance was, " i see you have a perfect record so im offering the refund i hope it doesnt turn out that we leave each other neg."
I see he has received two negatives yesterday for poor shipping.

I just looked at their feedback. In response to a couple of the negs they say "if theres a problem ask for a refund or we return neg feedback thankyou "

awww geez... i did look at the photo, and i have several spaghetti swags, all purchased through ebay and all made of lucite. I am not familiar with the balloon techique, so that would explain why I didn't recognize it as such. I honestly thought it was a bit dusty, something that I've had no trouble cleaning when they are lucite. This isn't made of lucite, and would be impossible to clean. If I owned a junk shop or sold it at a garage sale i wouldn't ask more than $3.00 for it.

am i being fair in asking for the shipping fees as well? i really feel i was misled. as you can see by the photo, this is covered in dirt. since when did "excellent condition" not include cleanliness?
Here is the last email from them.
" i dont mind doing a refund but im not going to lose money.i already lose my listing auction fees by giving a refund and thats why i dont refund shipping.i inderstand it cost you shipping and you dont want ot be out that thats why i offer a partial refund and dont make you send it back. said 5.50 before but ill strech it to 7.50.otherwise just den it back and ill send you back the bid price.im being more then fair letting you keep it and giving you 7.50 back but i cant go any higher then 7.50 normally i dont even refund,and in this case i sold you what i auctioned and that was a spaghetti lamp and thats what you recieved.

It might be just her picture, but her kitchen looks rather dirty itself. I would have found a better place to take the pic if it were me (thankfully, it's not) . I'd ask for the shipping back as well. She seems to have totally misrepresented that lamp.

i've whiddled them down to giving me $20 refund, which I basically lose $5.50. of course, they just emailed again with this beauty: "just make sure it doenst come back broken"
i replied, I am shipping this exactly as you shipped it, with your packing materials (newspaper) and box.

how does fed ex do return shipments? I resealed it so that they cannot tell that I even opened it. all of the Fed Ex labels have no tape over them. Is it possible to return it as denied?

It's already been entered into the FedEx system as delivered. He would have to request a call tag from his end to have it picked up and returned and charged to his account. I find it interesting he's trying to collect an extra $1.30 for insurance when the transportation rate already included $100.00 insurance on the shipment. You'd probably be best off to take the $20.00 and move on. The extra time you would spend in a tug of war with this guy could be better spent, and more profitable, listing things to sell.

our fed ex delivery guy picked up a dsl modem that was misdelivered to us from qwest. he said he doesn't condone it, but to simply tape it back up so that it looks as if it wasn't opened, then call fed ex to schedule a pickup. they did it with no problem. all they asked was why i was returning it, which i replied wrong item.
i emailed the seller and of course they had to retort that i was a scammer. man, i tell you. all i did was bid on an auction, make prompt payment, and then get this headache. i'm taking the 20, but i still may leave a neg. i know he'll retaliate against my perfect score, but i also know that i would be doing the right thing letting others know about this horrid seller.

if you paid via paypal file a claim you can get your money back ie "not as described" worth a try.

PP will not allow that. all the seller has to do is provide pp with a tracking number. that is it. then they are covered. trust me on that one. i've gone through that a few times in the 5+ years of selling on ebay.

did you sign for the FedEx package? If they just dropped it off you can say that you didn't order it and won't accept delivery. But if you signed for it you're stuck with it.

paypal does not get involved with item not as described.i fyou file a complaint,they will issue a warning to him,thats all.
i will just take the partial refund and move on,what makes you want to buy a piece of crap in the first place anyway??

Rusty -- Perhaps you can open up another ebay account just to buy under in case a deal goes sour as this one did. You don't need to ruin your perfect sellers feedback score over a purchase. I did it and I don't worry about my feedback on my sellers id. Just a thought ...

well I can say from personal experience that it is possible to get money back if you scream not as described it happened to me 2 months ago.

not a bad idea on a second account. i'll work on that one. this guy is a complete idiot. he has accused me of being a scammer and then pulls this??? lol. goes to show you can't even trust some of the long time sellers on here. absolutely amazing!
i decided to quit responding to his bashing, though for some reason he believes I think I am better than him. hmmm. i wonder why??? perhaps it's because i'm on the losing end of this transaction. oh well.
lesson learned. i need a larger monitor and have ask each person i buy a spaghetti swag lamp from, "is it lucite? does it look home made? and how dirty is it?"

When you get your first neg let it be over something you can't prevent, this you can.
