I had a buyer in the UK purchase an item on eBay. The Buyer claimed damage to the item upon FedEx delivery. He sends me a picture of the damaged item.

The old bait and switch -- FedEx still has the consignment I shipped undelivered in their UK facility!

How do I prevent the buyer from making a chargeback to my PayPal account for a fraudulent damage claim?

I have documentation from the buyer about the damage, the picture of a damaged item and mails from FedEx that the consignment I have shipped is undelivered in their UK facility.

I'm trying to circumvent problems with my PayPal account before the scammer tries to chargeback for his purchase. Seller protection from PayPal is nonexistent.

Should I stop FedEx delivery until the issue is sorted out? This is the only way I can think to prevent being out of a high ticket item while this fraud buyer makes his excuses, i.e....From where and what damaged item was the buyer sending me a picture of when the item I have sent him is undelivered?

Any suggestions would be appreciated.

Thank you

so UK buyer claimed item damaged, what does he want you to do??
i would ask fed exp to hold the item for you until you can have this case resolved with buyer??
play along and ask if you can ship him a replacement??
of course you have to decide if you want the damaged item returned before you will ship the replacement??
or if he wants to chargeback irregardless of what you offer to do,ask fed exp to return the item to you.
is it time for afternoon cocktail yet??

I suppose it's possible your buyer has you confused with someone else. (Could they have purchased two similar items and be confusing their shipment with one they received from another seller?)

Not sure it's possible, but if I were you, I would certainly put a stop with FedEx on the delivery and have it returned to you. You're right, Paypal offers no protection for international transactions, so if the sale was for a considerable amount of money, you might still be able to limit your losses. However, you may end up with a hefty return shipping fee from FedEx.

I'm sure there will be other (and better) suggestions, but my first instint would be to do everything you can to protect yourself. What does the buyer's feedback record look like? That may give you some clue as to whether this could be a case of mistaken identity on their part (ie. getting you confused with another seller).

Hope everything works out for you.

if he wants to cheat,he does not have to show you any photo, since paypal offers you no protection.
he can just go ahead and file complaint with paypal .

Thank you for your responses. The buyer, in my opinion, had pre-meditated to play the switcheroo with my item. He wrote prior to bidding asking very specific detailed questions about the item.

July 19th he says the item was delivered and it is damaged. I ask him for pictures of the damaged item. He sends one picture of a partially visible item with damage and a poor repair job. I ask for more pictures with the entire item visible and detailed description of the damage, outer shipping container, etc. No further pictures or information has been received from the buyer.

In the meanwhile, I contact FedEx about the damage claimed by the buyer, forward the one picture and ask for information about how to proceed. FedEx is the one who alerted me that the buyer has not taken delivery of the consignment I have sent. It is still in the UK delivery faciltiy undelivered and unopened. FedEx themselves are considering fraud charges against the receipient of the consignment.

What I would like to know is how to prevent the buyer who has tried to pull a scam one time from making a chargeback to my PayPal account and causing a lot more hassle?

You are absolutely correct stopwhining. The buyer can file a chargeback whenever he wishes and PayPal leaves the seller hanging out on a limb over the ravine.

Have FedEx return that item immediately. Then refund his money. If you don't, you'll be out the item and the money. This way, you'll only have to eat the shipping charges. Then change your TOS to state no Paypal on international shipments. It's very easy to insert a Bidpay - WUAP logo into your auctions.

if i were your buyer,i will not dare to complete this fraud scheme if i find out fed exp may get involved??
you can be candid with him and tell him fed exp is now aware of his scheme, that you offer him either-accept the shipment or you can refund his payment less paypal, ebay and shipping fees.
if he said refund me,then you get the item back and lose nothing, but your time .
(see, the second option is to protect you in case he just does not have the money to pay the charge and go ahead and file chargeback, you have no way of presenting your side of the story(with fed exp backing) if paypal does not get involved,as you DO not know who his cc issuer is to present your side of the story.
(in a chargeback ,his credit card issuer will ask paypal to present your side of the story, and if paypal said this is intl transaction and we dont get involved, then YOU LOSE)

what does he really want from you??
if he knows you get no paypal protection from overseas buyer,he can just file chargeback with his cc issuer and claim he did not make the charge and he will get his money back from you via paypal, there is no need to show you pictures of damages.
the fact that he bothered to show you pictures,he could be expecting fed exp to reimburse him, your role will be to contact fede xp and collaborate with him to get him reimbursed.
you know,i wonder how many overseas paypal users know of this seller protection program ,chargeback is not that common overseas, credit card usage is not as widespread overseas.

Please allow me to introduce myself I am not of wealth and Fame,,doooooo dOOOOO,,,(Mick Jagger).......Pleae allow pay pal 30 days to INVESTIGATE the Chargeback,,,,,,Now please allow pay pal 75 days form the END of the 30 days to continue their Chargeback proceedures and in the MEANTIME the buyer WILL have his MONEY back and YOU kind people will have NOTHING and be charged $10.00 for the previlidge of pay pal investigating the situation,,,think I just dreamed this up? Think again, the 75 days stated YESTERDAY.

A buyers remorse Azzhole. and he wins! I am NOW out $61.00...........pay pal has NO control. PP told me per phone, the CONSUMER will ALWAYS WIN! I asked what is the reverse side of the coin,,,,,she pondered for a few and said, what other side? He has my product and I have a $10.00 charge from pp and I am out $51.00!!!!!!! Trust in Pay pals,,,,"Buyer protection". It works for the buyer and the seller is screwed......Be careful of the VALUE of the "item" you take a pp payment on. they can reverse a CC apyment in the "blink" of an eye......and Pay Pay will sit on it's thumb.

.2 cents.
