I sold a vintage fold-up General Electric phonograph to a lady about 3 weeks ago. This little unit was in mint condition and worked 100%. It made it to her safe & sound via Fedx. She emails me to say the platter (turntable) just hums and will not turn. She sends it back to me demanding a refund with both original and return postage. I agree. Today the phonograph arrives and I check it out only to find it completely non-functional. The platter is siezed and loose ALMOST LIKE SHE DROPPED IT!! THIS HAS NOT BEEN RETURNED TO ME IN THE CONDITION I SENT IT TO HER IN!!!!! I am very suspicious and she is waiting for a $70 Paypal refund. What do I do?? Again, this item has been trampered with and I am none to pleased!!

was the item insured for shipping? if so let the insurer handle it. I would be highly reluctant to return money for an item I sent in good condition and was shipped back broken. Maybe a phone call to her might ease the situation. A conversation... makes a "non-person" seller someone with a voice. If I remember correctly ebay also has a mediation service maybe that's a step as well. I do not envy your position.

Could it have been replaced with their damaged one? Friends of mine mark their items with a glow in the dark pen which the buyer has no clue about this situation. They can easily monitor their items should they be returned the them by this pen mark.
You can BS them and say that your mark is not showing up therefore this isn't your item.

Trouble is, she's a buyer with all the benefits of PayPal - unfortunately.
There is one thing that can save you. Did she have delivery confirmation on the item when it was returned? If not... What turntable? I sent it and she received it. I don't have it and I don't believe she sent it back. Prove it.
If your ethics allow, that's the only thing that might save you. Otherwise, she can do a chargeback or complaint through PayPal and if she can prove that she returned it, they'll give her the money back -- including the shipping.
I'll trade you my bad check that I'm now dealing with. Anyone remember that collection agency that was mentioned a while back? I think they had "Mad" in their name... I'm going off to search for them now...

Listen to Jack! He's on the right track. If you issue a refund, you're out the money and stuck with a damaged item. The worst that can happen is she could be successful in a Paypal chargeback, in which case you'll probably be better off since you won't get stuck with the return shipping charges, which should not even be on the table. This has escalated beyond a satisfactory settlement. That item was insured for $100.00. She should have notified you immediately, and a claim should have been filed with FedEx. It may or may not have been payed, but you would have received the damaged item back. If she returned this without your explicit permission, then she deserves to be stuck. OTOH, if you told her to return it, and did not pursue your FedEx claim option, then you owe her a full refund, minus return shipping. Either way, you and she will likely be exchanging negative feedback.

I wouldn't issue a refund, and I'd hold on to the merchandise. Paypal should not be involved at this point, as their part of the transaction is complete - but they may think differently! I had something similar happen. Sold an umbrella stand for $900 shipping was $40. Buyer paid via Paypal received the item said it was damaged. I requested proof, photos, etc. He just shipped it right on back to me and did a chargeback. Ouch!

She has the upper hand, P/P will give her the refund w/o any questionm. Your only course is see if you can get anything from FeEx. I had a very similar occurence about 2 months ago. The buyer claimed the item ( a telescope was not as advertised) There was nothing wrong with it but I had no choice, but to refund everything but the return shipping.

just tell her the item arrived broken,so you cannot give her a refund,and see what she does next.
