I purchased a pre-sell item on Ebay on July 17th (a McFarlane Sports Figure), and paid by Credit Card on Paypal for it the next day on July 18th...Being a pre-sell, he said it would be shipped probably within 30 days, but possibly longer if items are not received from the manufacturer...After about 45 days I emailed and asked about the item, and heard nothing...I emailed again a week or so later, still no response...I looked at the auction and wow, he is no longer a seller and got over 100 negs in a month for not sending items that were paid to him for...He had thousands of great feedback and now he's getting negs big time...I should have investigated sooner, but didn't, and don't know if it would have helped...Ebay says it's to late to file (it's after the 60 days now)...My question is this...What's my best path to recover my payment?...Through Paypal, my credit card company I paid for it through, or is it a lost cause?

It's past the filing date with Paypal. Your only recourse is through your credit card if that time period hasn't expired. It seems that the seller ran into a problem with his dropshipper.

your credit card.
I dont think this seller would have kept any money in his paypal account,so your chargeback will hit paypal.

I'm betting that the seller had a problem with their expenses and used the presale income to pay day to day expenses and had nothing left to pay for the figures when they were actually available from McFarlane.
In the future... just invest in a friendship with your local Toys R' Us employee.
