I have just read the ebay policy on alcohol sales on Ebay...It says that Wine bottles that have wine in them can't be sold on ebay (except by a few dealers) because the value is generally based on the wine in the bottle rather then the bottle itself...Well, the ones I have are not in that category...They are a "Legends of Football" collection, that have labels of the player on them and a facsimile autograph and some neat design on them...The wine content is a cheap cabernet probably not worth drinking, and hardly a wine worth big bucks!!...Anyone ever sell anything like this, or know if it is probable an auction of a bottle of this would get yanked by ebay?...Or, is there any way to maybe send ebay a pic of what it is, and get some kind of pre-approval (or a no you can't)?...Thanks!!!

Here is a common disclaimer used by cigar sellers. Just switch out tobacco for wine.
The value of this item is in the collectible packaging, not in the tobacco itself. The package has not been opened, and the tobacco within is not for consumption. The packaging has a value that substantially exceeds the current price of that tobacco product in the package. The collectible tobacco packaging is not available at any retail outlet. The Buyer of this item must be at least 18 years of age. Bidder is responsible for making sure that they do not violate any laws in their city and/or state. The item is being sold strictly as a collectible, and the tobacco is not meant for consumption.

Thanks for your input Fenix...I did check the tobacco restrictions in ebay policies prior to asking this question...Tobacco IS permitted by ebay as long as the disclaimer you stated is met...On the other hand, ebay alcohol policy specifically states NO wine bottles with wine in it...Maybe this was a dumb question, I suppose no means no to ebay no matter what! Just wondered if anyone has come across it...Don't want to be suspended if I try it...

Unusually CLEAR prohibition AGAINST vino sales:
Collectible Containers:
We will permit sales of unopened collectible containers that still contain alcohol as long as each of the following conditions are met and stated verbatim in the listing:
The value of the item is in the collectible container, not its contents. (Bottles of wine are not permitted, as their value is generally based on the wine in the bottle rather than the bottle itself.)
The container has not been opened and any incidental contents are not intended for consumption.
The item is not available at any retail outlet, and the container has a value that substantially exceeds the current retail price of the alcohol in the container.
The seller will take all appropriate steps to ensure that the buyer is of lawful age in the buyer and seller's jurisdiction (generally 21 years of age).
Buyers and sellers both ensure that the sale complies with all applicable laws and shipping regulations.
Alcohol-Related Collectibles
eBay permits the sale of alcohol-related collectibles, including alcohol-related memorabilia, packaging and containers such as bottles, decanters or limited edition cans (provided you comply with the above collectible container sale guidelines).
Selling rare wine on Live Auctions
eBay permits the sale of wine on Live Auctions by licensed auction houses and dealers, because we can be sure that the potential problems regarding alcohol sales can be overcome through careful vetting of licenses and procedures. If you as an individual want to sell alcohol on Live Auctions, we suggest that you contact one of the authorized sellers on the site.
Selling Chocolates with Liqueur in them
Food products that use alcohol for flavor do not fall within these laws and regulations
Selling Wine- and Beer-Making Kits
Wine and beer-making kits will continue to be allowed on eBay, as long as the kit does not contain any alcoholic beverages

Depending on the age of the bottles you may have WINE VINEGAR not wine. Just a thought.
