Bought a pair of "new" Reeboks 2 weeks ago with BIN. Paid with PayPal.
Shoes FINALLY arrive today. Auction stated 3 times(!) in the listing NEW. Condition states "new-without box". Ok, no prob with that. Shoes are not new. Soles and insoles are dirty. Not just kinda dirty, but filthy. Grass stains, rocks embedded in the soles, etc. They have obvious not been worn much, but they are definitely not new!
Seller states she ships when payment clears. Paid 6/22, shipped 7/1.
They arrive in a tyvek envelope. No box? Paid a $3.00 handling fee for what? Improper packaging and not even an invoice enclosed?
I am seriously ticked about the deal. No wonder my buyers try to tell me how to pack and ask redundant questions about things I go out of my way to mention in the auction.
Here is my email to her. I have not sent it yet. Wanted to cool down a bit and give y'all a chance to write a better letter for me

I also paid you with Paypal on June 22 and you waited until July 1 to mail Priority? And to top that off, the handling fee I paid was not sufficient for you to take the time to use a free priority mail box to protect the shipment? I am offended as a seller at the level of service you provide.
I do not wish to keep the shoes, I doubt I would be able to wear them without thinking about how disappointed I am in this whole transaction. What do you propose we do next?

So now the shoe is on the other foot. As a buyer on eBay I'm often discouraged by what turns up in the mail as opposed to what was advertised in the listing. I'm still waiting for the other shoe to drop.

Your email looks fine to me. It pretty well covers all the bases. I would send it and wait and see what her response is. The timeliness of her response will be important. If she drags her feet on shipping, she may try to drag her feet on a resolution and ake it beyond the limit for a chargeback.

Wait a week and do a charge back at Paypal or at least start the process.
That is just absolutely terrible. Maybe this seller is as a bat. I would think anyone could tell a new pair of shoes from used ones. Hey maybe your postman swapped his for yours. LOL Sad part is she will probably claim they are new and tell Paypal you did a switcheroo. You just never know.
Let us know what happens.

Just this afternoon I received a big pottery salad bowl from a seller; it was broken in about 2 dozen pieces. Came via parcel post rather than priority, came late, and was in a too-shallow box for the size of the bowl. Hard to believe a power seller!!! would do such a careless shipping job. I've sent the seller 5 photos of the damaged pieces. Haven't heard back yet.
He hasn't left feedback for me yet. My question is whether I should just do a chargeback on PayPal for the whole thing and forget about collecting from him.

Back in May I bid on a caller ID for my phone, mine quit working, 11.99 including postage. It was one they don't make anymore so my only option was eBay.
When I got it I noticed a small piece of scotch tape over the top right corner where a piece of red plastic covers a light that blinks if you have a call. I pulled the tape off & the plastic cover was in three pieces.
I emailed the seller & asked why he didn't disclose in auction it was broken. His attitude was kind of so what's the big deal after all I got the manuel with it.
He annoyed me so I filed a claim with Paypal.
After a month of waiting to rule on this claim I received this email today from PayPal.

I really don't care one bit about 11.99, I do care that a seller can sell something that has a flaw like a break & it doesn't matter if he discloses it or not & then wins the dispute. Who ever said PayPal sides with the buyer, I don't think so, not for me anyway.
Now that I know there is tape over the broken plastic piece it stands out, but I did not notice it when I bid. Yes, it does work, but I found another of the same caller ID on eBay & it was unused in the box & bought that one.

ack! McJane. Seller does not disclose damage and PP does not think that it is SNAD? I think I would have to write if not call Paypal and raise a serious fuss.
Fluff, maybe I'm a sucker but I usually give the seller a chance to make things right. In this case that is going to take a full refund and her paying for return postage. If I start with a PayPal dispute than I am responsible for return postage. I also paid by credit card though PP because I think PayPal's buyer protection is questionable at best. If this doesn't work out, I'll file a complaint with the cc company.
And at the very least she is going to get a neutral from me, perhaps it will alert a future buyer to question her descriptions.
I did send my letter last night and am waiting for a reply. Everything about this deal just ticked me off from the minute I opened the mail box and saw that envelope stuffed in there.
I did some looking at her closed auctions. Seems she lists lots of items with the item specific listed "new" and says "new condition without box, tags, etc" in her description. From my experience, I'm willing to bet that all those items are used and am surprised someone has not negged her before.
In my instance, she said New in the title, specifics and description.

You know what discourages you, the long wait after you file & then you get an email from PayPal & they want you to take your item to an expert & then fax PayPal their opinion.
Now how are you going to do that with a pair of sneakers or, in my case, a long discontinued caller ID. The so called expert would think you were crazy.
I told PayPal it was impossible for me to do that & based my case on emails, which I sent to Paypal, from the seller admitting the caller ID was broken. Lost anyway. I know I won't win so I am not going to bother with it anymore, too much trouble.
I ALWAYS use a credit card when using PayPal & if this were a more expensive item I would do a chargeback, but since it is not I am just going to let it go.
Don't forget to post the outcome of your complaint & I hope you win, you should.
