I bid on an auction for 3 dvds for an old tv show "you can't do that on television". The auction shows color pictures and doesn't say anything about the dvds being bootleg copies. I wanted these for my adult children who used to love this show. I received them today and they were all on dvd-r's with no names to indicate which volume was which and with 2 in the same case. I paid over 30.00 for these and am really ripped.I emailed the seller and here is his answer:

"I thought it was a common frustration among fans of the show that official dvd's did not exist & episodes were hard to find. Listings of official dvd's will often have some form of copyright information and a release date. On eBay if you ever have questions or inquiries into the item or auction you can always ask the seller questions before purchasing."

I have filed a dispute with paypal but do I have any recourse with copyright infrimgement (or ebay) since these were bootleg copies.

Guess it doesn't matter..the seller refunded my money so I am happy (well not happy since I wanted those dvds) but at least I am not out any money.

Someone must have turned her in.

First of all the seller isnt going to state these are bootlegs, because Ebay will probably yank it.You probably should have asked him before you bid on it.The seller emailed you and said offical dvds of this program dont exist-is this a fact?

Bootlegged DVDs? You have been made whole, but you know what you should do. Let's try to keep eBay as clean as possible!

Maybe you can copy them before you send them back.

Maybe he doesn't want them back since he refunded right away.

I don't think your supposed to return counterfeit items anyway.

You could always forward them to the copyright owner along with the seller's contact info - to be helpful and keep your hands clean. Afterall, you currently have in your possession "stolen" goods.

The seller states I should keep the dvds. I haven't tried them so hope they are what I bought (I would hate to give my children porn).
I didn't feel like I should have to ask if they were original because the auction shows colored pics and appears to be a new dvd. I would have asked if there were no pics. I don't know if original exist..he states not.
I won't report him unless he lists them again..right now he has nothing listed but if he does this again I will report him to ebay.

That is the strategy of the bootleg sellers...If someone complains, refund and let them keep it. Think about it, the complaint level is low - I'll pull a figure out of thin air, 20%. They refund on that, are out a couple of blank dvd's and postage - Maybe $1. The ones that don't care of don't complain, they pay $30 for something that costs them nothing. It is very, very profitable. I know you got your money back, but not complaining is bad because it makes ebay a marketplace that keep eroding, removing buyer confidence. I rarely buy on ebay anymore because of the scams, and postage ripoffs...and I'm a powerseller!

I'm not familiar with the show, but is it possible it is in the public domain?
