Can I refuse to sell to someone after the auction ended and after they paid?
I see a big problem coming and I'm in no mood to deal with this guy.
He is in Italy he asked the cost of shipping before he bid I told him
then he writes: Hi dear ebayer, does the pedal is in perfect working order?
I ANS HIS QUESTION with Sorry but I never used this so I can not say if it is working.
Then he bids and wins the auction
Then I send him an invoice for actual cost of shipping plus 3.00 m/h fee to me. This is his email to me:
Dear Ebayer, i'm very happy about the auction! You'll receive the payment very soon. I'd like only ask you to check again if the shipping fee is correct...I mean, I've already bought pedal like this from US and I'm watching on my ebay other auction regarding the "same" pedal coming from US but in any case the shipping fees has lower than 29,60 (ex. 23,20 USPS First Class Mail International)
If is there a chance to save money in shipping, why don't try?!
I write back and tell him yes it is correct. the item is in a box where it fits with one inch space on each end and on the sides there is 2" space..I can't get it into a smaller box no matter how I try. The item alone is a heavy item. It is 4Lbs after packing and thats the correct cost of shipping.
He writes back to me the following email:
OK, OK....just payd! Usually I hate waste my money in shipping expences...anyway you are the seller and you told me "this" amount before the end of the auction.
I strongly hope that the pedal works perfectely at least and please, remember to declare a minimum value on the pachage to avoid me ANY custom fee once the pedal will be in Italy!

Well now, I didn't ans his email yet but I Do not want to complete this transaction with him ....What are my options?
I NEVER Lower cost on customs form, I never have and I never will do that so I see a big problem coming with this guy in more then one way.
If anyone knows the correct way to handle this please let me know. I do not intend to complete this transaction with him but I want to end it in the right way, if there is a right way.

email him and tell him you're not allowed by law to declare less than what it sold for.

... and in that email telling him that you must declare full value on the customs form, tell him politely that if this is not to his liking, you are willing to mutually agree to cancel the transaction.

What I would like do is not continue with this transaction I just want to end it with this guy without a big problem. Do you know the correct way for me to do this?

Do you accept unconfirmed addresses? If not, refuse to ship to unconfirmed, refund and relist. Then go block Italy in Paypal.
Second, email him that you had your 10 year old go try the pedal and while it was not broken before he darn well broke it now and the money is being refunded.
Third, send the pedal, declare full value on customs and use a third party insurance co.
Finally, tell the guy you shipped it. Put it in the basement. And 45 days from now refund his money. The Italian postal service is notorious for "losing items". Just view the packaging and shipping discussion board for examples.

First, I would get his agreement to not complete the transaction. Your "wedge" in getting him to agree this is your company's policy of honestly filling out customs forms (this should be in your TOS). Say that you can't deviate from this rule.
Explain to him that this will not give him a bad mark on his account.
Once he agrees, file a "Mutual agreement to terminate a transaction" in the Unpaid Item Dispute area. If he agrees, you get your FVF back. If he doesn't, you're out the fees.
In either case, either of you can leave feedback; I suggest that you tell him that you should both leave positive, or perhaps agree that neither leaves feedback.

I have never felt this way in dealing with any ebay buyer and I have had my fill as we all have had. But for some reason my inner self is saying do not complete this transaction with him...
All the suggestion are really great, now to pick which one I should use. lol
You know Cash your right, I should mention in my auctions that I don't lower the price on custom forms. But since it is a LAW to tell the truth on these forms I didn't think I needed to explain this to people. But I see it is important to have it in the listing.
Vintageads..I ship to unconfirmed address not just confirmed address, I also didn't know that I could block Italy in Paypal. I will check it out.
Which suggestion do you think I should use that would give me less trouble down the road.

I don't believe that you can explicitly block Italy, unless that's a recent change.
I've ALWAYS had trouble with Italy; thankfully I have only had 4 purchases there, but I'm 0 for 4. I spent this past Christmas in Rome, I love the food, history, etc., but if I never get another purchase from Italy it will be too soon.

I think this guy bought from me once, well tried. I refunded his money and moved on it was too much anxiety for me. He kept coming up with new questions and ways to annoy me.

Italy is a great country to visit, my daughter just left on Wed. for Carnival in Venus, she goes every year and from seeing all the pictures she takes its a great place to visit. It must be she goes every year and she loves it. ...lol But then again she is a world traveler so all the countries she goes to she loves....lmao
But dealing with the people from Italy is almost always a problem in some way. Plus as was mentioned shipping time is really crazy once it gets into the Country It takes forever to get to the customer.
merre, What reason did you use for refunding his money and did you have a problem with him after you refunded his money?

Toni: After several emails when he kept making outrageous demands, ship here, do this, wait a while, etc. It has been a while so I forget most of the details. He wanted to send partial payments, etc. His tone was sort of insulting too, called me babe, we can work this out, blah, blah, blah. The item was a hard to get set of Laser Discs that were my husband's, not something I normally sell. It was exhausting, finally, I just told him this is not going to work out. Refunded his money through Paypal, no reason stated for the refund and I never heard from him again. No emails, no negs, nada.

Well hope it goes as well for me, I will refund payment saying I got someone to test this item and it's not in working condition so I am returning payment.
Because what if when he gets it he tells me it's not working and wants his money back I will have no way of really knowing if he is telling me the truth.

"Due to the irregular Italian Custom Requirements, I will be unable to ship this item to you. Italy and the United States works closely in handling International packages, and with the current Patriot Act and FISA laws, our emails may be monitored.
You have asked me to commit a felony by providing inaccurate information on the customs form. I do not believe it is in my interest to get involved in criminal activity.

His e-mails to me would have made my hair stand on end. Can't you just smell a disgruntled buyer who will leave a neg?!
Especially now, soon, when we sellers have no right any longer to warn other sellers about this guy.

I paid the total amount you sent me in 2 minutes after the end of the auction and i was very happy about the winning price! I've accepted to overpay the shipping fees and i was waiting for the delivery of the item.
When i wake up this morning i found your open dispute and i was very disappointed....never open a dispute unless contact before the bidder or the seller or "the other side" ...finally i read your final message:
Hi, I had this item tested for you and it does not work. I will file with ebay that we mutually agreed to end this transaction please agree when they send you an email so I can get back my final value fees. Here is your full refund,Thank you tonimar1 ...and my answer is: I do not care about it, I'm a DIYers and I' m able to fix any crybaby i don't wanna a full refound I just want what I've paid for, so please hounour the auction and send me the pedal "as is".

I had it tested because...you said to me in a few emails that you hope it works ...then you said my shipping quote was too high, when it is the quote given to me on the USPS web site, you made me feel like I'm making money on your shipping cost which I am not, I am only making 3.00 to cover material and handling fee which is a very very fair charge since I lose money when paypal makes the exchange of currency and the paypal fee for International sales
It cost me more then USA and I am not complaining. YOU then ask me to tell a LIE on a customs form Which is against the Federal Law, and against my principles.
Then I worry that when you get the peddle if it is not working you will complain to me and want your money back. So all this put together has made me decide to get the peddle tested and when it did not work I felt it would be in your best interest not to continue with this transaction.
You don't have to sign the agreement with ebay if you don't want to I just will not get back my final value fee. But to me it is a small price to pay for peace of mind, and knowing that I was doing the right thing by you when all along you were making me feel like I was robbing you of money..
And if it didn't matter to you that it might not be working why did you make me feel like it was very important to you for it to be working.
Also, I can not change my decision because I threw out the broken pedal and it is gone.
All this because you were not honest with me in your emails.
None if this would have happened if you would have been honest with me from the beginning, by saying if the pedal didn't work it's ok, since I know how to fix these peddles. But no, you kept saying you hope it works, and since you are paying so high for shipping YOU hope it works. What was I to do? Not have it tested after all that complaining? I felt obligated to have it tested since you did nothing but complain.

toni: I have been burned on mutal FVF thing before. I had a thread on this board and they gave me good advice, don't do MUTUAL unless you are 100% sure they will agree. As Fluff said, if you returned their money, they did NOT pay.
I think your email is fine, but I do not think it will matter.

Then find a live bee or leech. Send it to him marked as such and valued at $1000.
Don't worry about him anymore. He is yesterday's news. If ebay gives you a hard time tell them its broken or that he wanted you to falsify the customs form and you refused. Take the neg, block the guy and then go block Italy in Paypal.

I just thought about the feedback now and when the new FB comes into play this guy would have left me a neg already but since now he has a chance of receiving a neg back from me he might think twice. But with the new way FB will be he don't have to think twice.
