I sold an ad to a buyer in Germany 30 days ago and just got payment along with a nasty letter that "suggests that I think about how I work with European buyers and that I respond to emails"

I have sold over 500 items all over Europe without a hitch and answer all emails. This clown even called me at 4:20 AM to tell me his payment was on its way.

So here is my question.

1)Do send the payment back and say thanks but no thanks because I know he will ding my stars.

or

2)Send him the item and take the hit on my stars?

I have already filed a non-buyer bidder alert and have received my FVF refund

Is it possible that your e-mail server rejected his e-mails?

Since you've already gotten your FVF back, I don't believe he can leave you a feedback at all. No harm, no foul.

I thought once I marked the item as paid that the FVF were reversed and the buyers non-payment mark was removed. Am I incorrect?

You're correct. One thing I should mention, if he responded to your NPB he will be able to leave feedback.

Sorry, I misread your post. I didn't realize that you'd marked it as paid.

What I don't understand is why hasn't he made payment long before you even started your FVF filing?
Why did he have to email you in the first place when ebay sends him an end of auction email telling him to make payment. Why was he emailing you?

First thing I would do is remove my phone number.

Weather you send the item or if you choose not to send it he can still leave you feedback and DSR rating.

Do you want to send him the item?

If you don't want to send the item then return his money but I don't think you will get back your FVF, because you made the choice to return his money and not complete the transaction.

When a buyer gets a strike and then makes payment the strike is automatically removed if it was his first time and ebay takes back your FVF that they gave you.

Thanks for the input

I have not marked it as paid because I have mixed feelings and was hoping for guidance from the wisdom of the board.

The buyer paid via personal check.

I am making about $8.00 on the transaction but a ding on my stars would cost me more then that.

I'd destroy the check, ignore any emails from him and move on. An $8.00 sale isn't worth the hassle.
If he didn't respond to your NPB, he can't leave feedback.

I would complete the transaction - say you are sorry for the misunderstanding and hope for the best. It's a buyer's world now and you may as well get used to it. Unfortunately

An awful lot of our online sales are to Europe so we do get the occasional late night phone call about orders but for the most part our EU sales are trouble-free. After customers place an order they get our EU bank details and make an online international bank transfer (usually free within the EU). Payment is usually credited within a few business days and we ship within a day or so of confirmation. Delivery time to most EU countries is around one to two weeks via Airmail and with the new EUR 150 customs duty threshold from Dec 2008, most orders are now duty free (but sadly still not VAT free).

Better check with your bank about a personal check from Germany.
Could be a hefty charge for them to process it.

I agree with Mcjane. Check with your bank on charges. If they don't have hefty charges, then simply complete the sale and send your typical thank you for the business note and move on.

The contract was broken. Why take payment after the fact?

Do you really need the money that badly?
