if i file against a npb ,can they neg me ,and can i get it removed if they do.

how long is everyone waiting now? 7days?

Yes, they can neg you if they respond to your notice of non-payment. If they don't respond, they can't.
I state in my auctions that pmnt is expected within 3 days. On the 5th day I file.
99%of the time they pay within a few days. Those that don't, I never hear from again.

I can't remember the last time a npb responded to a dispute but didn't pay. Usually a npb dispute gets them to pay or they ignore it altogether.

I just got a negative for filing a NPB after 4 days. Of course I have contacted eBay but no response in 3 days. This is his comment "Bad seller, sarcastic, bad service, bad to do business with, bad attitude" 2409 positives in 12 months and this idiot can do this and I have no recourse.

First, I wouldn't respond to the feedback yet. Wait a bit, and start thinking how to respond to this feedback. You have very little space to give a clear picture of what happened, so planning it out is important. Also, don't follow up until you've spoken with eBay. The most important thing is not to respond to their feedback by berating them. This is very important, because a neg is bad, but making a bad response is even worse for your business. Future buyers will be concerned about how you handle things and your response more than the buyers negative feedback.

Can you give a better picture of the transaction? What happened, communication, etc?

Did they contact you through eBay after you filed a dispute? Did they leave this neg after you closed the dispute or was it between filing the dispute and closing it?

Does this buyer have buying history? If so, you can check to see what kind of other feedback they left for others. All of this info may help you once you speak to eBay. You can point to any red flags as justification for your request to remove feedback.

When you speak to eBay, be as professional and reasonable as possible. It is hard to say whether you'll get anywhere with them. Sometimes they'll have pity on you, sometimes they wont.

I'll also add, any future communication with this buyer should be through eBay's system only. Do not email them directly. You want eBay to be able to review contact between you and your buyers, so you should do this always.

If you respond, keep everything courteous and professional. Don't let a bad buyer get the best of you, b/c they win and hurt you further.

If this is all obvious, please excuse my suggestions. I'm just trying to soften the blow a bit for you.

Ebay is not going to remove the neg,you would have to hire a lawyer to do so.

Just got a response from ebay. Of course it they denied removing the neg but they wrote...

"The eBay Feedback Forum is a member-to-member tool that gives people a place to speak freely without worrying about being censored."

Where is the sellers place to speak without being censored?

You could always buy an hour from an attorney, and have a Demand Letter written and sent to the buyer. You would be demanding that they remove the false feedback, that has damaged your reputation in the online marketplace. Copy sent to eBay.

The cost would be a worthwhile investment in your eBay business.

If you recall another thread here - a guy bought a grandfather attic time clock from some lawyer and left him a neg calling him worse than a sleazy used car salesman,he has so far spent 7k or more of his money defending himself in court.
The lawyer is asking what 14k??

I'd still call eBay about it. Have them look at the feedback they left for others recently. I would consider having someone at least review the issue and see what they can do. It doesn't hurt, other than spending some time on the phone.

It really ticks me off that eBay allows bidders to leave negative feedback when they obviously haven't paid. It amazes me to no end that eBay has monopolized the payment methods, which means that they know who has paid and who haven't.

The seller for the other item this buyer left a neg for made a good statement. eBay needs to review these feedbacks. if this buyer claims that someone hi jacked her computer, then eBay needs to investigate it. Whether they will is another story... but there are some CSRs at eBay that will help.

I just blocked this person from bidding on my items.

I hate to wish ill upon others, but hopefully they haven't paid for a few other items and will be banned from eBay. That will remove your neg.

those Pre Paid Legal services for about $15 a month will write letters for you. i know if i got a letter from an attorney for leaving bad feedback, i would reconsider how i behaved on ebay. just food for thought.

they give legal advice, handle wills at no extra charge, and will help in a pinch... but don't expect them to truly represent you without additional retainers.

i had this service for a few years for free through an employer. i used it a few times, mainly for a landlord problem, and to get a collection agency off my back that was billing me for something that wasn't mine to begin with. they wouldn't get the hint until an attorney wrote them. never had a problem afterward.

Go to bottom of Ebay summary page, click on site map and under seller info will be blocked bidder list.

Thanks everybody I contacted the seller that also got a neg and gave them the eBay reps name and email addy. Fat chance it'll help but its worth a try.

I just sent a NPB after 4 days as I always do and I get a hostile email that read.

I am leaving negative feedback for your opening an unpaid bidder case. My FIOS service was out and I had no computer

Thanks again I know its 1 neg but dang it I work hard to keep my customers happy.

Technically, buyers can't leave feedback if you closed the dispute without any response. If that is the case, I would approach eBay about that.

Did she send the message, "I am leaving negative feedback for your opening an unpaid bidder case. My FIOS service was out and I had no computer" via eBay messaging???

Before giving up, I would consider requesting that the buyer do a Feedback revision. I would do this with two messages because The Feedback Revision request can only be 500 characters, which isn't very much.

In the request I would stick to blaming eBay for their refund request system that requires you to open a claim. Tell her you have no choice but to do so (your hands are tied) to get your refund. Avoid blaming her or using phrases like "didn't pay". Instead use "you opted out" or "decided not to pay" and there is no way for you to know what a buyer's intentions are without receiving communication from them.

The second message (if needed) should be sent through eBay's messaging system which allows more space to further explain. I would again reiterate that your hands are tied with eBay's system to receive a refund when a buyer chooses not to purchase an item after they bid on it. You wish there was a better system, but you have to work with the tools eBay gives you. Tell her it wasn't personal, just that you needed to recoup the fees you were charged on the item. You have no intentions to hurt buyers, but at the same time you have to file a claim to get a refund for the fees you were charged by ebay. The important thing is to make both of you the victim of eBay's system.

Maybe it will work, maybe it won't. But I would consider trying. It can't hurt.
