Item description partially reads:
"Also included is the original purchase receipt that is also signed by Jay Ward from the Dudley Do-Right Emporium in Hollywood, California. This is taped to the back of the cardboard insert inside of the frame as it was found."

A few days ago I get the following email:
"Disappointed u didn't include the signed receipt will u be sending or do I have to put a claim in?"

I send them a reply telling them where the receipt is, "taped to the back of the board inside the frame", also nicely pointing out that it was in the item description.
Do they bother to email me back even with a "thank you"??? No. No feedback, nothing. Normally, I wouldn't be bothered by the lack of communication, but the way they worded their email makes me a bit concerned.

oh boy... the plot thickens.
I received an email from another eBay member today about the item I sold. They were inquiring about it because the item I sold is now being sold by auction. The ID is different, but obviously the same seller, very similar ID and located in same city.
I check it out. They used all of my text word for word, and used all of my photographs, which in our listing states is our copyrighted material.
The irony in this is that by relisting it, using the same text including the description should be boiler plate argument against them if they don't sell it for more than what they paid and try to come back and claim item not described... right? I mean, who can claim I described an item incorrectly and then turn around and sell it with the same description?
I tried calling eBay but there is a long wait. I will call again later.

I noticed that next to items I purchase, there is a menu item to "sell this item". Maybe they figure this implies it is ok to take the original seller's content as well?

you are just speculating if they dont sell ,they will file claim !
As long as you have made your money,what do you care what they do with the item,the title has passed hands,now it is their item,they can do whatever they want.
If it bothers you they are using your description and picture,tell them to remove it.

I could care less what they do with the item after I sold it. If they can make a ton of money on it, good for them.
I do care that another buyer is using my photographs and my item description, word for word to promote their item.
Beyond the issue of copyright infringement, it was causing concern for other users. While I was away yesterday I received a phone call on our business line from someone regarding the piece as well. Two different ebay users inquired to the legitimacy of the listing. That's where the problem is.
Why should I have to justify the other persons actions after I sold it to them? My initial concern was about how rude their email was to me, threatening a claim when they didn't read the listing beforehand. After I pointed it out, they didn't bother to communicate with us with any acknowledgement that we resolved their issue.
My concern was that they still are unsatisfied even before I found out they listed the item. However, by using my photos and text to relist the item, I should be able to counter any INAD claim because they were comfortable enough with my description to reuse it.
