Kennedy says bankruptcy law would hurt veterans

Bankruptcy legislation pending before Congress could push military personnel returning from Iraq and Afghanistan into financial crisis, US Senator Edward M. Kennedy told a group of veterans and their advocates yesterday.
Kennedy said he will oppose the legislation, designed to make it harder for people to declare bankruptcy and force many to pay back whatever debts they can.
For veterans facing bankruptcy, the legislation ''will come out more on the side of the creditors in terms of harassing these extraordinary individuals," Kennedy said. ''These are not the spendthrifts, these are not the Enrons, these are not the WorldComs that have abused the bankruptcy system -- these are people that are serving our country, and I'm going to do everything I can to make sure that that bill does not pass in the United States Senate the way that it is."
Kennedy spokeswoman Laura Capps said that Kennedy plans to testify in the Senate today against the bill. In 2003, 16,000 soldiers in active duty filed for bankruptcy across the nation, she added.
Kennedy cited the experiences of two military personnel from the Bay State, Marine Lance Corporal James Crosby, 20, of Saugus, and National Guard Sergeant Peter Damon, 32, of Brockton, both of whom joined him yesterday at an event he held to discuss the transition soldiers face when they return home.
Crosby and Damon returned from active duty in Iraq with debilitating injuries -- Crosby is paralyzed from the waist down and Damon lost both his arms -- that hamper their ability to perform manual labor. As a result, both men face mounting debts and diminished job prospects. They urged Kennedy to enhance benefits to veterans by supporting House legislation that would increase the pay of soldiers who are injured and to file bills that mandate the immediate distribution of disability checks.
''Since being hurt, it's definitely impacted and changed my life dramatically," said Crosby. "At the time [you are taken out of combat] the fight is not over -- you are fighting for your life and your whole life has been disrupted, which is the time when you need the money the most."
There are tens of thousands of veterans filing for bankruptcy each year because they lose income while on duty, Kennedy said. The proposed bankruptcy law would increase that figure as more troops return from Iraq, he said.
Noting the dramatic decrease in pay when their reserve and guard units are called up, Kennedy said: ''In the instances where the guard and reserves are drawn into the service and they are the principal provider of a small business, more often than not, they are going to be facing bankruptcy."
Most of the meeting at Blue Cross Blue Shield's Fenway headquarters focused on increasing awareness about services available to veterans -- including career and family counseling, housing help, medical assistance, and education.
Damon, 32, a former electrician who lost both arms repairing a helicopter tire in Iraq, said he was worried he would never be able to make money again. The father of two admitted yesterday he had no idea that veterans were able to get free tuition to state colleges. This fall, he plans to enroll.

First: if you can't read the whole post it answers the question of why they may file for bankruptcy.....sorry you can't read yet.
Second: I see you sound happy that kennedy couldn't get the Repugs from voting against the vets....how Anti-American you are! You must be against supporting the troops!
Third:So the end of the ARTICLE (not ammendment) is positive...so?
The outcome was the Repugs voted against the VETS!
Or do you think it's a positive thing that that guy lost his arms for YOU!

And the other vets can and will be using the same system than everyone else will...IF they can pay part of their debt...they will. If they can't they won't.

Linda K, wonderful news that wounded vets were not forgotten in the new Bankruptcy laws. How about a link to that fact. I would enjoy reading how compassionate and foresighted the republicans are that passed the new bankruptcy law. I and I am sure many others will be waiting your reply with a link to this wonderful news.
BTW, While your doing your research (that you are so good at) see if any special consideration has been given to the non-wounded vets that have had to file Bankruptcy because of their service in the military. You must be wrong that the compassionate and foresighted republicans have not thought about the non-wounded vets. So many of your troops have been asked to give up so much because of their unusually long deployments. I just can't wait to see that my hopes have come true and all is well with ALL our Troops.
I am sure that a lot of people want to read about this wonderful news so please don't keep us waiting to long.

Libra63, your right my English isn't the best. Plus I have no excuse for it either because when I went to school the schools weren't underfunded like they are now under this White House.
I am hoping with your advanced search skills you can find where in the new republican bankruptcy laws our wounded and non-wounded troops have been given consideration. To this day our troops have been ordered to serve unusually long deployments. Looks to me like this White House has made a "HARD JOB" for our troops and their families not only in Iraq but at home also.

Your question is easy to answer. They signed up because at that time they didn't realize what a poor job this White House would do running a war. Now our military has not been able to meet their recruitment goals.

Are you also not aware that soldiers called to war have certain protections from 'creditors' under OTHER laws? If not, I'm just so sure you're quite capable of learning for yourself just what those laws are and won't be requiring me, one you constantly insult, to do it for you. You're a big boy now.
