Who are the legislators who pass laws like these....giving illegals better benefits than American citizens have, in the first place?


I, for one, certainly hope they win these lawsuits....this is crazy.

In-state tuition for illegals spurs civil action in N.Y.

New York has joined Texas as the second state since early August to become the target of discrimination complaints for laws allowing illegal aliens who live in those states to go to college cheaper than out-of-state students who are U.S. citizens.


    In both cases, the Washington Legal Foundation (WLF) filed the formal complaints with the Department of Homeland Security's (DHS) Office for Civil Rights and Civil Liberties. That agency is responsible for investigating complaints of violations of rights arising from federal immigration laws.



    WLF, a public-interest law and policy center, says the laws in effect in New York, Texas and seven other states -- California, Kansas, Illinois, Utah, Oklahoma, New Mexico and Washington -- offer lower in-state tuition rates for illegals who live in those states but deny them to out-of-state students with full citizenship.



    The foundation claims the tuition policies violate a 1996 federal statute that says any state that offers reduced in-state tuition rates at public colleges to illegals who live in the state must provide the same lower rates to all U.S. citizens.


    Richard Samp, general counsel for WLF, said the average difference in tuitions charged illegals living in-state and students from out-of-state is about $1,000 a year for those attending community colleges; $5,000 to $6,000 annually for undergraduates enrolled in large, state-run universities; and as much as $15,000 a year for students in graduate-level professional schools, such as those for medicine, dentistry, or law.

    The organization began filing such complaints after a ruling in July by a federal judge in Kansas.



    U.S. District Court Judge Richard D. Rogers dismissed a lawsuit brought by two dozen out-of-state students attending public colleges in Kansas who claimed the state's 2004 tuition law was illegal and discriminatory.



    In his ruling, Judge Rogers held that DHS offered the "only enforcement possible" for the 1996 federal statute guaranteeing unbiased tuition standards. Rep. Lamar Smith, Texas Republican, sponsored the 1996 legislation and says he supports WLF's efforts.

I am curious how they know they are illegal and if so are not reporting them?

But you are right, they should not get in-state tution.

Ron - I'd assume because they can't present the necessary papers that are required of all others....birth certificates, previous transcripts, etc.


And it sadly appears that no one will report these illegals to the proper agency to get them deported.

Laws like that get passed because politicians--both Democratic AND Republican--pay more attention to special interest groups representing illegal aliens than they do to their own citizens.

In California we have repeatedly voted over the years in favor of things that would curtail illegals...only to have our "victories" at the polls ignored or overturned.

Laws like this get passed because state universities have lots of pull with state legislators. The schools are looking to enroll as many as they can, simply put. They realize that there's a huge untapped well of potential students living right there locally who they could lure into enrolling if they could get them in cheaply. It's an economic decision, not a moral, legal or political one. I don't like it either, but if you calm down a minute and examine it, you'll see that it's the same thinking that causes banks and insurance companies to support giving driver's licenses to illegals. Money talks. It is, after all, the American Way.

Reading into someone's post again, profe? I didn't notice that anyone who has posted so far needed to 'calm down'. I didn't see anyone upset.

bunni - But in CA it's been mostly a liberal democratic legislature that has done that....NOT a republican one. And imo, that's a big reason the CA voters wanted Gray Davis out - and voted him out. Between him AND the liberal dem. leaning legislature....you're corrrect, the voters decisions, comfirmed at the polls, didn't matter to THEM. They felt the voters decisions didn't count.

And the same thing with the colleges and universities.....they're run by and lean in mass to the left/liberal agenda.

Nope. What I meant by calm down was, if a person tries to take a dispassionate look at why these laws get passed, the reason is obvious, that's all. Sorry, I should have said it that way, so you wouldn't think I was trying to twist your words.

Linda, our Republican governor--whom I voted for, btw--plays the same game. Just last week he informed us that our illegal immigrant problem is not a crisis and doesn't need extra steps taken. Why? because there are powerful lobby groups who scream "racism" and make threats every time this issue is brought up.

As I said, it has nothing to do with party affiliation. But wait--maybe it does--your own beloved Bush, who is a conservative Republican despite what Bear tries to tell us, who is working hard to make sure we have more illegals--uh, I mean "guest workers"--in the country.

I paid almost 6,000 a year more for my kid to go to a Maryland College. This has been a problem for years but Bush and the republican controlled houses encourage illegals into America to supply cheap labor. They can't even do anything about closing our southern borders. Until we all get Bush and Congress to do something about wide open borders there will be lots of injustice over illegals.

I can't stand it! Both parties are scared to do anything about this crap because they don't want to lose votes - they don't want to offend anyone.

Someone needs to stand up and say "enough!" This is crazy - what will it take for all Americans in both parties to tell their representatives that they are tired of paying for people who break the law by entering this country illegally, that they are tired of illegal immigrants getting millions in benefits, education, social services, etc. paid for with THEIR tax dollars.

This issue is coming to a head soon - I hope very soon.

bunni - We are in agreement on this issue. I've long said that neither party has been willing to do much about our illegal problem and that both just appease their growing voting block.


The point I was making, and which we previously discussed in a thread about not deporting illegals as the cost would be prohibitive, was it is usually the democratic party/voters who are more liberal in giving these benefits to the illegals.

Bush has been President for 5 years now. Lots could have been done in 5 years to solve the crisis of illegals in America.

5 YEARS WITH BUSH AND NOW ALONG WITH THE REPUBLICAN CONTROLLED CONGRESS NOTHING HAS BEEN DONE ABOUT THIS PROBLEM.
