I told you folks I bot a certified used car with 3k miles from a car dealer.
I told them I will be there at 6 pm to see the car,well,there is a problem with this car,there is an area 2 by 2 inches where there are scuffle marks and rusty spots,quite obvious! right above the rear wheel.
Anyway,they sent the car to another location to get fixed,but I showed up early and so they called the car back with some temporary patchup.
I dont know how they do it,but when I saw some very light scratch marks,I ran my finger over it and pick up some grease,so I did not pay much attention,I asked the salesman and he made a grunt sound and said nothing.
Well,after I signed all the papers and walked to the car,the salesman showed me the ugly marks and said we dont have time to fix it.
!!
so bring it in on saturday and we will do i in an hour.
WELL,I called him next day and he said the paint guy only work on tuesday and thursday and if i call him monday,I will be the first to have my car serviced on Tuesday !!
I no longer trust this salesman,what should I do?
They still have the check,it is not deposited yet until I said so.
WHAT SHOULD I DO??

hwahwa..I would call them in the morning and tell them that you will take it back on Tuesday first thing and have them do the repair and tell them that you had better be satisfied with the job or you will ask for your money and car back.

If you have online banking, you can cancel your check at anytime. I'd cancel your payment until the car is fixed.

Contact your attorney general if you feel this dealership / salesman is being dishonest. They deserve a complaint even if you cancel the sale. You probably have 72 hours to legally cancel the sale and get your tradein car returned.

thanks for all the good advice.
I did sign the lemon law paper,but this is not a case of lemon,it is deceptive practice to hide the damage.
I will call the salesman in one hour,they will have to come up with a car with no damage or the deal is off.

hwahwa..okay.. I'm not getting this, please explain to me what I am missing.
1.You bought a used car.
2. The salesman noticed scratched area on body over back tire.
3. He says they will buff it out and repaint it on Tuesday.
4. You want another used car without scratches.
Is it the scratched area that is bothering you, because most used cars will have some dings and scratches... or am I not understanding you correctly.. do you think the car has been in an accident and is not mechanically sound based on the damaged area?

sorry I did not make it clear the first time.
This is a big dealer with sales office in two locations.
I found this car on their internet site and it has a link to the car report site,but I did not read the report.
I called the salesman in the morning and said i will come in later,I did not say when but it wont be right away.He interpreted it to be in the afternoon or evening.
So he sent the car to the other location 'to be detailed' (it could be the paint guy is working over there and they want him to paint over the scratched and rusty spots).
Well,I showed up early like noon ,so the salesman and the manager asked the other location to send back the car.
I test drive the car and then I looked at the car,I saw some very light fingernail scartches and I ran my fingers over it,I felt some light grease on my fingers and I asked the salesman,he just grunted.
I dont see anything wrong with the car and they told me it was given to a company exec as part of his perks,since he is single and prefer to drive his own car,this car get seldom used.Now they have given him a 2006 model,they are selling this one as a certified used car with low mileage (3000 miles).
After I signed all the papers and gave them a personal check and asked them not to deposit the check until I said so and walked outside to drive away the car ,the salesman pointed out the rusty area and said they did not have time to fix it,but will do so when I bring the car back .
These rusty spots were not visible when I examined the car,I dont know how they do it,but they have done something to conceal it well.
Anyway,this morning I called the salesman at home and told him I would not accept this car and unless he and his boss can come up with another car with no defects,the deal is off.
I am still waiting to hear from them.
They have already removed this car from their internet site and I will be removing the fund from my bank account in case they try to deposit my check.
I understand a used certified car with 3200 miles is not a new car,but they should have told me about the problem ,not hide it and then remove the paint and tell me after I bot the car.

the issue I have with the dealer is that they deceived me -they painted over the rusty spots and ugly black scratches,it is a temporary fix and then after I bot the car,they removed the paint and showed me the bad spots.This is a certified used car with 2 months of factory warranty left,then the certified warranty kicks in for another 1o months plus 7 years of powertrain warranty.
This is a 2005 Honda Accord LX.
It will be just a matter of time the temporary paint fall off and I will be bringing the car in ,so may as well tell me now!!

hwahwa.. I understand and agree that there was deception. Do you not want them to fix the spot where there is rust? If the car is what you want a " good repair" seems reasonable? Maybe they could reimburse some of the price of the car?

WOW hwahwa! If they had done that to me, I would not have waited until in the morning. I would have had a piece of that salemans butt and probably a good junk of his boss's.
I was raised around the car business and know how to look for most of what they do. If someone had tried to cover up something like that, I would be reporting them to the BBB and would certainly make sure that upper management knew what I was doing.
There is NO excuse for that kind of blatant dishonesty!

Okay,the salesman called me back and asked me to bring the car in tomorrow and speak to the general manager of the used car division,they will paint the rusty spots and the license plate ??(well,thats new to me,what is wrong with the license plate,i found no problem there??)
He said that since I have the car for 4-5 days,they want to take a look at the scratches??(so they are trying to say I could have caused the problem after I bot the car??)
This afternoon,I went to CARFAX site and typed in the VIN number and got the report-
It started out as a private lease vehicle in Florida in Jan 05,then became part of a commerical fleet and in August 05 sold in auction with 3000 miles on it.
Then it arrived in Texas in August and was in dealer inventory since then.
The car is clean,no damage,no accident,no odometer tempering,no flood .
The dealer is selling this car as certified according to Honda 150 points inspection guideline ,it carries 2 months of factory warranty,12 months of certified warranty and 7 years of powertrain warranty.
But they have lost all credibility-it is not a dealer company car,it is not a mistake that they list the car at certain price on internet,the painter does not work on Saturday,he works on Tuesday and Thursday at this location,they sent the car away to another location to get detailed and hid it so no one can steal it from me(they sent it away to cover up the rusty spots ,too bad i showed up too early).
And now they want to paint the license plate??
There are also other BS this salesman fed me-his daughter shared the same birthday as me,during Rita evacuation,his most precious possession he carried with him is HIS WIFE(I heard his wife screaming at him over the phone and HE SCREAMED BACK AT HER !! ),he sold his first car in 1959 -a chevey impala,thats probably the only truth he told me,a CHEVY SALESMAN!!!!!!!!
This is the second car I bot from them,my neigbor 's wife family bot 6 cars from them,this is one of the biggest dealership in town!!
