KENNEDY CAR CRASH COVER-UP?

Police labor union officials asked acting Chief Christopher McGaffin this afternoon to allow a Capitol Police officer to complete his investigation into an early-morning car crash involving Rep. Patrick Kennedy (D-R.I.), son of Sen. Ted Kennedy.

ROLL CALL reports: According to a letter sent by Officer Greg Baird, acting chairman of the USCP FOP, the wreck took place at approximately 2:45 a.m. Thursday when Kennedy's car, operating with its running lights turned off, narrowly missed colliding with a Capitol Police cruiser and smashed into a security barricade at First and C streets Southeast.

“The driver exited the vehicle and he was observed to be staggering,” Baird’s letter states. Officers approached the driver, who “declared to them he was a Congressman and was late to a vote. The House had adjourned nearly three hours before this incident. It was Congressman Patrick J. Kennedy from Rhode Island.”

Baird wrote that Capitol Police Patrol Division units, who are trained in driving under the influence cases, were not allowed to perform basic field sobriety tests on the Congressman. Instead, two sergeants, who also responded to the accident, proceeded to confer with the Capitol Police watch commander on duty and then “ordered all of the Patrol Division Units to leave the scene and that they were taking over.”

A source tells the DRUDGE REPORT: "It was apparent that the driver was intoxicated (stumbling) and claimed he was in a hurry to make a vote.

"When it became apparent who it was, instead of processing a normal DWI, the watch commander had the Patrol units clear the scene. The commander allowed other building officials drive Kennedy home."

This morning's incident comes just over two weeks after Kennedy was involved in a car accident in Rhode Island.

"I was involved in a traffic accident last night at First and C Street SE near the U.S. Capitol," Kennedy said in a written statement released by his office. "I consumed no alcohol prior to the incident. I will fully cooperate with the Capitol Police in whatever investigation they choose to undertake."

If the police didn't get scientific evidence about drinking. I would think it would be hard to hang a drunk driving charge on Kennedy.

Lots of people after a accident might act confused and be unsteady. Lots of people after an accident might take a drink or two to calm themselves. I am not defending Kennedy I am just saying that unless their is some kind of scientific evidence how can anyone say he was driving drunk.

Its a lot like Cheney shooting that guy. The cops didn't get any scientific evidence there either. So we have to believe Cheney when he said he wasn't drinking before shooting his hunting partner.

Now Kennedy changes his statement.and blames it on medications.

WASHINGTON (AP) — Rep. Patrick Kennedy crashed his car near the Capitol early Thursday, and a police official said he appeared intoxicated. Kennedy said he had taken sleep medication and a prescription anti-nausea drug that can cause drowsiness.

Kennedy, D-R.I., addressed the issue after a spate of news reports. His initial statement said, "I consumed no alcohol prior to the incident."

Later, however, he issued a longer statement saying the attending physician for Congress had prescribed Phenergan on Tuesday to treat Kennedy's gastroenteritis, an inflammation of the stomach and intestines.

Kennedy said he returned to his Capitol Hill home on Wednesday evening after a final series of votes in Congress and took "prescribed" amounts of Phenergan and Ambien, another prescribed drug that he occasionally takes to fall asleep.

"Some time around 2:45 a.m., I drove the few blocks to the Capitol Complex believing I needed to vote," his second statement said. "Apparently, I was disoriented from the medication."

Kennedy appeared to be intoxicated when he crashed his Ford Mustang into a barrier on Capitol Hill early Thursday morning, said Louis P. Cannon, president of the Washington chapter of the Fraternal Order of Police.

Cannon, who was not there, said the officers involved in the accident were instructed by an official "above the rank of patrolman" to take Kennedy home.

No sobriety tests were conducted at the scene.

A letter written by a Capitol Police officer to Acting Chief Christopher McGaffin said Kennedy appeared to be staggering when he left the vehicle after the crash about 3 a.m. The letter was first reported by Roll Call, a Capitol Hill newspaper.

Kennedy said he was late for a vote, officer Greg Baird said in the letter to McGaffin. Baird is acting chairman of the Capitol Hill chapter of the FOP police union. The last vote of the night had occurred almost six hours earlier.

Kennedy said he was driven home by Capitol police.

"At no time did I ask for any special consideration," he said. "I simply complied with what the officers asked me to do."

Kennedy, the son of Sen. Edward M. Kennedy, D-Mass., and his staff declined to discuss any further details of the accident. The congressman took part in House votes Thursday.

Capitol Police did not immediately return phone calls for comment. They issued a one-line statement saying they were investigating a traffic violation that occurred early in the morning at that location.

Baird wrote McGaffin that two sergeants who responded to the accident conferred with the watch commander and were ordered to leave the scene.

He said that after the officers left, Capitol Police officials gave Kennedy a ride home.

Kennedy spent time at a drug rehabilitation clinic before he went to Providence College. He has been open about mental health issues, including being diagnosed with bipolar disorder.

Rep. Patrick Kennedy will enter rehab for addiction to prescription pain medication Friday evening after a highly publicized car crash near the Capitol.

Kennedy, D-R.I., plans to seek treatment at the Mayo Clinic in Rochester, Minn.

The congressman was announcing his decision during a new conference Friday afternoon, then planned to travel to Minnesota later in the day.

Kennedy, who has struggled with addiction and depression, said he had checked into the Mayo Clinic over the Christmas holidays and returned to Congress "reinvigorated and healthy."

"Of course, in every recovery, each day has its ups and downs, but I have been strong, focused and productive since my return," Kennedy said in a statement obtained by The Associated Press.

The congressman said he became concerned about his condition after the Thursday morning car accident.

"I simply do not remember getting out of bed, being pulled over by the police, or being cited for three driving infractions," Kennedy said. "That's not how I want to live my life. And that's not how I want to represent the people of Rhode Island."

The congressman's father, Sen. Edward Kennedy, D-Mass., issued a supportive statement in which he said he's proud of his son for admitting his problem and taking steps to correct it.

"He has taken full responsibility for events that occurred ... and he will continue to cooperate fully with any investigation," the elder Kennedy said.

Bear - if they didn't do a breathalyzer, and he admits taking a prescription drug that actually has produced incidents of "sleep driving" (Foxs Dr Manny was talking about it this morning) then how can you be so convinced that he was drunk?

The only thing that cop has said was that he was unsteady... I've not heard anything of the smell of alcohol on his breath whih certainly any trained officer would notice when they spoke with him initially.

Early yesterday morning Rep. Patrick J. Kennedy of Rhode Island, son of Sen. Edward Kennedy of Massachusetts, crashed his car near the Capitol, according to the Drudge

The security barricade at First and C streets Southeast could not be reached for comment.



The Los Angeles Times reports PJK issued a statement--though we couldn't find it on his Web site--in which he "denied . . . that he had been drinking" but acknowledged driving under the influence of prescription drugs:


In a second, longer statement issued late Thursday, Kennedy, 38, said he had seen Congress' attending physician two days before and had been prescribed Phenergan to treat gastroenteritis. The drug, which is used to control nausea, may cause "considerable drowsiness," according to Physicians' Desk Reference.


After a series of votes Wednesday evening, Kennedy said, he took prescribed doses of Phenergan and Ambien, a drug he said the Capitol physician had given him some time ago for occasional sleeplessness.
"Apparently I was disoriented from the medication," he said, repeating his earlier statement that "at no time before the incident did I use any alcohol."



Slate dubs it "Nappaquiddick." Kennedy's claim not to have tippled is in dispute, however, according to the Boston Herald:


A hostess at a popular Capitol Hill watering hole told the Herald she saw him drinking in the hours before the crash.


"He was drinking a little bit," said the woman, who works at the Hawk & Dove and would not give her name.


Leaving his office late last night, Kennedy refused to say whether he'd been to the Hawk & Dove the night before.


We may never know who's telling the truth, for, as the L.A. Times reports:


Baird [the police union head] wrote that the officers were not permitted to perform basic field sobriety tests and that the watch commander on duty "ordered all of the patrol division units to leave the scene."


Officers then drove Kennedy home, the congressman said in his second statement. "At no time did I ask for any special consideration," he added. "I simply complied with what the officers asked me to do."


It seems highly unlikely, however, that if you or I drove a car into a Capitol barricade, the Capitol Police would respond by chauffeuring us home.


The Times notes that this is not an isolated incident:


Kennedy's past includes several troubling episodes, starting with his treatment in 1986 for cocaine use.


More recently, a charter company accused him of causing $28,000 in damage to a rented yacht in 2000.


That same year, he acknowledged that he was "on a lot of different medications for, among other things, depression," and was accused of shoving an airport security guard at Los Angeles International Airport when she tried to make him check his bag.


He was in a traffic incident last month in his home district, according to Boston Herald columnist Howie Carr, who reported that the mishap occurred as Kennedy was hurrying into the parking lot of a pharmacy in Portsmouth, R.I.


PJK is 38, a year older than his father was when he drove Mary Jo Kopechne to her grave. Since then, Massachusetts voters have returned the elder Kennedy to the Senate six times. If the weird hypnotic power the Kennedys wield against Massachusetts voters extends south to Rhode Island, Patrick Kennedy may have a long political career ahead of him.


Still, you have to wonder why these people don't just hire a driver. Surely they can afford it.

Police Disciplined in Kennedy Crash

May 5, 2006 — Capitol Police have taken disciplinary action in relation to the handling of the response to Rep. Patrick Kennedy's car accident, acting Capitol Police Chief Christopher McGaffin said.

McGaffin said the incident was improperly delayed due to "poor judgment" on the part of police managers and that a field sobriety test should have been administered to Kennedy after his car hit a barrier near the Capitol at 2:45 a.m. on Thursday.

The police report said Kennedy was speeding and his eyes were "red and watery." It also stated that his speech was slightly slurred and that upon exiting his vehicle his balance was "unsure."

Kennedy announced earlier today that he would enter the Mayo Clinic for treatment for addiction to prescription pain medication.

There are questions about why Kennedy was not given a sobriety test immediately after the accident.

"I would say within law enforcement that there is probably … concern that consideration was given a member of Congress that would not be afforded a normal citizen on the street," said Lou Cannon, president of the Fraternal Order of Police for the District of Columbia.

McGaffin would not elaborate on the disciplinary actions the watch commander faces, but he did say "significant administrative and personnel corrective action has been taken." Other officers may also be disciplined. No one has been fired at this point.

The report indicates alcohol may have played a role in the crash, but officers from the Capitol Police on the scene were apparently told by their supervisors to simply drive Kennedy home. Kennedy has said that he did not ask for special treatment.

A police officer in Los Angeles said it appears that standard procedures, which would include a field sobriety test if the driver was found to have bloodshot eyes or slurred speech, were not followed.

LAPD Detective Felix Padilla said if an officer suspects driving under the influence he has an "obligation to do that."

"We have a duty to the public to protect the public, and to ignore that would be neglect on our part," he said.

I could buy into this if there was more than one person or if that one person was not someone that called a newspaper office and says they were there but will not identify themself but for all we know... that person is Linda .

The bar's manager, Edgar Gutierrez, said Kennedy is a regular, according to the Boston paper. Gutierrez said he was working Wednesday night but did not see the congressman.

Wait - the bartender of one bar says that Kennedy was seen in the bar next door but the manager of that bar says that he was not there. That's not a citing Bear - that's a rumor. All that is is the unnamed bartender from next door saying that he heard the unnamed waitress (or Linda)says she saw him.

Have you noticed that the only person with an actual name, and that was actually in the bar that night, states that he was not there?

Wrong, fenix, daughter of doctor. It doesnt 'cause' sleepwalking but is a potential side effect depending on your body chemistry. I was prescribed Ambien and I never sleep-walked when I took it. Which I had the same bottle for over 2 years. For my body chemistry, it knocked me right out and I would only take 5mg. I am more likely to sleep walk without it than with it. You know for somebody so smart, you make up a lot of bul*sh*t and post it publicly.

No, it does not prove that Kennedy was not there, any more than a phone call from an unnamed person that claims that they work there proves that he was. the thing is that until something else happens, I'm mpore inclined to believe the guy with the name in the bar than the person with no name on the phone.

This apparently is a popular congressional hang-out. Are you telling me that there was not a single republican congressional member, cstaffer, junior staffer, coffee gopher, etc there with a couple friends who can say he was there?

Lets all say Kennedy was drunk and has a drug problem.

Lets all say the Police didn't do their job maybe they were star struck.

Lets all say Kennedy should quit his job.

Lets all say Limbaugh should also quit his job.

Lets all say its up to the public to make SURE both Kennedy and Limbaugh quit.

Fenix were are battling over semantics now. The cops suspected he had been drinking & were prevented from investigating further by their superiors (who have now been disciplined for doing so).

The accident report notes "alcohol" involved. He was seen in the bar.

Alcohol enhances the effect of Ambien & Phenergan. Phenergan in itself is also used as a sedative, so he was double dosing on sedatives.

And it took Patrick Kennedy 37 hours to explain that he has no recollection of nearly driving into a Capitol Police car with his headlights off, before smashing into a barrier near the Cannon House Office Building.

Friday's statement in the House Radio/TV Gallery was actually Kennedy's third statement in 21 hours, but the first two -- issued Thursday evening -- made no mention of prescription drug addictions, sleepwalking or amnesia.

In fact, in the first statement, Kennedy acknowledged that he was "involved in a traffic incident last night at First and C Street SE near the U.S. Capitol," but insisted that "I consumed no alcohol prior to the incident."

A later expansion of that statement contained this: "Sometime around 2:45 a.m., I drove the few blocks to the Capitol Complex believing I needed to vote." Explaining that he had been taking the prescriptions Phenergan and Ambien, Kennedy stated only that he was "disoriented from the medication." He was lucid enough to recall, according to the statement, that his car had "hit the security barrier at the corner of 1st and C St., SE."

So, either he remembers not drinking and hitting the barrier or he doesn't. Which is it?

Adding to Kennedy's implausible tale is the waitress at the Hawk and Dove bar on Capitol Hill who reportedly remembers the congressman "drinking a bit" in the hours before the crash. Also, consider the Capitol Police officers who were first at the scene of the accident, believed they smelled alcohol and are still angry that they were pulled off the case by supervisors before administering a Breathalyzer test to Kennedy..

Overall there is no excuse for him being behind the wheel of a car with the combination of drugs and alcohol in his system.

His credability has gone down the toilet.

Bear - where do have the officers said they smelled alcohol? That is where my question about the alcohol stemmed from initially. They said he was unsteady and had red eyes. Once you add that he was supposedly in a popular bar and only one person who made a phone call and did not give their name, says they saw him, makes me wonder about the drinking.

Don't get me wrong, I definately think he was impaired, he had no business on the road, and the police screwed up but until someone can provide something more substial regarding drinking I'm just not buying into that one. that was an immediate assumption that was jumped to because of his fther but even if you look at his past history, it's one of recreational and prescription drugs, not alcohol.

Since you like the Kennedy gossip I'll give you one. Its being said Kennedy was with a woman that night and she has a lot to say about Kennedy's behavior.

That should keep you busy for a day or two.

Republican congressman with a bad driving record, Janklow, ran a stop sign at 70 MPH and murdered a motorcyclist.....he got 100 days of community service....for killing a man.


Tit for tat ...it could go back and forth forever.


Let's focus on the Murderer-in-Chief who has killed and maimed thousands all for profit and over a lie.

I heard there WERE two witnesses who both said they saw him drinking in the bar.

And I also heard that the police who originally were the ones he almost hit....did say he smelled of alcohol.
I'd believe them over HIM anytime. With or without a breathalizer test.

And lastly "They said he was unsteady and had red eyes."

NEITHER of the drugs he admitted to 'doing' would cause 'red eyes'....but alcohol would.

But you're right he has been in 'treatment' before for depression....I'd be depressed if I came from the kennedy genes too.....they've been 'crused' by someone. Probably stemming from joseph kennedy and all he did.

Sure sounds that way to me. It's been reported he was in 'treatment' in Dec. [2005] then again this Feb. then is going back in now.

Yep, sounds like he's been more 'mentally altered' than not for the past 6 months or so.
