Now on a daily basis we are watching BUSHY'S Presidency evaporating.

We will all see BUSHY'S popularity drop to under 20% soon.

The process starts:


1. Submit the petition to the Office of the Pardon Attorney

All petitions, except petitions relating to military offenses (see paragraph 6 below), should be forwarded to the Office of the Pardon Attorney, Department of Justice. The completed pardon petition must be entirely legible; therefore, please type or print in ink. The form must be completed fully and accurately in order to be considered. You may attach to the petition additional pages and documents that amplify or clarify your answer to any question.

2. Federal convictions only

Under the Constitution, only federal criminal convictions, such as those obtained in the United States District Courts, may be pardoned by the President. In addition, the President's pardon power extends to convictions obtained in the Superior Court of the District of Columbia and military court-martial proceedings. However, the President cannot pardon a state criminal offense. Accordingly, if you are seeking clemency for a state criminal conviction, you should not complete and submit this petition. Instead, you should contact the Governor or other appropriate authorities of the state where you reside or where the conviction occurred (such as the state board of pardons and paroles) to determine whether any relief is available to you under state law. If you have a federal conviction, information about the conviction may be obtained from the clerk of the federal court where you were convicted.

3. Five-year waiting period required

Under the Department's rules governing petitions for executive clemency, 28 C.F.R. §§ 1.1 et seq., a minimum waiting period of five years after completion of sentence is required before anyone convicted of a federal offense becomes eligible to apply for a presidential pardon. The waiting period, which is designed to afford the petitioner a reasonable period of time in which to demonstrate an ability to lead a responsible, productive and law-abiding life, begins on the date of the petitioner's release from confinement. Alternatively, if the conviction resulted in a sentence other than a term of imprisonment, such as probation or a fine, the waiting period begins on the date of sentencing. In addition, the petitioner should have satisfied the penalty imposed, including all probation, parole, or supervised release. Moreover, the waiting period begins upon release from confinement for your most recent c onviction, whether or not this is the offense for which pardon is sought. You may make a written request for a waiver of this requirement. However, waiver of any portion of the waiting period is rarely granted and then only in the most exceptional circumstances. In order to request a waiver, you must complete the pardon application form and submit it with a cover letter explaining why you believe the waiting period should be waived in your case.

4. Reason for seeking pardon

In answering question 20, you should state the specific purpose for which you are seeking pardon and, if applicable, attach any relevant documentary evidence that indicates how a pardon will help you accomplish that purpose (such as citations to applicable provisions of state constitutions, statutes, or regulations, or copies of letters from appropriate officials of administrative agencies, professional associations, licensing authorities, etc.). In addition, you should bear in mind that a presidential pardon is ordinarily a sign of forgiveness and is granted in recognition of the applicant's acceptance of responsibility for the crime and established good conduct for a significant period of time after conviction or release from confinement. A pardon is not a sign of vindication and does not connote or establish innocence. For that reason, when considering the merits of a pardon petition, pardon officials take into account the petitioner's acceptance of responsibility, remorse, and atonement for the offense.

5. Multiple federal convictions

If you have more than one federal conviction, the most recent conviction should be shown in response to question 2 of the petition and the form completed as to that conviction. For all other federal convictions, including convictions by military courts-martial, the information requested in questions 2 through 6 of the petition should be provided on an attachment. Any federal charges not resulting in conviction should be reported in the space provided for prior and subsequent criminal record (question 7).

6. Pardon of a military offense

If you are requesting pardon of a court-martial conviction only, you should submit your completed petition directly to the Secretary of the military department that had original jurisdiction in your case, completing questions 2 through 6 and question 15 of the petition form to show all pertinent information concerning your court-martial trial and conviction. 7. Additional arrest record

In response to question 7, you must disclose any additional arrest or charge by any civilian or military law enforcement authority, including any federal, state, local, or foreign authority, whether it occurred before or after the offense for which you are seeking pardon. Your answer should list every violation, including traffic violations that resulted in an arrest or criminal charge, such as driving under the influence. Your failure to disclose any such arrest, whether or not it resulted in conviction, may be construed as a falsification of the petition.

8. Credit status and civil lawsuits

In response to question 14, you must list all delinquent credit obligations, whether or not you dispute them. You must also list all civil lawsuits in which you were named as a party, whether as plaintiff or defendant, including bankruptcy proceedings. You must also list all unpaid tax obligations, whether federal, state, or local. You may submit explanatory material in connection with any of these matters (such as an agreed method of payment for indebtedness).

9. Character references

At least three character affidavits must accompany the petition. If you submit more than three, you should designate the three persons whom you consider to be primary references. The affidavit forms provided are preferred. However, letters of recommendation may be substituted if they contain the full name, address, and telephone number of the reference, indicate a knowledge of the offense for which you seek pardon, and bear a notarized signature. Persons related to you by blood or marriage cannot be used as primary character references.

10. Effect of a pardon

While a presidential pardon will restore various rights lost as a result of the pardoned offense and should lessen to some extent the stigma arising from a conviction, it will not erase or expunge the record of your conviction. Therefore, even if you are granted a pardon, you must still disclose your conviction on any form where such information is required, although you may also disclose the fact that you received a pardon. In addition, most civil disabilities attendant upon a federal felony conviction, such as loss of the right to vote and hold state public office, are imposed by state rather than federal law, and also may be removed by state action. Because the federal pardon process is exacting and may be more time-consuming than analogous state procedures, you may wish to consult with the appropriate authorities in the state of your residence regarding the procedures for restoring your state civil rights.

11. Scope of investigation

Pardon officials conduct a very thorough review in determining a petitioner's worthiness for relief. Accordingly, you should be prepared for a detailed inquiry into your personal background and current activities. Among the factors entering into this determination are the nature, seriousness and recentness of the offense, your overall criminal record, any specific hardship you may be suffering because of the conviction, and the nature and extent of your post-conviction involvement in community service, or charitable or other meritorious activities. We encourage you to submit information concerning your community contributions.

12. Exclusive Presidential authority

The power to grant pardons is vested in the President alone. No hearing is held on the pardon application by either the Department of Justice or the White House. You will be notified when a final decision is made on your petition, and there is no appeal from the President's decision to deny a clemency request. The Office of the Pardon Attorney does not disclose information regarding the nature or results of any investigation that may have been undertaken in a particular case, or the exact point in the clemency process at which a particular petition is pending at a given time. As a matter of well-established policy, the specific reasons for the President's decision to grant or deny a petition are generally not disclosed by either the White House or the Department of Justice. In addition, documents reflecting deliberative communications pertaining to presidential decision-making, such as the Department's recommendation to the President in a clemency matter, are confidential and not available under the Freedom of Information Act. If your petition is denied, you may submit a new petition for consideration two years from the date of denial.

50 Congress men and woman wrote BUSHY a letter about the border guards. Guess what NO PERSONAL REPLY FROM BUSHY.

8 Republican Senators both wrote and called their President. Guess what no reply from BUSHY even to Senator in his own party.

At Christmas time BUSHY pardoned 15 criminals 5 of those pardoned were drug dealers.

BUSHY could have and would have done something if he wanted to simple truth is BUSHY didn't care about those 2 Southern Border Guards OR OUR WIDE OPEN SOUTHERN BORDER.

2 Border Patrol Agents Turn Themselves for Shooting Mexican Drug Runner

Two Texas Border Patrol agents convicted of shooting a Mexican drug runner in the backside while on duty turned themselves in to U.S. Marshals Wednesday, and there's still no word on whether President Bush will grant them a pardon.

Ignacio Ramos and Jose Alonso Compean began serving 11- and 12-year prison sentences, respectively, for the February 2005 non-fatal shooting of Osvaldo Aldrete Davila.

Several groups, including Friends of the Border Patrol, The Minutemen and Grassfire.org, have been trying through petitions to keep the agents out of prison — either by a motion to allow them to remain free on bond during an appeal or through a presidential pardon.

U.S. District Judge Kathleen Cardone denied a motion for the two ex-agents to remain free on bond until their appeals on Tuesday.

"This ruling by Judge Cardone is the most disgraceful act that I have ever heard of in the history of our great nation and both she and the prosecutors should be ashamed of themselves for taking the word of a drug smuggler, caught in the act, while ignoring the facts," Friends of the Border Patrol Chairman Andy Ramirez wrote in a statement. "Evidence that would have severely damaged the credibility of the known drug smuggler, and exonerated Compean & Ramos was sealed and suppressed and the attorneys were prevented from mounting a proper defense."


"I must remind the public that narcotic traffickers and human smugglers laugh at law enforcement as they know that the Johnny Sutton's of DOJ will not prosecute them, and instead will prosecute officers who do their job and keep that poison off our streets and out of our schools, parks, and neighborhoods," Ramirez wrote.

Rep. Dana Rohrabacher, R-Calif., however, criticized the president for failing to come through with a pardon.

"This is the worst betrayal of American defenders I have ever seen," Rohrabacher said in an interview with WorldNetDaily. "It's shameful this was done by someone who is in the Republican Party. He obviously thinks more about his agreements with Mexico than the lives of American people and backing up his defenders."

Rohrabacher, along with a slew of other lawmakers — including Rep. Ted Poe, R-Texas, have been pursuing last-ditch efforts to free Ramos and Compean. Petitions with more than 225,000 signatures were delivered to the White House Tuesday afternoon.

"We expect some response from the White House shortly but we have not received anything yet," Poe told FOX News on Wednesday, adding that people should call the White House switchboard to voice support for the two agents.

The White House already has received "a lot" of phone calls from Americans on the issue, he said.

About a dozen rallies took place across the country in support of the agents last week.

"Grassroots support for these gentlemen is just through the roof," said Grassfire.org spokesman Ron De Jong. He said people signing the petitions are saying to themselves, "'something just doesn't add up' and they're starting to make great waves."

"We are extremely hopeful that the light of justice will shine and this wrong will be right, because otherwise it would be an absolute travesty if these gentlemen had to go to jail for doing their jobs," De Jong added.

Compean and Ramos were convicted by a jury last March of violating the civil rights of Davila when they shot him on Feb. 17, 2005, in Fabens, Texas, about 30 miles east of El Paso, then tampering with evidence by picking up shell casings from the shooting.

The ex-agents say Davila had a gun, and that's why they fired at him, but a gun was never found.

In exchange for his testimony against the two agents, Davila was granted immunity from prosecution by the U.S. government for attempting to smuggle nearly 750 pounds of marijuana, which had a street value of more than $1 million, into the United States on the day he was shot. He was treated in a U.S. hospital and is now suing the federal government for $5 million, Poe said.

"It's just an absurd case," Poe said Wednesday. "There's something weird about our government being so interested in making sure these two border guards go to prison. We hope to get to the bottom of what this is all about."

Several lawmakers, including Poe; Rohrabacher; Walter Jones, R-N.C.; Tom Tancredo, R-Colo.; and Duncan Hunter, R-Calif., last week sent a letter to Attorney General Alberto Gonzales asking him to allow Ramos and Compean to remain free on bond pending the appeal of their convictions.

"The federal government was on the wrong side in this case. This drug dealer was not just bringing in a little bit of marijuana," Poe said. "Our federal government goes to Mexico, finds this drug dealer, gives him immunity ... they're [Ramos and Compean] being punished basically, for doing what they're supposed to do."

He added: "What better two people should be pardoned than border agents doing their jobs trying to protect the United States?"

Prosecutor: It Was a Cover-up

Last month, Bush issued 16 year-end pardons: Five cases involved drug crimes, while others involved bank fraud, mail fraud and the acceptance of a kickback.

In September 2005 the president pardoned 14 people, including a member of the mineworkers union who was convicted for his role in bombings at a West Virginia coal mine; a counterfeiter; several dealers of marijuana and LSD; and a bootlegger.

The president has pardoned 113 people since taking office in 2001.

White House spokesman Tony Snow last week would not comment specifically on pardon proceedings, but he said the facts presented in court showed that Ramos and Compean tried to cover up what occurred.

IF BUSHY WANTED TO DO SOMETHING FOR THESE BORDER GUARDS HE COULD HAVE END OF STORY PERIOD. AFTER ALL BUSHY SAYS "HE IS THE DECIDER".

And if you want to compare Presidential pardons, How many paid pardons did you hero klinton grant on behalf of his brother or did you conveniently forget

I'd normally agree with you Bear....because I have often thought if we'd just shoot a few of them, word would get back to mexico...and the problem would stop. As things are now...we've got too many American's worrying if their going to die from lack of drinking water on their trip here. Which is outrageous imo. Plus I don't one bit care for the mexican gov. HELPING them on how to survive while crossing here illegally either.


BUT...that being said...if anyone listened to Tony Snow's press conference, I'd bet it's on the WH website....they'd get the FULL story.

And, imo, HAVING the full story....I believe we are a nation of laws and that even law enforcement MUST obey our laws.

So in this case, I fully support the decision President Bush made....to not pardon these two.

During a press briefing last Friday, White House spokesman Tony Snow addressed the case and criticism at some length.


"According to the facts presented in court, you had an incident in which there was an attempt to pull somebody over. He finally got pulled over; somebody holds out a gun. Sort of scuffling ensues," Snow said.


"And what happens is you've got a fellow running away, and a couple of agents eventually in pursuit, firing 14 shots at him - I think 15, actually. Fourteen by one agent missed, one did strike him in the fleshy hindquarters," he added.


"Now, at the time this happened, they did not know if he was an illegal," Snow continued.


"They did not know that there were 700 pounds of marijuana [in Aldrete-Davila's van]. They didn't know any of those things. But instead you had this. They also had received arms training the day before that said if you have an incident like this, you must preserve the evidence and you must report it promptly," he said.


"Instead, according to court documents, they went around and picked up the shell casings.

Furthermore, they asked one of their colleagues also to help pick up shell casings. They disposed of them," Snow added.


Snow noted that a jury convicted the agents on 11 out of 12 counts and defended the government's stance.


"This is not the case of the United States saying, we are not going to support people who go after drug dealers. Of course we are ... we also believe that the people who are working to secure that border themselves obey the law," he said.

I have NO DOUBT that had the President given these two a pardon...or granted them clemancy...OR even spoke in support of them......old mingo/crow and wacopeepa would be BITCHING about that too.

Bear, I DO understand your position....but I still see you so much differently than I see those two.

They bash everything this President does.

And I understand your frustration with this drug criminal being used to put two of 'our own' in jail.

Truly I do. It's the same way I feel about our laws that if someone breaks into our homes and we shoot them on their way OUT....WE will pay the consequences.

Those laws are terrible...and I would like to see them changed. They give the criminal the 'right' to escape the threat of death for what they've done....invaded our homes...etc.

And I too would have taken your position about how this incident 'came down'.

I just don't see it as appropriate for a President to back unlawful behavior....that's all.

He took the 'high' road....where I'd have said since he was on our land....he deserved what he got. But that's not what our laws require.

Bush Considering Pardon for Border Agents Convicted of Shooting Mexican Drug Runner

WASHINGTON — President Bush promised to review a case for a possible pardon of two former U.S. Border Patrol agents serving time in prison for shooting a Mexican drug runner.

Bush said in an interview with KFOX-TV in El Paso, Texas, Thursday that he would "take a sober look at the case" as it works its way through the appeals system.

"There are standards that need to be met in law enforcement and according to a jury of their peers, these officers violated some standards," Bush said. "On this case, people need to take a tough look at the facts, the evidence a jury looked at, as well as [the] judge. And I will do the same thing."

Ignacio Ramos and Jose Alonso Compean reported to prison Wednesday to begin serving their sentences for the 2005 non-fatal shooting of Osvaldo Aldrete Davila. Ramos faces 11 years and one day while Compean will serve 12 years. Davila fled to Mexico after he was shot in the buttocks and later admitted he was transporting over 700 pounds of marijuana in the U.S. illegally.

Rep. Duncan Hunter, R-Calif., introduced a bill to pardon the agents, joining a growing group of supporters of the men, including Reps. Dana Rohrabacher, R-Calif., and Ted Poe, R-Texas.

"There's a compelling case that this was an extreme injustice," Hunter told FOXNews.com.

Hunter, a potential 2008 White House contender, said he collected 72 co-sponsors on a bill within 15 minutes after he introduced the measure on the House floor. The bill is the first of its kind in Congress, said Hunter spokesman Joe Kasper. The legislation is likely to head to the House Judiciary Committee for consideration.

"There's nothing to lose because these gentlemen are already in prison," Hunter said, who has met with the agents' families and urged the White House to get involved.

Hunter also sent a letter to the director of the Federal Bureau of Prisons requesting the two former agents be segregated from the general prison population — some of which the ex-agents may have helped put away.

Ramos and Compean were fired after their convictions on several charges, including assault with a deadly weapon, obstruction of justice, and a civil rights violation.

Sen. John Cornyn, R-Texas, sent a letter to Senate Judiciary Committee Chairman Sen. Patrick Leahy, D-Vt., requesting an oversight hearing for a "public explanation and opportunity for questioning."

"I write to urge you to continue to conduct vigorous oversight of the federal government's commitment to protecting Americans who live and work along the border," Cornyn said in his letter.

Cornyn said he and Sen. Arlen Specter of Pennsylvania, who chaired the committee last year, investigated the case and that his office personally interviewed prosecutor Johnny Sutton.

Compean and Ramos were convicted by a jury last March of violating the civil rights of Davila when they shot him on Feb. 17, 2005, in Fabens, Texas, about 30 miles east of El Paso, then tampering with evidence by picking up shell casings from the shooting.

The ex-agents say Davila had a gun, and that's why they fired at him, but a gun was never found.

In exchange for his testimony against the two agents, Davila was granted immunity from prosecution by the U.S. government for attempting to smuggle nearly 750 pounds of marijuana, which had a street value of more than $1 million, into the United States on the day he was shot. He was treated in a U.S. hospital and is now suing the federal government for $5 million, Poe said.

Bear....'waco'peepa has no credibility with posters....nor with most lurkers. I've seen others talk about him on other boards...and it 'ain't prurdy'.


That's just his favorite word to use against anyone who doesn't agree with his life views.

He just throws it out there....NEVER with any proof to back it up...because he CAN'T.
