Yes, he has won and that won't change with the recount.
But...
He shouldn't have (as much as I hate to say it). Al Gore won the popular vote. The fact is that he should be the next President. It's way past time to scrap the antiquated electoral college system. None of the reasons for having it are valid any longer.
I think the first thing that the new President Bush should do is put the wheels in motion to get passed a Constitutional Amendment to do away with it and go to a straight popular vote format for our elections.

I think that to change the electoral college, the states need to ratify. I can't imagine CA going for that.
I admit to being a bit in the dark as to the reasons and workings of the voting process. At the very least, this election did serve to get the voters attention. The last figures I heard from my home state of Ohio is that 70% of registered voters hit the polls yesterday. That is amazing and wonderful in my opinion. The local media was interviewing people leaving the polls, and one elderly gentleman said, "I believe it is not only our right, but our duty to vote". I totally agree...

To pass a Constitutional amendment, it must be approved by 2/3 of both houses of congress and 3/4 of the states. No single state can block it. But it is certainly difficult to get one passed, and it should be. The Constitution is not something to be taken lightly or easily changed. But this is one amendment that IMO would breeze through, especially after last night.

abingdon -- I don't think ANY possible constitutional amendment (about anything, actually) would necessarily *breeze* through. It's a process that takes literally years, for one thing.

I would like to read some pros and cons to this issue. Not by the lunatic fringe, but by knowledgable people. If anyone is aware of such a site or information source, you should post it. I agree at first glance it seems outdated, but there must have been compelling reasons when the method was drawn up. Perhaps I'll give myself an assignment to research this. Haven't done any such work in a lonnnng time.

Would be kinda funny if Gore made a fuss out of losing the electoral vote when he won the popular vote, considering that's exactly how he and Clinton got into the White House BOTH times!

Are they "fussing" about the electorial college or the mishaps in Florida themselves? It seems the women who designed the ballot that some voters found confusing is a Democrat herself. Rush has a copy of the problem ballot on his site and hubby brought a copy of it home. It's only confusing if you don't really look at it. Anyone who took the time to really look should have been fine. She was trying to make the text larger for those who have trouble reading small print, but didn't figure on folks not paying attention.

I've used one of those butterfly type ballots in every election. I've never considered them confusing. It does appear from the high number of votes that Buchanan received though that people did find it confusing.
My understanding is that if you make a mistake on your ballot, that's tough. I'm sure this question has been raised before though. Does anyone know what the law says regarding a vote cast by mistake?

One of the networks covered this...if you realize you have errored "while voting", you can go to a poll worker. They can go through the process of cancelling your ballot number and issue you a new one. Once you hand in the ballot and it is dropped in the box, there is nothing that can be done.
Which brings up an interesting question...if these folks errored, what made them realize it? I think it was HCQ who said, "did they suddenly realize it when they returned to their homes?"
