I've been using paypal since February. I'd keep money in my acount for payments, etc. I received a payment from someone who used a stolen credit card. When they found out a month and a half later that a buyer had used a stolen card, they took $500 OUT of MY account to cover their loss. Can they legally do that?! Needless to say, I'm still waiting to hear back from someone at paypal. Do I have any legal recourse?

Paypal claims to give you some protection, but so far I havent heard of anyone actually being protected except for Paypal. Your information is a little too vague to judge. Did you ship the item out of the U.S? Was the payer verified? Are you? If you email me with some details, I'll give you some more info about what you might try.

Neither I nor the buyer were verified. The transaction was digital within the US.

Did they take it out of your Paypal accout or bank account? If they took it from your bank account, you can go to your bank and get it reversed. If your PP account, there is little you can do. Unfortunately, they have changed their TOS to make it YOUR loss if THEIR validation stinks.

As far as their TOS, what if I signed up before they changed it? I don't seem to recall that on the TOS back then. One other thing, my account didn't have enough to pay what they were out, can they go after me legally to get the rest?

I would like to address the comment by yisgood. I use paypal, yeah I know they have problems, but I wanted to let you know that I had a buyer purchase with a stolen card. I received a notice that this had happened and to supply them with a tracking number. I gave them the tracking number, and because I was verified that was the end of it. I wasn't out 100+ dollars, so their old seller protection worked wonderfully.

Now, I will agree with you that the new TOS for seller and buyer protection is next to worthless, but so is billpoints and exchangepath, so I'll stay with paypal until they do something bad, but so far they have been good to me.

Grahamreaper: Are you sure it was a stolen credit card? Maybe buyer charged it back for non receipt and your showing the receipt helped PP win their case. Or maybe once in a while PP pretends to be on your side so you become their spokesman here. I have heard too many horror stories, some of them directly from folks I know personally. A seller I know had her account frozen over a small charge back for an item she had shipped out over a month before. She even had delivery confirmation, which PP refused to accept, though their own TOS stated it was good. The bottom line is the stolen CC thing could be so easily solved if sellers were sent the cardholder's address. I am amazed that PP, ExP and most of the others refuse to do this.
But as long as there are folks willing to accept this level of "service" there will be companies like PP and EP there to "service" you.

Ashloric: If your PP account is still open, they can still take it out as soon as you have money in it. Otherwise, they might try to reverse a payment made to your bank account, but you can stop that.

Of course I can't be sure it was stolen, but everything matched the way a stolen card is used. I was told by PP that it was stolen, and in hindsight all the warning signs were there, ship to different address, emails didn't match, I was stupid, luckily I didn't have to pay for my stupidity thanks to PP's seller protection. Playing the "they pretend to be on your side" card doesn't cut it, I am not somebody important enough to sway the masses, I just thought I would share my experience since you said you had not heard of anyone benifiting from PP seller protection.

If no PP then who? I have visited your page, and I can't say any of them look very good, and there is no customer base for them.

Ashloric, I am sorry to hear about your problem, listen to yisgood to keep them from getting any of "your" money, but the money that they recoverd from you wasn't yours sad to say.
