I just had my bid for 5 magazines cancelled by the seller without any explination! I have a rating of 32 on Yahoo! with no negs and almost 600 on eBay with 1 neg over a year ago.

The only clue I have is someone asked the seller about one of the magazines in the lot. The seller replied that she could not sell that one because someone had bid on the whole lot. Just 5 minutes later my bid was canelled!!!

%#@*%& I could chew nails right now. This kind of business practice is outrageous. I would report her to Yahoo! if I thought they would do anything about it.

If you were the high bidder, you can rate the person bad....unless yahoo changed it. I had that happen to me once.

I cannot rate the seller as the auction is still running and has almost 5 days to go and I was the ONLY bidder at the time. The reason my bid was cancelled by the seller becomes quite obvious in the first three questions and answers below. I have edited out all identifications.

There are only two reasons to cancel a bid that I could find in the TOS and general rules for sellers.

(1) "When a bidder has asked you to remove their bid. Bidders do not have
the ability to remove their own bids, and must request that sellers remove
their bids for them."

(2) "When you suspect that a bidder on your auction does not mean to follow
through with their bid, or is otherwise behaving dishonestly."

Here is the rest of the exchange...

(Description - 5 magazines pictured)
I have an assortment of back issues of your favorite men's magazine. Because of all of the inquiries, I am selling individual issues for $5 each. If you are looking for a particular issue, let me know & I'll see if I have it. All magazines are in mint condition, with all pages intact. Shipping is $2....

Question 1
Non-bidder #1 (new): interested in purchasing whole lot.need ***** magazine issues 1 thru 19.can you help me? Thank you Mar 18 17:34 PST

Answer
Seller (23): I'll check & see what I've got... Mar 19 05:04 PST

Question 2
jrodgers (32): There are 5 magaines shown in the photo. Am I bidding on all five or just one? Mar 19 06:53 PST

Answer
Seller (23): All 5 together, unless there is another issue not pictured that you are interested in.... Mar 19 07:29 PST

Question 3
Non-bidder #2 (new): I need ***** issue #38, with Denise Richards on the cover. Much appreciation if you can assist me. Thank you Mar 20 08:26 PST

Answer
Seller (23): The Denise Richards issue is part of the lot pictured. If i did not have bids on the lot, I would sell it seperately, but i have a bidder on the entire lot. Mar 20 10:22 PST

Question 4
jrodgers (32): Why was my bid cancelled? Mar 20 10:29 PST

Answer
Seller (23): because i had so many requests to sell different individual issues that I decided to sell them that way rather than selling all of them together. Mar 20 11:36 PST

Question 5
jrodgers (32): Thank you for you response but Yahoo rules give two reasons why a bid can be cancelled. They are: When a bidder has asked you to remove their bid. Bidders do not have the ability to remove their own bids, and must request that sellers remove their bids for them. When you suspect that a bidder on your auction does not mean to follow through with their bid, or is otherwise behaving dishonestly. As neither apply in this case I believe you may be in a "breach of contract" situation. The only thing I can do then is report the situation to Yahoo! and let them take the appropriate action.

Question 6
Answer
Seller (23): So, if I had decided to sell the Denise Richards copy to someone, even though it was pictured on this auction, which, by the way, states that they could be sold seperately, would you not have wished to cancel your bid? I think you would have if all copies would not eventually have been included & I had changed the auction to sell them seperately. That was for your benifit, so you would not be forced to buy the remaining issues after individual ones were sold. I suppose I should have just let YOU worry about that.... I have barred you from my bidding on ANY of my auctions from this point, because you're an idiot! Mar 20 19:35 PST

Yes....I will get over it, but for now it makes me mad that a seller on Yahoo! can do something like this to a bidder. I have filed my formal complaint with Yahoo! but doubt they will take any action in light of there downward spiral during the past few weeks. The seller would never get away with this on eBay as it would be considered avoidance of their Final Value Fees and she would probably be suspended over there.

I've never known seller can cancel bids like that except with ebay.

In my case I won a car auction and the seller relisted it in less than 24 hours and sent me an email saying that I had to bid such an amount to win and responded to my negative that I didn't really win the auction.

Bid cancelled by seller

Why was my bid cancelled?

Mar 20 11:36 PST
because i had so many requests to sell different individual issues that I decided to sell them that way rather than selling all of them together.
-----------

Clearly this is no longer an auction for the lot pictured and any bid will be canceled. So why hasn't the seller canceled the ad? Or edited the photo or description to something that IS available for sale? Very underhanded business practices. IMO publicly namecalling & blacklisting a bidder with a very valid issue is pure sleaze. You should be glad you don't have to deal with her now.

By not cancelling the ad it becomes alomst free advertizing. If someone bids now she will just cancell the bid and tell them she is selling them individually. It's also fee avoidance. Rather than list them individually she just sells from the pile.

Think I will take a picture of my house and state that everythig inside is for sale...just make me an offer on each item. Think of all the fees I could save.

Unfortunately, being suspended from selling on Yahoo is not a form of punishment, but rather, a form of reward.
