Does Yahoo permit listings of items that the seller does not have? I have seen a few listings for DVDs that have not yet been released. What happens if I place a bid, win, then the manufacturer decides to withhold release of the item? I know eBay won't allow this.

I'm pretty sure that Yahoo does not like presells. However, I don't think ebay has a restriction as I have bought several presell items on ebay.

Yahoo has a strict policy against auctioning items which you do not have in your actual possession at the time of the auction.


Guote from 'sellers guide' on what you are not allowed to sell:


"Items that you do not have the legal right to sell, including any items that do not exist at the time of the auction"

That means anything not yet produced and in your hands.

I agree that the "does not exist at the time of the auction means "not yet produced", i.e., not made or manufactured yet.

However, it does not state "not in your hands".

I know many small business people who do business by drop shipping. This is one method by which you would not have the merchadise not "in your hands", but still have a ready inventory of merchandise to deliver to the customer and the legal right to sell it in whatever manner you wish.

I also know quite a few people who have sold merchandise for others, they dont actually have the merchandise "in there hands", but they have access to it after the sale, and they have legal right to sell it with permission of the owner of the merchandise.

I think its fine to state your opinion, quite another to state as a fact what TOS and Guidlines simply do not state or mean.

Many People do Use Drop shippers but your Not supose to If what gets bid on comes up out of stock and cant be shipped the buyer can cause you problems and if you ran a dutch auction for outr of stock items you could get a lot of negitive feed back at once.
