this might pertain to your prev list of auctions conditions you posted:

24. SELLER SETS RESERVE: Sellers are obliged to sell their non-Reserve
Price Auction item at the current high bid to the current high bidder
shown at the time of the auction's close regardless of any statement to
the contrary that a seller may include within the item's description.

from ebay's list of reasons for ending auctions, all of which, they say, are NOT DISPUTABLE (their caps).

Thank you all for all of the Thank Yous! My dad enjoyed everything and said that he would come back at a lter date if needed.
Something that I would llike to add:
I know that deciphering what an attorney can says is sometimes frustrating. My father tends to talk in a lot of howevers and thuses. MY spin on things is that the contract that we as sellers have with ebay is extremely one-sided, but a contract nonetheless. They are the big dogs and we are the little dogs that must stay on the porch and yap! Reason being that individual lawsuits would not work well is that damages would be so small that they would not be worth pursuing. I am sure some of you have lost much to the VERO program, but it is still small compared to ebay's clout and money. That doesn't make it right, just the way it is.
I might add that it seemed quite odd that Jeffdefender can interfere with other's auctions without repercussion. Seems to be some favoritism there and that is certainly a breech of our contract. What do we do? the suggestion was to band together and go elsewhere, or to contact the Attorney General's office to force some type of legislation. There are no easy answers...unfortunatly the contract that we all agreed to is binding, and VERY lopsided, certainly not in our favor.

I would like to thank your Dad for his time and the very detailed answer. It gives a lot of food for thought and has made me think what other old laws and decisions are lurking waiting to be applied to online commerce.

oldstuff pere et fils, just got back from a meeting and had a chance to read the very interesting and informative dialogue. that was one law school education that clearly was put to good use!! thanks for the time and for sharing your knowledge with us!!

I just want to say THANKS AGAIN. As most people on this board know, I am a law student. (Which probably explains why my questions may be incomprehensible---besides OCI is going on, lawyers know what that means )This was a great learning experience, and learning like this is partly why I come to AW. Even though I can ask, and have asked, professors these questions, it is great to have the viewpoint of a practicing attorney. I am going to print out this thread for future reference. I have also discussed this whole event with several folks around the law school and at firms and everybody thinks it is novel and great.

Thank you, thank you, thank you for sharing some of your "billable hours" with us. And thanks to AW for making this possible

Wow!!! What a phenomenal thread! Thank you so much Old Stuff and especially Old Stuff Senior!!! I just got my first chance to read the thread, and I learned a few thing for sure!!! That was fascinating, and of great value in bringing clarity to what can be very confusing. Of course we could probably keep you both here for eternity answering questions! Ahhh, it's been a full year since the JeffDefender threads! It's still my favorite stuff from Auction Watch EVER(I know I started the original thread, but that's not the only reason... I don't recall seeing such a strong mobilization of common effort as the AW clan put together at this time).

Magazine_guy, do you know how to call up and repost the original JeffDefender thread? I don't know how to find it on AW....

Nice to see that everyone benefited from my dad! BTW...I guess after all this time you should know that I am a woman, not a man as most have thought. Also, wanted to say goodbye to everyone on the board...have mainly been lurking lately, but have acquired a wealth of information over the time that I have been here. It's been fun, but I'm done.
