I had invited the seller her to post his side as I like to form an opinion with the full story. He e-mailed me the following:

"Please look and see that had she approached me and said she was mistaken I would have GLADLY refunded her money. Her first email accused me of fraudulent activity. She admits that SHE did not know there were a total of 14 tapes and that it was MY duty to tell her BEFORE she bought it. I would VERY much like your opinion. Does Vol. 1-4 in the title not tell you that it is not a COMPLETE set?"

Sounds like an okay guy who was put on the defensive with the buyers first very emotional e-mail. Lesson for buyers - work it out with the sellers in a calm, cordial manner.

But, I would still like to hear from the buyer as her statements do not add up. There is no way she could have already shipped one of the other wins as they were after the date she said she shipped. So she sold an item she did not have. When received emotionally e-mailed the seller claiming fraudulent activity. Then either shipped out the set with the four she received - which will piss off her buyer or she was lying and never did make the shipment.

Please come back and explain yourself and let us know if you have resolved it with the original seller.

IMO, I've read the auction and I would have to say, that it plainly states that it's VOL 1-4 in the title. The text of the description states "Chapters 1, 2, 3, and 4" It does not say "set" anywhere within the title or description. Most of the other auctions, of this type, say "set" if they are auctioning off the set. I see other auctions, that are auctioning off .. as an example "chapter 2".

These maybe technicalities.. but it would appear.. by the different auctions out there.. that this is a case where the buyer's responsibility is to ask questions and then bid.

I am the seller involved in this transaction. First I would state that the title in this listing PLAINLY stated Vols 1-4. I feel that my listing was not misleading. I would have been glad to have refunded the money to the buyer had there been a different approach. The FIRST email I got from the buyer after receipt of the videos stated "this is FRAUDLENT activity." The second email from the buyer stated "You knew EXACTLY what you were doing when you stated four vidoes. Another email stated "No one Else has the gall to sell a PARTIAL set." Number 1: This is a mini series and not a normal movie. A look at other mini series sold on eBay such as Winds of War and War and Rememberance will show other listings just like mine in which SINGLE volumes or multiple volumes of the series are sold without the complete set being sold. In my listing I clearly stated Vol. 1-4. Why is this any different from any other partial sell of a multiple volume set. Another email from the buyer stated "You are wrong, you tried to pull something over on someone and I just happend along and Whamo." It is because of this attitude that I refuse to refund the money. I feel that unjustified and undocumented statements have been made to me directly and through this message center. I full intend to seek any and all recourse available. My feedbacks speak for me. I have only been a member of eBay since May of 2000. I have accumulated 715+ positive feedbacks in that short time. I am a professional and a CPA. I have sold items on eBay ranging from $1.99 to $4500. If I were interested in "Fradulent activity" why would I pick such a low dollar item. The buyer made mention in the complaint that I made mention of acquaintances and family wealth. I believe the buyer forgot to mention who started listing "references." I simply responded to the buyers listing of "business partners." This is PURELY a misunderstanding on the part of the buyer. I would have been happy to refund the money had the buyer asked me kindly and not started the contact with accusations. I feel that it is the responsibility of the bidder to question items which they are not sure of BEFORE they bid. Another of the buyers emails state: "Obviously did not won this video before, I have no idea how many 'volumes' there are?" If the buyer did not know what they were buying why did they not question BEFORE bidding.

I just want to add one more thing. At the time that this listing was running, there was another listing for a 10 volume set of this movie. Therefore, both 4 and 10 would have shown up in the search. Searches in the "past" auctions would have shown, at the time of the bid, that others have posted single 'volumes' of this series of tapes.

IMHO the seller followed all the rules and conditions set by eBay. The bidder assumed a lot without confirming before bidding.

Would be nice if amellia explained how her bostonlvr id that bought the tapes wound up bidding on the auction by her amellia id which lotsafuzz found.

you shouldn?t worry so much about my Bidders because as you can see from my feedback I take good care of them.

A bidder on auction 507043211 was about to win the auction for $17.15 with a maximum bid of $21.14. Then with your bostonlvr ID you bid, 20 minutes before the end of auction, over his maximum. The second bidder should have won that auction for $17.15. I wonder if this bidder would think you took good care of him/her if he knew bostonlvr( auction winner id) and amellia (the seller id) were the same person?

You brought this issue here and we just did research 101 - easy to find what looks like shilling and you lied that you had already shipped out the set as you had not won the other two you bid on yet.

You have not answered lotsafuzz and others questions as to why your own 2nd ID bid on your 1st ID's auctions nor have you answered my questions regarding your false statements.

Of course you will not be posting here anymore as there is really nothing to say as it is very clear what is going on here and with your other auctions.

I hope for your buyers sake you quit bidding on your own auctions and that you are less emotional when you have problems with sellers.

If you pass this onto safeharbor against your seller he has the right to also report you for bidding on your own auctions - I think safeharbor will be more interested in that than the fact that you bid on an auction - won exactly what you bid and then went berserk and blamed the seller.

This is exactly why I think both parties should be here when these accusations are made - seems to also be truth in the old adage - that there are always two sides to every story.
