This reminds me of another thread, only the seller was having trouble with the buyer.
The majority opinion of the posters was to return the buyer's money and be done with it, but the seller sent the item instead.
True to form, the buyer said she never got the item. (Even though supposedly it was sent with delivery confirmation. )
Now it looks like the seller is in for a hassle with this buyer over insurance, or refund the money and be out the item and money.
In my opinion, if you send the item back to the seller, I really don't think you will see your refund.
I would do what most here suggest, keep the item, give it as a gift, whatever, and report the seller to Vero and ebay. After all, no one likes to be taken.
Unfortunately, sometimes brand names are used, do you ask for a "facial tissue" or a Kleenex, which is a brand name.
I don't think this is the problem here though, otherwise the seller would have been more receptive to your complaint.

OK, this is the reply that I got from this guy today, whadya think?

Oh for Pete's sake, now he is trying to make you feel guilty!
Tell him very sweetly that that is a great idea, submit your name and address (in case he "lost" it) and tell him when you receive the refund that is exactly what you will do.

Oh sure, he gives that money to charity! Judging from his feedback that statement just doesn't ring true. I think you shook him up a little, or maybe a lot.

Glad this worked out for you, but I also think asking for a refund first before sending the merchandise is way out of line. I would NEVER send a refund to someone without the merchandise first. Since I sent it to them with payment, they can expect me to send payment back after I receive the merchandise back.
Also, while I do offer to pay postage both ways when I take returns (and I've had two returns in the past 2 years) that doesn't always happen.
Next time if you are in this situation, my recommendation is to be a lot less hostile (I know you toned it down from your first draft!) and don't ask for the money first without sending back the merchandise. It's only going to cause problems!

ahc, I know. And I really did mean to delete that from the email. It was late when I sent it, and I had been doing alot of editing. But, I did tell him that, and I offered to do it the normal way. I asked him to send me his address and instead, got an offer for a complete refund.
I am going to send him my address, and see if I really get a refund, and if I do, I think I will send him the bear back. I don't really feel right keeping it.

Ack! This is what happens when you read too fast. I somehow missed the post where he said he'd give you the $ back !! If he did that, I think a neg may be too harsh ... but a neutral might work. IMO of course - I haven't been dealing with him up close and personal.
I do think you should not send back that bear, as he obviously has no plans to change his current mode of operation. Toss it in a bear collection bin at the mall or something like that.

I've been calling them beanies since before there was a TY and they had real beans inside. Thank goodness I don't sell them. I hate the little creatures. They're ALL beanies IMHO.

I'd be tempted to reply with something like,

Thank you for your response. However, I'm still dissatisfied. <Reason for dissatisfaction here.> Also, I think you have a silly name and I'll bet eBay doesn't pay you much to cut and paste these canned messages. <Reason Crockett doesn't have a better job.>
If I had thought about that, I would have sent it. Maybe minus the part about <why crockett doesn't have a better job>
On the up side, I just recieved 18 emails, all but 2 have said the seller was in violation and has been warned. The good thing is, they were signed by various names, so maybe he received 16 warnings??!!! Oh well, I'm going to send him my address, and after he gets all these warnings, we'll see if he sends me a refund.

Oh yeah, I would never *really* send such a rude message (even though I wonder whether the names they give are real... Crockett and Siegfried?) -- it's just a fun fantasy!
Just an update on the bear saga. First of all, I sent him an email with my mailing address so he could send me a refund. Never got a response, so I sent all of his applicable auctions to ebay and I contacted Ty. Ty was very interested in the situation, and requested the auction numbers. I sent those over the weekend. Now I feel a little bad. I got the check today in the mail.
But hey, I'm still doing the happy dance!!!!!! I was totally befuddled for a few minutes, there was NO information on the check, AT ALL!!!! and we all know how frustrating that can be. Now, we just have to wait and see if it goes through. The money is being donated to charity. The bear is sitting on my desk, as a gentle reminder of the lessons learned, and, if the check clears, that sometimes it pays to stand up for what is right.
I'll let y'all know if the check bounces. I'm also holding feedback for another 2-3 weeks.
