Ok, let me know who the person is and how many times you have advised Paypal that this merchant is a crook. They then have a duty by law to not allow this crook to continue on their site. Let me know.

I am not operating under any pretense of being a concerned consumer - I am a concerned consumer, who is trying to get information from a Company who is protecting crooks and preventing me from getting my money back!

Ok, Mr. PaypalDamon…Let’s see you put your money where your wordhole is:

The criminal entity you are representing has restricted my account (BarrySDCA) and held up $795 of MY MONEY. Someone sent me $10,000 for a business deal and I was able to retrieve all but this last $795 of it before your partners in crime restricted my account, accusing me of fraud.

Well…this is the only transaction I have received and there have been no fraud complaints against me - none - zilch - ZERO! The person who sent me the funds had over $180,000 in his account and you froze his, too. He hired an attorney and you finally released his funds, but my $795 seems to be too much of something for you to release the restriction.

You have ALREADY verified my account, however you still seek “additional information”. I have sent you all the information I will provide, as you are not a financial institution and not bound by the same privacy rules as the bank down the street.

However…I GUARANTEE you will verify my identity when my lawyer contacts you. (It is also on the BBB complaint I just filed, but they tell me that you don't answer them).

So, let’s see how long you take to release my funds or what poor excuse you can come up with this time. It has already been three months.

For anyone interested, I will post what happens with the issue. I did send my real Email address to PaypalDamon, as requested. Here is the reply:

trigger is that large dollar amounts went out quickly (and were withdrawn
quickly). This is a possible indicator of money laundering and it is why the

This is a legitament business transaction. We were contracted to build a web site and have already started the project. I will keep you informed of any progress or poor excuses that come this way.

As far as the Paypal rep on here, he really does nothing except allow the matter to be stretched out until they bilk everyone and then file bankruptcy. It comes from the hierarchy to screw and victimize unsupecting people. Beware. Don't use Paypal - they operate illegally.

As of 5:30PM today, I did not hear anything further addressing my issue so the following message was sent:

It's past 5:30PM and I haven't heard anything. I believe that I have exhausted all my options to settle this matter amicably. If the restriction to this account is not removed, allowing the pending transaction to settle and the user "BarrySDCA" account closed by 5PM, Friday, June 8, 2001 then this notice shall constitute intention to seek binding arbitration in accordance with the electronically published Paypal Terms of Service. At arbitration, I shall seek damages in the amount of $795 + additional fees and expenditures associated with the arbitration. Additionally, the current electronic mail address on file for the Paypal user "BarrySDCA" shall then be deemed invalid and any communication from Paypal to the user "BarrySDCA" shall be forwarded to the US Postal address on record with Paypal.

As you can see, it smells like more of the same hot stinky air. I’ve had enough already and am seeking arbitration under their terms of service. At least this will move it closer to a courtroom.

UPDATE: PROBLEM RESOLVED!

As promised, here is the update to my nightmare with Paypal. I received the following message from Paypal this morning:

until we receive the requested documentation. Once we receive that
documentation we will review your account and lift the restriction.

To which I immediately replied:

I believe this is the heart of the dispute. The documentation you are requesting is a clear invasion of my privacy and will not be forthcoming. However, in good faith, I will be happy to send you a copy of our business license and/or federal tax ID. Any further documentation is really a mute point as it has been past three months since you initially restricted the account.

If this is not acceptable, then I will continue to seek arbitration in accordance with my previous message to you. A copy is below for your records.

[my final demand and intention to go to arbitration can be found above in this message thread. I left it out so the message doesn’t get too long]

First, let me say that I did indeed have every intention of going to arbitration and our company attorney was already under instructions to prepare the case. However, not more than 10 minutes after sending in the reply, I ACTUALLY RECEIVED A TELEPHONE CALL from Brian Lopez. Mr. Lopez said he was from Paypal and inquired into our business. He asked for our web URL, which I provided.

Get this: He was checking out our web site while online. He actually asked where it said that we accept Paypal. Was he kidding??? There is absolutely no way in hell that this company will ever accept Paypal again.

Mr. Lopez took the information and said he would call back in an hour. He actually called back in less than an hour with news that the restriction had been lifted. I verified this by visiting the web site.

So while I can’t say if Damon was the catalyst here or if it was our intention to seek arbitration, but I can tell you this: don’t make any threats that you do not intend to keep. We were actively preparing to arbitrate this case, which Paypal clearly would have lost.

For those of you who are interested in arbitrating your case with Paypal, you should contact an attorney to resolve the issue. You can also find help via the American Arbitration Association (www.adr.org).

I will, of course, keep www.PaypalWarning.com online with horror stories from this company and helpful links to those who need it. Please keep the feedback coming and good luck.

I am filing an abitrary dispute as I write this message to you. I am greatful for your assistance, Barry.

I have also filed the claim with travelers with the president of claims.

Contact me for further information only those who have been defrauded by paypal or had their accounts closed when they complained.

You have read what files? Your employees files, the ones who claim that my
account is unrestricted only for me to go there to see that it is further locked up?

Why did you write to me? I wrote you about this matter months ago, and still no change. I faxed a 19-page summary to PayPal and still no resolve. In fact when I became further upset at the lack of professional legal treatment from them, they told me twice that my account was unrestricted and fully accessible. When I got to my account it stated that it was locked.

I consider this retaliatory. They have caused many NSF and Overdraft fees to
hit my account and my bank finally because of all the confusion closed my account.

Paypal has not paid back my fees of which I had to pay to restore the loss to my bank.

Don't write me back with inflammatory statements and insults to my intelligence. I will leave PayPal alone when I get my money back.

Now what???

Just do it this time! Just do it!!! - and stop making excuses and false pretensions.

HERE IS THE CLARIFICATION PER YOUR REQUEST:

Wrong, Damon. That is a lie.

1. I purchased an item.
2. I used PayPal for the transaction.
3. This was done back in December of 2000.
4. The item was a piece of junk, and after many attempts with the seller, he refused to refund my money.
5. I then contacted Paypal and filed a Buyer Protection Claim, and a Fraud Report. It appears that this seller has defrauded many people and PayPal was sent at least 50 different complaints about this seller regarding his fraud.
6. Still PayPal ignored my filed complaints with them. They told me that it would take 30 days for an investigation.
7. After PayPal continued to ignore me, I finally went to my bank and asked that they credit my account back. They did.
8. After they credited my account, I then notified Paypal that my bank had already done the credit and never mind their crediting back of my account now.
9. I told stipulated to PayPal not to re-charge my account because my bank had refunded my money back on their fraudulent transaction.
10. Paypal went in and charged my Account BACK ANYWAY, the $87.06.After having done this, this caused my bank account to explode with deficit to the tune of $712.50 plus other NSF and Overdraft fees to other merchants of whom I had written checks to.
11. Paypal's excuse was, well you should not have told your bank to credit your account because we would get our money anyway and charge your account.
12. Still nothing on my buyer protection claim.
13. When I finally after about 2-3 months continued to complain, your staff then claimed to have investigated my account with regards to my buyers protection claim. Still no resolve and many lies by your staff.
14. I must have phoned and written to your staff a total of 35 times, but still no resolve and continued dishonesty about the account having been resolved and investigated.
15. All I want back is my money to the tune of $712.10.
16. Paypal never should have gone back into my account to take money that they were not authorized to!
17. I had also filed a Buyers Protection Claim regarding another seller who defrauded me. Your company paid that one but only because it was about $8.00. The larger amount that I was defrauded by the seller who I believe is allowed to still use your site, Bargaintown, was refused by Paypal, but they had finally after months of complaints only refunded one for nearly $8.00.
18. It seems that you are not going to be a help either, and I guess it will be just as that in court. Consider this your last warning because I am extremely angry and your staff has hung up on me, ignored my complaints for months only to close it after they have only spent a few hours on it, and they taunt me sending me emails that the account is up and running, and accessible, and no longer restricted or not locked up anymore. When I go there, it is still locked.
19. How many laughs did they get off of that one??!!!
20. Well, I am not laughing and never was!
21. Because of all the confusion, by bank just closed the account because I was doing business with Paypal and this is not the first time. I have given you all 3 chances to fly right. A person can only take so much.

Thank you Paypal Damon. Now what? Should I proceed on with the suit that I have started? I am decent person and have given you all the benefit of the doubt to compensate for the unluckiest and dizzballs you have working in your company, but I have grown very impatient and am no longer forth giving.

Is my money going to be refunded today or not? Simple yes or no.

How much money has my bank received? When was this done? How much money are you stating that Paypal honored to my bank? This is money that belongs to me not my bank! My account is closed. When/what day was this done? I have gotten nothing to stipulate to what you are stating above. Please provide all details. Something is wrong here!

I am going to point to one specific item in the post:

From the terms of use (cut short for ease of reading):
ii. Additional Protection for eBay Auctions.
This Additional Protection does not apply to disputes about the quality or attributes of delivered goods, goods that have been lost in the mail as shown by seller's presentation of proof of shipment, payments for services, payments to Unverified sellers, or a seller's failure to deliver intangible goods.


In addition, before filing a charge back, the terms of use dictate that you let us complete the investigation (and attempt recovery) before doing so. You did not follow this procedure.

I don't have all of the other details you are alluding to in your post (bank fees,etc), but I do know that this matter has been escalated to the appropriate parties and that the information you have been given by these parties is correct.

I ask that you cease any further contact with me because you are digging the hole deeper and mess is awfully smelly.

You have been absolutely no help as I thought. It will be nice when people like you and businesses like Paypal are all six feet under. The world will be a better place.

Out for good. My attorney is handling it and arbitration is also.
