I received an email today from a reputable company concerning Cyber Rebate. Here is an excerpt of the message I got:

We just learned that CyberRebate.com has filed for bankruptcy. If you
have
made a purchase at CyberRebate and have not received your rebate yet,
we
recommend the following immediate actions.

1) Call your credit card company and dispute ALL charges. If
necessary, call the customer service department of your credit card
company,
explain the situation, and ask them to reverse the charges immediately.

2) Check to see if your credit card has any return guarantees
associated
with it. Credit cards like American Express Blue, for example, have a
60-day
return protection policy that might help.

3) For transactions with a check, contact your bank to stop payment on
your
check or simply void your check if you have not sent it yet.

ad one more ripoff to the growing list of online fraud.. does any law enforcement ever take place???

I was wondering about this company. I did order something a while back but did get a rebate check but the check takes about 3 months I was wondering what kind of scam this was or if it was an OK company? Anyone else buy anything and actually recieve check lately ?

I got paid the first go round.

Second go round, nothing. They owe me a bunch.

they owe me over $300.00 for 2 items. theft of that amount in my home state is a felony.

It's not theft you are a victim of a bankrupt company.

You will get paid just like all the others owed money.

I knew there was something iffy about this comp[any that is why i never ordered from them.

Your best bet would be to do a chargeback on your credit card.

otherwise you will probably recive $.05 on a dollar like other creditors.

I just got off the phone with Visa. They agreed to initialize the chargeback paperwork on the 11 cyberrebate charges on my account.

There is 1 additional charge that I am not disputing because cyberrebate followed through on that one and I received my rebate check for it.

Any chance I can do a chargeback if the charge is more than 60 days old? (mine is 2 weeks past the 60 days!!!)
Does anyone know?

Visa told me that anything over 60 days doesn't show up on their screen, but I was to highlight that charge on my statement and send that with a letter stating I wanted to challenge that charge, and the reason, to the address on the back of the statement.

But the only one I had over 60 days was the one that Cyberrebate actually paid me my rebate on.

Most legitimate chargebacks are processed for the cardholder for many months, even years later, regardless of the stated time limit.

This case is a little different.

For one thing, the legitimacy of the chargeback is not purely white. The company did deliver the goods, and it's less than obvious that the rebate was merchandise paid for by credit card.

Secondly, there is usually some merchant who takes the loss. In this story, presumably, some bank is on the hook, Cyberrebate's merchant bank. "The system" tends to take care of its own, which might result in a harder line regarding chargeback limits.

It can't hurt to try, because from a moral perspective, almost everyone will agree that the chargeback is legitimate.

A very nice lady on the RefundExpress website shared this link regarding the CyberRebate Bankruptcy. People are getting together here to share ideas and contacts on how to handle this mess.

Although I didn't notice posts regarding anything other than CyberRebate I am not able to post the url here as it is against the AuctionWatch rules. Please feel free to email me at [email protected] for the url.

I am now counting my blessings as I didn't lose hardly anything compared to some of these people. This is so sad.

I truely hope that by all of us joining forces we will be able to get some kind of justice.

I have a little bit of "inside info" that might help. Cyberrebate is local to me and I did speak with an employee (former employee) and once long ago with the owner and recently with an officer in a major credit card company.

1) this was not fraud. this was a company with a plan that might not have been well thought out and resulted in bankruptcy. Anyone who is owed money is a creditor and can get in line with other creditors.

2) the success of a charge back depends upon a) your credit card company and their policies and b) how you phrase your complaint.

Charge back forms have certain boxes that have to be checked off. Among the common ones, "item never received" or "item not as described." "Didnt get rebate" is NOT one of the choices. So if you harp about the rebate, chances are your credit card company won't know which box to check off and your claim will be denied. However, if you state that the item was not as described, because you were supposed to receive for example, a free radio and a $50 rebate coupon and the rebate coupon was missing, therefore you are charging back $50, you stand a better chance. I have suggested this to a few people and it worked for them.

I FEEL EXTREMELY LUCKY. I FOUND THIS CO. WHEN IT FIRST STARTED OUT AND PLACED 2 ORDERS TOTALLING $18000.00. I RECEIVED MY LAST BATCH OF REBATE CHECKS 60 DAYS PRIOR TO THEIR BANKRUPTCY. HMMMM.....DID I CAUSE THAT? HAHA. GOOD LUCK TO ALL OF YOU. THIS WILL CERTAINLY MAKE ME THINK TWICE FROM NOW ON, BUT I HAVE THIS BAD HABIT OF TRYING TO GET ANYTHING AND EVERYTHING THAT IS FREE.

you can do chargeback up to 120 days after purchase.
now if a company is bankrupt,what good does chargeback do??
i thought the terms said a company in bankruptcy is protected from creditors until it works things out.
also if there is no money in that bank account,all these chargebacks will just accumulate in that account as debits??
credit card company always said the customer does not have a case if he still have the merchandise/
first you must rid the merchandise by returning it to the seller,i doubt if missing a rebate coupon is good enough reason for chargeback.

Hello everyone....
This is Jon T. I have posted a few times to several different boards and am back to let you know of my current action.

(1) I have a sample dispute letter that I sent to all of my credit card companies (NextCard, Aria, Amex). It's yours for the asking... just email me.

(2) I have also contacted a local attorney who specializes in Consumer Law. (see his profile and contact information below) He has won successful cases against Buy.com and has other pending litigation against other credit card companies and consumer service businesses.
I had an initial consultation with him in person and gave him copies of all my documentation. He will review it and let me know within a week (July 24th or 25th) if I have a case that he'd be willing to take - it could be either an individual or class action suit. If it's a class action suit and he decides to take the case, he will take it on a contigency basis.. meaning no out-of-pocket expenses for the plaintiffs (us) and he only gets paid if he wins the case. The amount sought would be the total amount all plaintiffs in the suit have lost to Amex PLUS his attorneys fees... 33 1/3% of total amount sought if settled before trial begins, 40% of total amount sought if settled after trial begins. However, I stress that all expenses would be paid for by Amex IN ADDITION TO the total amount all plaintiffs in the suit are owed by Amex.
In other words: you would recover your charges, interest, finance charges, etc. and not pay any attorney's fees.

I will post an update as soon as I hear anything from my attorney and please contact me if interested by private email so I can give him a rough estimate of how many individuals are interested in pursuing a case against Amex to recover their losses.
