I need some help here. I ran a dutch auction. I had 10 widgets for sale. One person got 4, another 4 and a third wanted four but only won two. I emailed him saying that he owed XX for the two items. I then indicated that I had others available if I wanted all four. Never heard back. Emailed a second time. Finally filed NBP Alert. He emailed today saying that because he didn't win all four, he wasn't obligated. I looked it up and he's right!

Besides the fact that I am annoyed he didn't tell me sooner, my question is this:

Ebay charged me a final value credit for the two items which are not going to sell. How do I get my money back without putting a black mark on this guy's record?

File FVF and use the reason that Buyer and seller agreed not to complete the deal.

You are correct about the bidder not being obligated to take the 2 widgets that he won.

Let's say you have 1000 identical items in a Dutch auction at a price of $10 each. Bidder number 1 bids $10 each for all 1000 widgets. Bidder number 2 bids $25.00 for 1 widget. Bidder number 2 gets his widget at $10. Bidder number 1 gets 999 widgets at $10 UNLESS bidder number 1 chooses not to take a partial quantity. And yes, 999 out of 1000 is indeed a partial quantity according to eBay's rules.
