Auction ends on 8/28. I won and pay with a money order 8/29. 9/1 seller tells me he has received money order and shipping product out.

I contact seller 9/22, tell him no product has arrived would he please check his records. He emails and tells me that procduct was shipped, but that he will be going to post office that day and will ship a replacement. (I am only two states away, 9 hour drive by car)

As of mail delivery today, 10/2, no product. I neg. I send request to seller for refund of my $5.70.

He replies that he sent my order twice, that he realizes I have filed "unjustified" complaint with ebay (must be the neg) and that now he is negging me!!

I have 105 feedback, all positive, no neg and no neutral. As seller, I leave feedback minute I receive payment. As buyer I leave feedback immediately upon receipt of product.

I have held up my end of the bargain - I paid! How can he get away with giving me a neg?? Arrrgghhhhh!

(Oh, btw, seller has 7 negs over last month, 4 in last week, all due to merchandise not being received)

Yes - That is accurate. Sub next to me is Stoney Creek - at least they did not divert it or dam it. But they did cut down almost every tree.

that happens all too often....retalitory negs and I don't like it either. Th first one hurts.......but you get over it... reply to their neg with "check their negs" . I have found people look at the entire picture, not just one part.....while this isn't fair, there isn't much we can do. I told ebay a long time ago that I would not leave anymore negs because of that. Now I at least wait until they have left me feedback as they can't leave two.....
If you paid by the mail, I strongly suggest that you file fraud charges with the Post Office.....
Of all the things I have shipped, ALL has been received.......some find it too easy to blame the Post Office.....also for all the good it will do, I would file fraud with Safe Harbor.....

Well, I am trying to be nice. This is the email that I sent to the seller after receiving a very irate one from him that still has me knashing my teeth:

Dear XXX,

If I receive the XXXX this week, I will go back in and post a reply to the
negative I left for you on ebay. That may help a little.

I do not want to get into a major war over this, but I do not think that you
understand the ebay feedback process. I do not deserve a negative from you.
I did what the buyer is required to do - I mailed you a payment in your
choice of a money order and I mailed it in a very timely fashion. You
received the payment. That is what I was required to do to hold up my end
of the auction, and I did that. You are only required to leave feedback
based on whether I fulfilled my requirements as a buyer.

As a buyer, my responsibility is to leave you feedback based on your actions
as seller. Not any other reason. I have over 100 positive feedback on
ebay, and you will see that as soon as I receive either payment or
merchandise I promptly leave appropriate feedback. The only times I have
left negatives in the past is when I had customers that did not pay for
auctions that they bid on and won.

I have not received any merchandise from you, yet the merchandise has been
paid for since late August. I have heard nothing from you, save for the
times that I contacted you first. You did not send me an email at any time
indicating anything had been shipped. If I go in and take a look at the
feedback that has been left for you lately, I have no choice but to think
that I have paid for something that I am never going to receive.

I am sorry that things have disintegrated to this, XXXX. According to other
feedback left for you, others are not receiving things they ordered, either,
or it is taking an extraordinarily long time. You might want to rethink the
way you are doing things on ebay, XXXX. I am being totally sincere when I
tell you this - I am not trying to criticize at all. But when someone buys
something on ebay and pays, it is an unwritten rule that their merchandise
will be shipped immediately. That is what the buyers expect. (Just as the
sellers expect the buyers to pay for things immediately, so the buyers
expects to get things they pay for immediately) It is also very good
business practice to acknowledge payments when they are received, and to
notify buyers when their package is shipped. I find when I do these things,
people are very happy and become repeat customers.

Maybe time constraints prevent you from covering all of the bases required
in this ebay business. Do you have someone that can help you with the
packing and emailing?

I wish you luck with your business. There are many message boards on-line,
full of seasoned ebayers with years of experience. Access some of those
lists, and you will be able to find good answers to any questions you have
concerning this business.

Well, I am now ROFLMA! I now know what some of you go through with retalitory negs and people that wouldn't know the truth if it bit them in the arse!

In checking the sellers feedback again, I see he replied to my neg with a note about his hard drive failing which is why things were shipped "late"

First I've heard about the "hard drive"! LOL!

That was a very well thought out and to the point response to the seller. Too bad it will probably go right over his head. Hopefully, all the neg's will get him off eBay.

Seems like a pretty common story.

The first neg always hurts, even more so when it is retalitory.

You have done what you can. This seller has obviously had problems with other buyers and my feeling is your letter won't do much good.

So sorry this happened to you. I know it will leave a bitter taste for awhile.
