I recently had a buyer (verified) pay via an e-check through paypal. I sent the merchandise since this buyer had a feedback of 70+ no negatives.
A week later I notice the check was cancelled. When I emailed Paypal, their response was that buyer can cancel check anytime they want.
I say this is the same as a bounced check. I have asked the buyer to reimburse me, but of course no response yet.
I am considering closing my Paypal account because of this. I definately will never accept an e-check again. At least with a paper check I can begin collections as it is a crime to bounce a check.
Any ideas how I can collect on a bounced e-check. And what about Paypal's "fraud" protection? That's a big joke.
I'm wondering if the FTC can do anything about Paypal's deceptive business practices and claims. They have made false statements.

Well uhmm doesn't it say the following when you receive an e-check via PayPal:
This eCheck Payment will remain "Uncleared" until the funds have
cleared from the sender's account, which usually takes 4 business
days. If you are shipping an item, please do not ship your item
until the funds have cleared into your PayPal account. You will
be notified by email when the funds have cleared into your PayPal
balance.
It was your choice to send the item before the e-check cleared & yes, the buyer can cancel the e-check before it has cleared.

Were you ever informed this echeck was cleared and the (PayPal) transaction completed?

It sat "uncleared" for several days before clearing. This is why I don't understand how it can be cancelled. The bidder has good feedback, so I wasn't concerned about it not clearing.
I am going to send her a certified letter requesting payment. I have already filed NPB for bounced/stop payment check with ebay.
I accept personal checks and have only had 2 bounced checks, which the bidders paid. I think I lose this one in cyberspace.
I have noticed many sellers now do not accept paypal. I have also removed the Paypal logo from my scheduled auctions and am going to try Billpoint, which is free until November30.

I wouldn't take this out on paypal they make it very clear about e-checks not to ship till after the e-check has cleared if this e-check was clear your account would auto accept the payment.
PAYPALS TOS states once a payment is cleared and accepted it can not be canceled buy the buyer or seller.
I just got done going through paypals entire
TOU TOS call it what you want.
A few things they make very clear some one who send a payment can cancel such payment up untill the time it is accepted.
After a payment is accepted it can not be canceled. and they can not be responceable for payments sent and accepted by the wrong person.
This goes for E-checks credit card paypal funds or bank transfers.
they also mention if you got scammed or sent payment to a wrong party or over payment and you paid with a debit-checkcard or Credit card you maybe able to recover your funds by starting a charge back through your bank or credit card company.

What does the buyer say - anything?
edited - sorry - just notices where you said there's no response from the buyer yet.
Did the check actually show as cleared at some point? It's hard to tell from what you say.

What does paypal consider as "accepted?" Is it when I go into my account and click on the transaction? Is it when I file it into my history, or is it when I take the funds out?

according to paypal when funds are cleared if the person you sent payment to is a registered member with an account payment are automatically Accepted in to your account.
the member has to do nothing. if you send payment to a non registered user even after the funds cleared the person you sent the payment too must register to accept the payment.
Edited to add this includes frozen accounts they will continue to accept payments and personal accounts over there $500 in six month limits.

I'm not sure you understand how the e-check works. If it is pending it means it hasn't cleared, the buyer can cancel the payment until it clears (5-7 days) the email you got from PayPal when the echeck was made should have stated something to that effect. PayPal also offers an "instant e-check" which clears immediately because the buyer chooses to back it up with a hold on their CC account.
If you take a check and the buyer puts a stop payment on it and you complain to your bank their response is also going to be "Tough Luck". You can change banks but you'll find that practice is universal, if you ship before a check has cleared it is a risk you've accepted.

I sent an email to the buyer explaining that cancelling an echeck is like a bounced check.
A new payment just appeared from her via Paypal! I was afraid I would have to eat this one--there have been quite a few no pays lately.
