FIRST CAPITALS MEAN NOTHING....i HAVE A BIDDER WHO BID ON SOMTHING WITH NO INSURACE ....I SCANED THE MANIFEST TO SHOW HER THAT THE PRODUCT WAS SENT OUT ....SHE STILL HAS NOT GOTTEN IT ....SHE HAS EMAILED ME AND TOLD ME ...IF SHES OUT OF LUCK...I REMINDER HER THAT...I DID SCAN THE MANIFEST TO SHOW HER IT WENT OUT .....SHE EMAILED BACK TELLING ME THAT FEEDBACK WOULD FOLLOW !!!I EMAILED BACK AND TOLD HER WHAT KIND OF FEEBACK....I AM NOT GOING TO REFUND SOMTHING ...IF THE SELLER CHOSE NOT TO INSURE AND I ALSO HAVE SCANED THE MANIFEST TO PROVE IT WENT OUT ...WHAT DO I DO

Did your buyer specifically decline insurance? Did you even offer her insurance?

If you did not offer insurance and give her the chance to decline it, you owe. If she specifically declined insurance, you don't owe.

You state right on there, "Product is sent without insurance". So, the buyer did not have a choice, correct?

PRODUCT WAS SENT OUT IN A GOOD AMOUNT OF TIME ....SHE EMAILED AND TOLD US IT HAD NOT GOTTEN TO HER ...ABOUT THREE WEEKS AGO..WE EMAILED HER THE MANIFEST THEN.....

I DO NOT THINK SO .......IT ALSO STATES THAT ON BIG ITEMS WE RECOMEND THAT THEY INSURE THERE ITEMS...SO THE CHOICE IS GIVEN...WOULD YOU NOT SAY??????

Was this a large item? And did the buyer specifically state they did not want the insurance? Did you offer it to them?

PRODUCT IS LARGE ENOUGH THAT A PERSON WOULD READ THE PAGE AND THINK!!!!! OK THIS GUY IS SENDING THIS WITH NO INSURANCE ...MAYBE I SHOULD ASK HOW MUCH INSURACE IS ...SEEING HOW HE HAS GIVEN ME THE CHOSE TO INSURE IT OR NOT ....AND HAS STATED THAT HE IS SENDING IT WITH NO INSURACE ....I JUST DO NOT SEE YOUR LOGIC IN SAYING THEY ARE NOT GIVEN A CHOSE ..THEY REALLY ARE GIVEN THE CHOICE...THEY CHOSE WEATHER THERE PRODUCT IS BIG ENOUGH TO INSURE...THERE CHOICE !!!!!

I looked at your TOS...You do suggest Insurance on big items...Do you mean big ticket items? If so, it is a little vague. Did you keep any proof that customer declined Insurance? That's your only hope. Was it an expensivce item?

It is your responsibility as the seller to mention the need for insurance when you email the buyer with the amount due, if you feel it is warranted.

If you do not feel insurance is necessary, you are self-insuring and are responsible for the product until the product is in the hands of the buyer and is not damaged.

Unless the buyer has been offered insurance and declined it, you are responsible.

Will back off now and see what others views on this are.

How much $$$$ are we talking?

Why not just ask her to wait another week or so, [if it was a Canada to USA shipment] and if it doesn't arrive, refund the total amount + shipping.

No sense losing a potential repeat customer over a few $$$.

And if your buyer sent you cash, and it was lost in the mail, would you ship their purchase? After all, you didn't purchase insurance on their payment....

It is the buyers responsibility to get the payment to you, regardless if it was Cash, Money Order, or MatchSticks.

Sorry East West----when you state that an item is sent out without insurance--you are basically stating that you will be responsible if the item doesn;t arrive.

You need to give the buyer an informed choice of saying YES or NO

Ship everything Priority Mail with delivery confirmation. Since I started doing that I have had no lost items.

Eastwest - I couldn't read your description as you have no auctions showing, open or closed. However, even if you included the link to your shipping page, many customers never bother to read that page. I do well to read all of the terms and conditions included in the description.

If you did not inform, and did not ask, your customer in the description or in any of the emails you sent, that insurance was not included, you should refund the money.

With the extra postage to Canada, your customer may have assumed that insurance was included, (not realizing that postage to Canada is higher).

I'm with Grape, you owe.
