Ok this is my problem. I bought an item the first week of Dec. I emailed this person before hand and asked if I would get it before Christmas, she said no problem. Well, it didn't come, and I thought maybe it was the mail, no big deal. Well Dec 30, still didn't come, so I emailed her, and she said she didn't get my payment. So I went to my credit union, and they said they would be on the lookout for it, and then I find out it was cashed! She still says she hasn't received the payment, and I emailed her telling her I had prove that this check was cashed. Do I scan the cashed check once I get it, and prove to her that I did mail it, and it is cashed? I know you all will have some input as what I should do here, please help?

Ya know, if you ask MOST people if they ever make a mistake or get mixed up, they will tell you "No way!". Sounds to me like this is what happened here. Seller probably applied your payment to another widget and shipped that to some lucky buyer that got a freebie! Definitely scan that check, front and back and email it off.
I'm waiting for something like this to happen to me, I ain't the most organized person on the planet!

Yup, definitely scan the check and send her a copy. Hopefully, it's an honest mistake. If it's not, then you're going to have to file a fraud claim with Ebay and and fraud charges with USPS. Hope it doesn't come to that, but here's a web page with some great info, if it does:

I think a neutral would be in order, that factually expresses the problem that resulted due to her lack of organization. "Seller failed to record payment; did not ship; received too late for Xmas."
