I have a seller who has been suspended. I checked before I sent my money order to him. Since I can't find out why through ebay, I sent an email to the seller asking him why. This was his response:

i was suspended for a week for profanity.i never said anything like that
though but i cant fight what ebay says

Should I trust him? This doesn't sound real valid to me, but I am relatively new. (+92)

I bid on one of their auctions last week and sent them $30. Now, he's suspended and I owe another $20. SHould I wait to see if I get my stuff from the first auction? His ratings are pretty good. 239 positives (193 unique) and 17 nuetrals (slow shipments). Any ideas on what I should do?

I've already been burned once by a seller who got suspended after I sent the money.

I think if it was me I would email him and say that due to the suspension you will only send the second payment after you have received the first item. If he is really an honest seller he should have no problem with that. I hate it when things like this happen, I hope it goes well for you. Good luck.

I was suspended for saying "Bite Me" on an eBay chat board ... it's a realistic possibility. eBay has a VERY strange idea of what is "profanity".

I can believe his story. He says he's been suspended for a week, so just wait a week. If his suspension is lifted then send him the money you owe him.

I remember the days when the cafe would have peeing dog, peeing boy, mooning bart simpson (sometimes a chorus line), colorful jokes and other things and no one was suspended!

I would also hold the second payment to see what happens with the first payment. Any honest seller would understand. However if you are dealing with a unhonest seller.....

It could be real...but ....

Baileejean suggestion is excellent. One item at a time...then, you can pay for the other. 17 Neutrals for slow shipping is no great track record.

For what it is worth, the suspended sellers in my category over the past two years were suspended for 1)incorrect contact info or 2)shilling. Those of us who are dealers and buyers share information in my category, sort of self-policing to keep the category above board for all of the buyers, so I was able to see the forwarded emails originating from ebay to the complainants on why the seller was suspended. Then I got to see forwarded emails from customers who had bids in progress with the suspended sellers, emails originating from the suspended sellers giving their explanation and story to the customer as to why they were suspended. Well, ebay's cause for suspension didn't match the seller's explanation for suspension.

OK, pretty good advice, I emailed him and explained that when I get my merchandise from the previous auction, or he is 'un' NARU'd I'd send the payment. He emailed me back today and said:

you do not have to send it now.i said within 10 days and it is after that.ill
just do a non paying bidder alert when i get back on, thanks


What does anybody else think? I have the money order ready to mail, just waiting for one of the two things to happen....I've never been hit with a NPB.

I'm sure I'll get a neg too, but, 1 out of 95 isn't anything to worry about. Plus, I can respond.

If he files NPB/FVF and you get hit with a "black mark," you'll be able to appeal it based on the fact that he was suspended. (You might not; he could pick the "buyer and seller agreed not to complete the transaction."

And, if he gives you a negative when he returns from suspension, you can write to eBay, quoting this bullet item from the Feedback Removal Policy:

"eBay may give special consideration to remove feedback upon request from members if the listing ended before the member was suspended, but the feedback was left after we reinstated the member."

The above statement was added specifically to cover situations like this.

abacaxi They actually suspended you for saying "bite me"??? If eBay censors hung out at my house for a few hours I would get suspended for life! "bite me", please, don't they have anything better to do?

Does eBay have a list anywhere about what is acceptable speech and what is not??

OK, I sent him the following e-mail...

I've got the money order here; I told you I would send it when you either got back on Ebay or I received my merchandise from my previous purchase (invoice 273), and I will. If you want to neg me, that's fine. you I can write to eBay, quoting this bullet item from the Feedback Removal Policy:

I will also forward all the e-mails, so they know what my intentions were.

If you file NPB/FVF I'll be able to appeal it based on the fact that you were suspended. Face it, who in their right mind would send money to a suspended seller!

I really was planning on buying the bears from you. If you choose to end this transaction at this point, that's fine. Your's are not the only widgets out there.


and I got this in response:

You are full of and so is eBay and you can forward that to eBay however
amny times you want. Take your money and shove it where the sun doesnt shine.
I feel sorry for people who WASTE their money on little widgets
thats really worth less then a penny.


I'm so glad I got into this transaction. It's people like this who make online auctions so much fun . He's ticked me off with this last unnecessarily crass e-mail. Does alot for keeping customers...

Oh well, now that I'm done venting, since he is NARU'd (it's been a loooong week for him!) I am still sitting on his money order, (of course, after that last e-mail, I'm going to make it out to myself and cash it . ) and waiting for my 1st order from him.

If he gets back on e-bay, what do you guys think I should do?

I think you can safely assume the seller didn't get suspended for invalid contact information like he claimed. He is probably on a 30-day suspension for a fairly serious infraction of some type.

My advice ... don't pay him. Archive the correspondence with him and if 30-60 days from now a neg shows up, go through the process you outlined. My hunch is his threats are empty air.
