According to TimeSensitive - the revised User Agreement and Privacy Policy will not allow mailing list invitations to be made in either auction listings or the About Me page. The way its phrased this included both text invitations as well as email address collecting devices. I put my invitations in EOA notices, emails with my buyers, and on statements included with their items - so I'm safe for now.
I replied with a follow up question - are we allowed to have a link to our own website and have mailing list invitations THERE and still be Ebay Legal. I asked this question not only for my own use, but I know users of Auctionwatch's Storefronts may have mailing list options available there - and if this is going to be an Ebay no-no Auctionwatch and its users should be made aware of this..
