I vowed never to return, but here I am, back on these boards, with a very serious query.
One of my friends is a huge Lady Death Fan. So, I thought for his birthday, I get him a Commisioned Artwork of the "Death-ly" Diva in something that would be a unique gift.
Today, I find in my inbox that eBay has canceled my bids for the commision auction ("Administrative Cancelation," but never NARU'd) and the artist telling me:
I was given Cease-and Desist orders by Chaos Comcs due to my use of the word "Lady Death." I've also had several other friends of mine given C&D Orders to their auctions. It wasn't bad enough they were asking for a cut of your profits over a certain dollar amount, but this is too much."
It goes on on a more "personal" nature, but that's my business.
Anyway, what the hell is going on? I did some random searches for Chaos Comics Characters in the Comic Artwork Section, many have been closed or are no longer in the database.

Maybe the Artist doesnt have the right to commission artwork on a name/trademark he sold to Chaos Comics
If Chaos Comics bought the rights to the image and name etc etc
Then he no longer has the right to sell or make anything related to this character on his own.
There is such a thing as copyright infringment on stuff you created if you sold that copyright to a company.
It happens all the time in other media.
For example
David Letterman basically created "Late Night with......"
Yet when he left NBC to go to CBS he had to create a different "Name" for his new show and "Late Night with" is now Hosted by Conan O'Brian NBC owns the rights to the show named "Late Night" Even though for well over a decade Late night was associated with "Dave"
So the artist can create artwork of this character for Chaos Comics to be sold and Chaos Comics would make their cut and market it but the artist can't produce and sell stuff with this character on his own.
