Replicas Without Proper Markings: Federal and state laws require that replica, "look alike" and
imitation firearms have clear markings permanently affixed to the weapon -- the most common
requirement is a blaze orange plug inserted in the barrel of the item. This law applies even to novelty
items, such as cigarette lighters, that are designed to look like firearms. eBay will NOT permit the
listing of any look alike weapon that does not comply with these laws.

There are some collectors that might be interested in a set of Hoppilong Cassidy cap guns. If eBay wants to hold antiques up to the same regulations as new products then it should be across the board.

"We regret to inform you that you can't sell that 1912 Oldsmobile because it doesn't meet the emissions control standards for 2001 cars, and the absense of seatbeats makes it illegal to sell on eBay."

"We regret your Edison Toaster doesn't doesn't meet the safety standards for new toasters."

Uaru..in California it is perfectly legal to sell the 1912 Oldsmobile...the emission requirements and seat belt laws don't apply to collector cars of that age. It is also legal to sell the old toaster. It is not legal to sell toy or imitation guns that can be mistaken for the real thing. So ebay would be consistant in letting the car or toaster be sold and not the gun.

The law reads as follows, as to items that were produced before 11/1988

(f) Effective date
This section shall become effective on the date 6 months after November 5, 1988, and shall apply to toy, look-alike, and imitation firearms manufactured or entered into commerce after November 5, 1988.

So ebay is over reacting, as the resale of items produced before 11/1988 is allowed. Ed

ebay has made it clear they dont make money off antiques and collectables, and they are slowly trying to let sellers know this. Their main focus now is the storefronts to draw in retailers. ebays loss is another sites gain, as collectors wont stop buying because ebay wont let the items on their site.
