I am posting on the Ebay board because I don't believe anyone really reads the Yahoo board judging from the small number of posts there.

Anyway, I made a bad mistake in judgement (at least I think it was) and purchased a large number of lp's on a Yahoo auction. The only picture they showed was 7 Elvis LP's and they made it sound like it was their personal collection. With shipping they are costing me nearly $400.

Anyway, first he tried to change the shipping amount -- it clearly stated - shipping in US only $150. He immediately tried to hit me up for another $75 and then had the nerve to say "no one else has complained". I finally convinced him he could ship them media mail and they would go for the $150 he had stated. I also told him to insure them.

Now today, he is listing the same auction on Yahoo again. Same pictures, same description. I wrote and ask how I could be getting those 7 and him have another set -- and he will no longer even respond. If I ever get anything at all I wonder what it will be and am pretty sure they won't even include these.

My question is, can I do anything through Yahoo if they were misrepresented? I paid through Paypal and if I try to do anything there will I be in trouble with them and labeled a trouble-maker. This is the first time I have ever made such a large purchase and the second time I have bought anything through Yahoo. Both experiences were bad so I will definitely stick with Ebay from now on.

He does already have a bid on the second listing. He didn't even make a new ad, it still showed the original counter on it.

Any suggestions? I know media mail is slow but every day now I am getting a sicker and sicker feeling that I have just lost $400 and others may also.

First, I've got to know what Elvis LPs you were paying $400 for! Seven of them? Then $150 shipping? I'm sorry, but there's no way 7 LPs would cost $150 to ship.

Anyhow, onto the real problem. How long ago did the auction end? If it's been more than a month you probably aren't getting the records. If you paid via CC through PayPal I'd say do a charge-back on your credit card. (No, PayPal won't label you a trouble-maker.)

Also, don't think just because eBay claims they are safe that this same kind of thing can't happen there. This kind of stuff happens all over in the auction industry, not just Yahoo!

No, I said I purchased a large lot of LP's. There were nearly a thousand in all. It's just they showed them all stacked up in the floor and the 7 Elvis LP's were the only ones that were shown in a way where you could actually see the covers. They just mentioned lots of big names. They stated the pic showed the great albums included in this auction.
They clearly stated what you see is what you are bidding on. Because I collect LP's and because they all looked to be in good condition I went ahead and placed the bid without knowing anything about the others.

Now he is running the same picture same auction exactly and has another bid and will not answer my emails requesting information about how he can be doing this. It has only been about 10 days so not long enough for my six boxes of records to arrive but I know I will not be getting the ones I was expecting if I ever get any.

My question was is there someone at Yahoo to notify and am I just stuck since I will obviously not get what I had planned on getting? I know Ebay has a good system for this but don't know about Yahoo. Besides he is doing the same thing to another person now as he already has a bid on "my" records which are relisted.

I'd suggest posting on the Yahoo board, anyway. Some people do watch it. I'm afraid their policy is to NOT be involved so I doubt they'll help even if they really should. You might try 408/530-5151, I have that noted as the Yahoo live number for "Wallet" function and payment problems.... possibly you can beg to get transferred to somebody live in Auctions.

First, I'd email this seller one more time, express your fears clearly, and outline the protective steps you'll be taking in case, say, you get these records and the Elvis ones aren't included. Ask for proof he's shipped boxes of suitable weight.... scan of PO receipt, for example. Tell him if he doesn't respond immediately, you'll lay out his unresponsiveness to your concerns in his Yahoo feedback with it initially labeled "negative". If you do so, make it accurate and calm so it won't look flakey if you later switch to positive rating with an apology addition note!


You might also call your credit card company and get clear instructions from them on how to cover yourself if either nothing arrives, or it's not what was pictured. And then you might contact PayPalDamon, his email's posted once in a while over in the AW PP area. I doubt they really want a $150 shipping cost batch of records sent to their offices as part of a dispute resolution, so they might be able to intervene with this bozo sooner than they might otherwise. I'd say first and foremost follow your card company's advice and KNOW what they require, and ignore PP if they tell you anything different.


Actually, it isn't that hard to find the auctions you mean! I note he's ALSO sold several duplicate listings, of 500 45's, BUT with a recent feedback in one case saying an adequate shipment was received however they were jukebox records and not DJ versions which his text made them sound like. Heh, so he upped the minimum to $250 on the LP's relisting after your buy at $225 on the same info? Does he have multiple batches of 500 45's and LP's to send? He might? Might've bought a truckload and this is his sales pitch, to make them sound like a unique collection. Note, it ISN'T actually exactly the same photo in the new one, the albums have been shifted around just a teeny bit. Also, tho the listing shows one bid, if you look further there's no ID handle showing as having bid, so actually there may be none.

My guess is, you'll get a bunch of records. I dunno if you'll get the Elvis ones you have a right to expect, especially considering his efforts to jerk you around on the shipping charges. Perhaps you could arrange for an independent "witness" to be present when you open the boxes and inspect them, assuming $150 shipping-cost of LP's arrive?

I see a major problem here as the massive shipping cost of $150 relative to $225 for the records themselves. Suppose he says, on complaint the Elvis stuff is missing, or the count is way low, or everything's junk... "OK, ship them back to me, YOU pay shipping both ways, of course, so I'll refund $225".... which leaves you with no records and $300 in the hole, assuming he sends the $225. HUGE pressure on you to keep whatever is sent for $400 net cost. I have no idea how a credit card company deals with high shipping charges, you again might be in this exact situation if you get a chargeback from them, too. You might actually be better off if absolutely nothing ever arrives than if huge cartons of junk appear!

this sounds like B2B-dealer to dealer transaction.he has zillion of old records to sell and he listed the 7 most eye catching ones to get your attention and you bot 1000.
hope you two both prosper.
he will send you the records,whether elvis will be there or not??
how are you going to go thru 1000 to find elvis??
corect,no auction site is perfect,ebay being the biggest,is actually the worse in my opinion.

Ok here is the deal I sell Records only thing I sell I can ship 78's 24 of them these are heavy and they are fraglie but shipping priority for $20 Pluss extra for insurance I have done this many times....

I could ship 7 LPs for under $6.00 inculdeing insurance this would be priority not media mail, media rate for a single Lps is $1.88 can ship 2 for $2.11..

I just sold a lot of 12 elvis LPs dated from 1954 to 1973 Records were in excellent used condition one had no Jacket the whole lot went for under $20 high bid Shipping $8.25 priority uninsured.
