Hello

This is similar to another post running right now. I had a cutomer that won 2 items from me about a month ago, did not respond to the invoice, then I filed for NPB, they did not respond, then totday I filed for FVF.

One hour later I get a Pay Pal payment from them, with the link to the remove NPB. They told me they needed me to do this for them, because they had gotten NARUed and wanted to have their auctions they were selling back up again.

Fortunately for them, I just happened to have their items still available but what ticks me off is that they never would have responded to my invoices had they not gotten kicked off and now are losing money on thier slaes. This also means they have been NPB's with other sellers in the past.

Since I got their payment after filing for my FVF's, can I get in trouble with Ebay if I do not remove their warning?

Here is the information from the NPB Removal request page:



"Non-Paying Bidder Warning Removal

Sellers: If you want to remove any Non-Paying Bidder warnings placed on your buyer's record, please fill out the information below. This will result in a Final Value Fee credit reversal so make sure your removal request is made after you filed a Final Value Fee Credit request for the item.

You can use this form if:

You are the seller
You have completed the process for Final Value Fee Credit, and the credit has appeared on your account.
No more than 90 days have passed since the auction ended.
Note: Once you submit this form, the buyer will be notified by email that eBay has removed his or her Non-Paying Bidder warning at your request. If there was not a warning associated with this item, no email will be sent."

IF YOU WANT TO and YOU CAN... appear in the text. I don't see anywhere that it's mandatory to overlook a DEADBEAT just because they had second thoughts AFTER THE FACT when they are experiencing repercussions for their initial decision to NOT PAY. (I could be wrong... but it doesn't seem to be a requirement on your part at this point, regarding the removal of a NonPaying Bidder tick on that bidders account).

Whatever you decide to do regarding their preference for being a Deadbeat... I think you should either send them the item (since they did eventually pay for it) OR refund their LATE PAYMENT and keep the item for relisting.

- Least, that's what I think.

Thanks very much for that reply. I actually just packaged up their items for sending, because since the items are still available and I did (finally) get paid, then that's fine by me to send them out. But I do not think they should have their warning removed, because if this was just their second warning, they would not be asking me, paying me, and would not have gotten kicked off.

So I am not going to remove their warning. And I do agreee that from reading that paragraph, that it does seem to be optional, not mandatory. I do appreciate very much your response. Thanks again.

I would not remove the warning. This reminds of a child testing their parents. How many times can I get away without paying, without getting NARU'd. I know there are many sellers out there who DO NOT file for FVFs. They finally hit 2 or 3 who DO file.

If they are selling, then they know how auctions work. I'm sure you sent out an EOA notice, then the NPB, that's 2 notices to pay, not counting any other notes you may have sent. This should not have come as a surprise to them.

I had the same exact same situation this summer too! A buyer with over 200 postitive feedbacks did not pay. Approx. two weeks after I filed the final fee request I received her check. I always email your package is on it's way when it's sent. After I did that I got this long dear john letter from her telling me that she had been suspended and asked that I remove the FVF request.

She explained not paying me by Losing my email. I find that hard to belive because I include my email address in everyone of my auction's listings, it's pretty easy to find! She also said that she never stiffed anyone, and always paid for all of her auctions, well than why did she get booted?? She obviosly stiffed two other sellers before me.

Those lies made me NOT want to remove the FVF. I thought I was obligated by EBAY to remove once paid or face possible fee avoidance repercusions.

I have justified not removing her FVF because she has never acknowledge receiving her purchase. So I feel the transaction is not over until she acknowdeges shipment.

I think ebay has stepped up three strikes and your out rule. I know other have complained that this is not much of a punishment, but some people do get attatched to their ebay names & their feedback numbers.I don't think I would have been paid if she hadn't gotten suspended.

That's what I was concerned about too--fee avoidance or some other such issue with Ebay.

But I, like you, do know that if I had not filed for FVF's I would have never received payment, not any response. After reading similar posts, I am convinced that I will not remove their warning.
