Hi, I need advice. I did a buy it now on a hard to find & expensive item at a very good price(for me.) Paid for it & a few days later seller emailed me, said sorry broke it & will return my money. She did. Now item is up for auction again & looks like the exact same pics to me & same mark on bottom. How would you all handle this? I really wanted this. It was a piece of Franciscan desert rose.

It sounds like they weren't happy with accepting the BIN price and had second thoughts. You could report it just in case the seller has a habit of doing this and ebay is keeping a record of complaints. I doubt they will help you though.

You could e-mail the seller and tell them that you noticed that they found another one of the hard to find pieces and see what they say.

Thanks for your suggestion. Some more help please. I did email the seller & got the below in a second email. Her first email stated she & a friend found the second one (same auction pic used, same condition, same mark on pottery). I would still want it. I couldn't afford it otherwise.
Guess my ? is: Can an auction be pulled legally after it receives bids? Help.

"There are two bids on the item as of this morning. I would like ot pull it today if possible. I will not be home until around 3:00 PM. Do you know how or if this can be done within rules and regulations? If so, would you kindly email me ... or call me on my cell phone at XXX. I would like you to have this piece if it can be done - but would like to handle it correctly on eBay. Your support / direction would be appreciated

Yes, she can cancel the bids and stop the auction. She will be stuck for her listing fees on the second auction though.

I hate when people do that!~ L I hope you get what you originally bid on! No way it broke and has the same auction a few days thereafter ! Boo!

583 items came up for a search on "Franciscan desert rose." Maybe you could get a better/same price on another auction in case seller waits too long to stop auction. BTW that pattern is beautiful.

Mustangs49, sorry I didn't get back to this. Are you paying the same price as you would have for the first one that supposedly broke?

I would wonder about the truthfulness of them finding the item again so soon and if they did, why didn't they contact you instead of listing it? If I was the seller and broke something and then found another one right away I would contact the bidder pronto to let them know, especially if it was a harder to find item.

I hope it works out okay for you.

I agree with what the others have said..As far as your initial question.."safeharbor" forget it..there is no such thing..from my experience ebay is not interested in investigating fraudulent claims.

I don't think they are all that interested in handling disputes either. Months ago a buyer gave me a glowing feedback and then clicked Negative. Both she and I contacted Ebay and they would do nothing. They just said we could add to the comments on the feedback page. Fast forward to Safeharbor. Since Safeharbor came on the scene, I decided to try again. Both the buyer and I agree it was a mistake. I have to pay $20 for a mediator just so Ebay will take it off my feedback. They won't take if off your feedback unless you have a mediator. No matter what you and the other party decide it still has to be approved by the mediator to get if off. I guess I'll pay the $20, but I shouldn't have to.
