I hope someone can tell me how to go about this. First of all, we sell wedding dresses. After a year without firm TOS, We decided to "get tough" and put the rules on our auctions. They are easy to follow, nothing out of the ordinary. But, in this line you get a lot of "dreamers" that will run their bid up and never pay just like those who come in our shop to play in the wedding dresses with no intention of buying because it's "fun". TOS listed on the auction page
Anyway, we had one end a few days ago at $306.00, right after EOA we got this from the "request for total "---The buyer entered the following message: I NEED TO KNOW THE COMPLETE TOTAL AND WHAT DATE TO PAY IT BY. ( this is when she provided her name address, phone # etc)
We responded and the next morning got this---I TRIED TO SEND AN EMAIL YESTERDAY THAT DIDN'T GO THROUGH. I GOT HOME AND
HAD THIS CONFIRMATION ON MY COMPUTER, AND APPARENTLY MY STEP-SON TO BE
BOUGHT THIS ONLINE THINKING IT WAS A GAME. HE SAID THAT HE WON ME A WEDDING
DRESS AND DIDN'T REALIZE THAT YOU HAVE TO PAY FOR IT. HE SIGNED ME UP ON
EBAY AND I'VE NEVER EVEN VISITED THIS SITE. PLEASE PASS ON TO THE NEXT
BIDDER.
THANKS,
JESSICA SMITH
Here is what we told them (by the way we get all kinds of excuses when a person wants to back out)---
Hi,
I'm sorry it doesn't work that easy with eBay. We just can't pass it on to the next bidder. You have won this auction, and this is a legally binding contract according to eBay rules. Sorry to sound so blunt, but in this business we hear all kinds of excuses for wanting to back out of an auction. Payment is due in 7 days, or as stated in the auction, legal proceedings will ensue.
> Thanks,

This morning she writes back with---
SO, SINCE I DIDN'T ORDER THIS DRESS, I AM LEGALLY BOUND TO PURCHASE IT? I
DON'T UNDERSTAND THAT. IF A CHILD UNDER 18 MAKES A PURCHASE ONLINE, IT
SHOULD BE VOIDED.
HMMMMM. It just so happens that our niece lives in the same town (in our same state), which happens to be a college town. This girl lives in an apartment complex filled with college kids. Buyers remorse maybe?? If not that, then why leave a kid who is that unpredictable at home alone with a computer?
Has anyone else ever had this happen?
***TERMS OF SALE***

Payment is to be received within 7 days of end of auction.

Just file for fees, offer to the second bidder and neg them. What else can you do? You can't force them to do the right thing...

File for fees, neg the buyer. Then write to ebay and tell them the userid belongs to a minor and the account will be Naru'ed.

I would check and see their feedback, did they just sign up, did they win/bid on other items recently? were they the same type of items?
I would want to research it a bit more to email eBay...the more details they have the better it is.
But I would definitely neg/block and file for my FVF.
