I need help on solving this problem. I have perfect feedback and have always paid promptly for all items purchased. I have received a notice that I didn't pay for a purchase. I have written many emails and even called the party from whom I purchased this oyster plate. I paid immediately but still haven't received this item..the ironic thing is I have purchased many things from this same dealer..Where do I go to get this straight.It is driving me crazy..One other thing,I had a lady to email me recently and she asked me how could I leave positive feedback for this dealer..at the time, I couldn't do otherwise, because all of my transactions had been perfect with them.. Could someone please help me solve this problem..Th notice said I could be barred from EBAY. I am crazy about EBAY and just recently signed up 4 co-workers..I want to make this right. I just don't know how! Do I pay again? I was wondering if perhaps the dealer doesn't have the item to send? It is not always the buyer that may be wrong. Thanking you for any help you could provide.

*HOW* did you pay?

Check, Paypal, Billpoint or other?

Can you *Prove* that you paid, or could the payment have been lost in the mail?

A little more detail will let people here give you better answers.

Good Morning!
You may have what is called a non-selling Seller but considering your history with this particular seller, it is more likely a mix-up.
Payment can be overlooked, if electronic, the e-mail could've been accidentally deleted (we all get waaay too much spam!)
What has the response been from the seller?
Did you send proof of payment (confirmation e-mail or scan of MO?)
What was the result of your phone call?

Thanks so much for your help. I have the check before me. It was dated for 9/26/02 and they have cashed it. When I called the dealer and explained what had happened he promised to look it up and call me back..that has been 2 weeks and I still haven't heard from him. I know it is probably a mix-up but how do I get it straight with Auctionwatch or Ebay..Who do I send a copy of this paid check to. I am the injured party not them and I truly want to get it straight.Thanks again for your help.
Also, how do you get in touch with either AW or EBAY.

As long as the seller does not file for the FVF credit you have nothing to worry about. The NPB aler is just an alert to get you to pay. In this case the seller sent it out by mistake. Don't sweat it and move on.

Sorry you are having this problem. The problem is between you and the seller, AW or Ebay have nothing to do with resolving this.

You say you called on the phone but you didn't say what the results of that conversation was. I can't imagine a seller knowing you have a canceled check not sending the goods. Are they sayin they sent the item and it never arrived? If so this could be an insurance issue. This gets debated all the time but if you, as a buyer, are offered insurance and you decline it, most sellers will not send another item. Great sellers will. In the area I deal with, Collectables, there are usually no other items to send.

Having said that, they still shouldn't be getting FVC if you can prove the check was cashed. This is complicated but your best bet is getting communication established with the seller. If they refuse to talk you might be able to involve Ebay and get you strike taken off because they should not get FVC if they were paid and you have proff you are not a non paying bidder. Others on this board may be able to tell you which buttons to push to get ebay involved.

If they are just ignoring you you might want to try sending a copy of the canceled check either scanned via email or snail mail. If you send the check via email, incert it in the email rather than sending as an attachment as attachments are often deleted or blocked.

You won't "be barred from Ebay" with one FVC, however that is one strike out of three. If three sellers report you as a non paying bidder you are toast. This sounds like an Ebay seller with fairly poor customer service. Hope you get it resolved.

There may be a link or html addy on the e-mail you received ~
the wording is something like:
if you believe you received this warning in error, blah blah
As logansdad said, nothing actually goes against your record unless a seller files for FVF (eBay doesn't like giving money back so they put a strike against you!)
IF the seller files against you shame on them, they are a non-selling seller if they cashed your check so YES, you will get a link on your 'warning' notice from eBay.
Hopefully that won't happen

Why have you waited 2 weeks for the seller to "get back" to you? Get on the phone & start ragging him. You are not at fault, he is & I wouldn't let up on him until he ships you purchase. Make a photo copy of the check (both sides) & mail it to him. I am primarily a seller, but I would never treat a customer like this.

I waited two weeks because he said he would check it out and call me back. This guy is a powerseller and I thought he was probably very busy. I have called 4 times today and don't get an answer, not even an answering service. I appreciate more than words can say, all of the time each of you have given to me today. The reason I thought AW was involved is email reads: aw-confirm@ebay. I am not very smart with computers (know just enough to get by) so maybe this is my error.
Would like for each of you to know I think you are the GREATEST! I don't mind so much losing the money or even the item, just disturbed because I have paid and the check has cleared the bank. I will keep trying to reach the proper parties until I can get it resolved.Again, many thanks to each of you.

You need to light a fire under this sellers butt! There is no good reason that they can not respond to you after all this time.

Send one more email stating that if you do not get your item that you will file fraud charges with ebay and their local police dept.

Send ebay a copy of the check and demand they remove the npb from your file.

Just keep at them till someone listens to you. Hopefully the seller will get their butt in gear. Best of luck.

sounds like you have been jerked around by this powerseller.
tell ebay and let them go after their own powerseller.
there is also ebay insurance,check it out

Yes we powerfulsellers are very busy and you peons should not bother us.

We will get back to you when we damn well please.

We are big and powerful sellers and ebay sticks up for us.

Don't screw with us, just send your money. Send it more than once if we are distubed. Keep sending money!!!

As a powerseller...I would want to clear this matter up...angel...KEEP CALLING UNTIL YOU GET AN ANSWER...and send an email!!!!...You have every right to expect your item...and DOESNT MATTER if they are are a powerseller or not!!!!

Would like to give you an up-date on this problem. I finally got in touch with this dealer today. I told him about the cancelled check and the name of his bank and the day he deposited it. He said it must have slipped through somehow by mistake. He was very nice and had the warning removed immediately. I just checked my email and sure enugh there is a notice that the warning has been removed. Again, my heartfelt thanks for all of the good advice. Let me make my self clear, I wasn't the least bit worried because he was a power seller. I just gave him the benefit of the doubt, that by being a power seller, he was probably too busy with sales to get back with me any faster. I purchase a lot of items from power sellers and have always been treated fairly. This mistake was just a first for me and I didn't know how to handle it.
