I bought a sports figure off ebay...this one.

When I received it the packaging was in very bad shape. The seller included a note that I could return it for a refund, less postage, if I didn't like it.

Now...I don't have any intention of returning it and being out $10+ for nothing.

I can't decide whether to leave a neg for him because he knew the condition and didn't mention it or a neutral just to alert others.

I know the "Buyer Beware" policy and I probably should have asked about the condition before I bid, so maybe it's my fault. I guess I've been lulled to sleep by dealing with honest people so long it never crossed my mind. The guy has 600+ different positives with 1 neg so I thought I was pretty safe with him.

I don't know...what do you think?

Just going by the picture included with the listing I would have expected the item to be in the same condition, which looks near mint to me. If there was a problem with the packaging he DEFINATELY should have mentioned it in the listing. Whatever type of feedback you choose to leave, you should make a point of stating that the picture was a poor representation as the item was damaged.

Was the damage to the item the post office's fault or UPS or whoever? If not the seller may deserve a neutral but can leave you a negative for leaving the neutral.

I see many sellers barely mention the condition of their items or in this case the original packaging which is part of the auction item. I get the feeling the lack of condition description is so they can send a lesser quality item. In your case a photo of a pristine item was on the auction and you should have received the photo item unless the post office messed up the entire package. These bad buying expierence take the fun out of ebay.

How would it be your fault? The picture included with the listing (any listing) should be an accurate representaion of that specific item, and if not the seller should say that it is only a general representaion and then elaborate on any defects. I don't expect every buyer to ask about the condition of every item I sell.
If I do have a condition problem to note on any item I sell, I
include pictures of it and a detailed description, and then I state " if you have any questions about the condition, please ask before bidding".
It is easy for him to say he'll give you a refund minus the shipping, because he figures you will not bother as you'll be out $10.00.
This way, no matter what feedback you give him, he can respond with "offered refund".

As someone who sells and occasionall buys figures I ould not consider utting a listing up without a description of the condition of the packaging (I'd be deluged with emails asking it if I did) and unless it was a genuinely rare figure (ie - Kelian AAA wrestling figures) wouldn't consider buying one without it being listed.

If the seller pictured a figure other than the one being shipped and did not mention the one being shipped I would neg him. It's deceitful and he clearly new it - by putting the notice in with the package rather than emailing and stating that there might be a problem he was betting that you would make exactly the decision you are making and he was able to get rid of a damaged piece of merch at full price.

If this was not damaged in shipping, then I would say the seller pulled a switheroo. Showes one item & shipped you an inferior item. I would complain loudly about this.

I agree. Complain loudly and demand a FULL refund or Replacement (with refund for your shipping the item back). If he does not do that, Neg. "Sent damaged item, not as described. Offered PARTIAL refund upon return. I want FULL refund" Send this as a response to his neg and for your own neg. Give him a chance to make it right.

SOUNDS LIKE YOUR FAULT RIGHT NOW, SELLER OFFERED A REFUND, YOU DON'T WANT TO DO IT...

JUST AMAZING HOW MANY POSTERS HERE SWITCH WHAT THEY ARE SAYING JUST BECAUSE A POSTER IS A COMMUNITY MEMBER.

BETTER YET SHOW US A PICTURE OF THE PACKAGE NOW IN ITS ARRIVED CONDITION.

According to the picture on his auction listing I would think also like you did, that the item and package was in very good condition, because thats how the picture looks.
Also, the seller didnt mention about the package being damaged so I would also think that it is in good condition.
Now, since it is not in the condition that it looks like in the picture, and nothing was mentioned by the seller as the packing being damaged, I would write to him and tell him you want a full REFUND because he didnt state about the package being damaged.

Don't leave him feedback until you settle this with him and you need to make it clear to him that he misrepresented his item.

What a pickle.

Seller clearly shows package in great condition, sends one that is not and offers refund less shipping. He's got that base covered. In the auction clearly states Insurance is extra and recomended, I will not be responsable for lost, stolen or damaged merchandise! - got that base covered too.

No matter what your neg says, seller can say they offered refund and/or that you didn't accept insurance.

If what you say is true and the packaging was not damaged by shipping, then I say shame on that seller. It reflects poorly on all of us.

Thanks for your thoughts so far (well, except maybe for Twelvepole).

The package wasn't damaged in transit. As I mentioned, he knew it was in lesser condition hence the note inside offering to take it back.

I have an email drafted to him but I'm not gonna send it until I'm not as pissed as I am right now. I like to write 'em while I'm pretty pumped then take a look after I've cooled down and see what needs to be changed.

HOW ABOUT A PICTURE OF THE PACKAGE NOW, SO WE ALL CAN SEE THE DAMAGE?

I AM WONDERING IF THIS ISN'T JUST BUYERS REMORSE, AS I HAVE SEEN POSTED BY OTHER SELLERS WHEN A BUYER WANTS TO RETURN SOMETHING?

It sounds like he doesn't want to return the item, but he wants the item shown in the auction. Go to the picture and click on properties and see if the owner of the picture and the person you are buying from are one in the same.

This is one reason I do not want anyone to use my pictures. My pictures are of the auction listed. If I have two auctions the same I take two different pictures.

I think if you want a refund than that seller is responsible for the return of all money not just part of it as it is the sellers fault Item not as described. That is what I would do as a seller.

HOW MANY TIMES ON THESE BOARDS HAVE I SEEN "REFUND THE MONEY, BUT NOT SHIPPING"?

IF THIS IS ALL TRUE, I WOULD RETURN THE ITEM WITH A LETTER STATING THAT I WANT A FULL REFUND INCLUDING SHIPPING USING A SIGN FOR METHOD OF SHIPPING TO THEM, IF I PAID BY CREDIT CARD, I WOULD DO A CHARGEBACK ON ANY AMOUNT NOT PAID AND OR MAKE A COMPLAINT WITH PAYPAL.
HOWEVER IF YOU USED PAYPAL AND THE MBG, JUST MAKE A COMPLAINT WITH THAT AND YOU WILL ONLY LOSE MONEY ON SHIPPING THE ITEM TO PAYPAL.
