This morning I got an email from PayPal about possible fraud on a sale in August (a $4.97 sale!) and requested I answer 7 questions about the transaction. I stated I had shipped the item and provided the date and that I had received positive feedback and had heard nothing from the buyer about a problem. I did not use DC because of the low $ involved.

Tonight I got this email:

"Thank you for your prompt response.

Unfortunately, the transaction in question does not qualify for the
PayPal Seller Protection Policy as you were unable to provide
proof-of-shipment that can be tracked online. However, as a courtesy,
the temporary hold has been cancelled at this time and the funds are
once again available within your PayPal Account."


I clicked on the "disputes" tab on my PP account and it shows none...so my question is......

am i supposed to refund the $ or what???

If they said it is 'POSSIBLE' fraud and they put a temporary hold on your account,it means they are investigating.
Now they said they are releasing the temp hold so you can access your account,this does not mean you are not liable if it turns out to be fraud.
do nothing,if it turns out to be fraud,they will take the payment away from you.

Yeah, don't worry about anything. Just leave your balance in there and encourage payment through paypal.

They only put a hold on the $ 4.97 not the rest of my account - I emptied most of it AFTER getting the notice just to be safe. The $4.97 has been released now too and there is no dispute showing....I think I'll just fuhgedaboutit

They can only hold the amount in question. If they lock the account, they will be in violation of a court order, plus violating many laws pertaining to that. In your case, I would simply move on. Don't even respond to PayPal about this anymore as you are correct, small money not worth the time or effort.

If PP do reinstate the chargeback then you need to file Mail Fraud charges against the purchaser. Forms are available online or at your local Post Office. If everyone would press charges against criminals using PP then online payments would be much safer for all concerned

In order to file fraud charges, wouldn't you have to prove that you did send the item and that it was delivered to the person? In this case, there was no way of tracking and the person can always say it wasn't received.

You can file Mail Fraud charges with the USPS, but I doubt it would do you much good.

When I first started selling, some guy bought my Demarini bat, paid with PayPal and the reversed the charges on me after I had shipped. I checked and he had bought no less than 10 Demarinis that week. I contacted the other sellers and he had stiffed them all. I encouraged every one of the sellers to help me nail the guy.

In addition to getting him NRU'd, I also filed a Mail Fraud claim. Received one letter from the USPS about 60 days after the claim was filed. They said they were checking it out. That was the last I ever heard of it.

I also contacted the sheriff in his county and filed charges. It took two months of calling before a detective finally said he would look into it. That was the last I heard there as well.

Amazingly , about 90 days after I filed all these forms, PayPal put the money back into my account.

I still wonder if the guy is somewhere on Ebay...
