When Byrd Goes he will be Deeply Missed by Hard-Core Democrats....He's Ancient, But Still Tries to do the Right things for The Country. He's Also awake most of the Time when Congress is in Session...unlike some of his opponents.

Remember when we discussed this war powers issue before and I said that the Pres has wide latitude as long as Congress goes along ?
Well it's begining to look like Congress may be getting ready to pull the rug out from under GW and crew.
The Dems should all be turning the heat up for the Fall elections.
But they must be extremely cautious in their rhetoric, and they know it. If they start criticising the arrests of aliens, narrowing of civil rights, and the prosecution of the "war", and we are attacked again, GW and the Reps will sweep the elections and public opinion.

Back when Lincoln was doing preetty much the same thing he had 28,00 people in prison with habeous corpus set aside and armed troops around the capitol with fixed bayonets.
The Congress was afraid to say anything. He had warrents out for the Chief Justice of the Supreme court for saying he had oversteoppped his powers!

The system works very much like the "King in Parliment" of the British - if the King and Parliment go along, there is not much that can oppose their will.
In the US there is of course a written constitution. Unless there is an explicit offence to the constitution, there is not much a court can do if the branches are operating within their ennumerated powers.
I also do not think a court will define or defend the prospects whether we are at "war or in revolt or in danger". That too would be declined as a political question to be answered by Congress and the President. Otherwise, we would have to visit all three branches of govt to prosecute a war and hope that they all agree. It would create an unprecedented constitutional crisis if the courts took up the question.

That would be a serious mess.
For the first century or so, they were all testing the workings of the document. Many of the cases that got to the supreme court had to do specifically with which branch could do what and how much. When Lincoln suspended habeus corpus that was very much the situation. You like to hope that these various conflicts have been resolved but small changes continue to come up which require new rulings. It's just boring though when old issues are brought back to the fore when the president hasn't had his pablum.

KRS, that was back when being a Republican might have been something to be proud of. Back then, they were Pro-America/American in all things and would go to *WAR* the instant anyone tried to mess with the U.S. Constitution or Bill of Rights. How sad it is that things have changed so dramatically for the once-proud party of Lincoln. These days, the party is filled with neo-fascist multi-national corporate interests and religious hooligans of ever far-fringe stripe and caliber bent upon destroying the U.S. Constitution and the Bill of Rights and enslaving the American Population by stealing all of their wealth for their own pockets. That decent people continue to support such pure criminality is a shame and a reminder to all of us just how naive and stupid people can be to believe anything that they are told by these clowns from hell.
