PINELLAS PARK, Fla. (AP) - With a furious legal and political battle raging outside her hospice room, doctors removed Terri Schiavo's feeding tube Friday after a judge rebuffed an unprecedented attempt by Congress to keep the brain-damaged woman alive.
Schiavo, 41, could linger one to two weeks without the tube, provided no one intercedes and gets it reinserted _ as happened twice before. Late Friday, a House committee filed an emergency request at the U.S. Supreme Court, asking justices to reinsert Schiavo's feeding tube while the committee files appeals in the lower courts to have its subpoenas recognized.
Republicans on Capitol Hill used their subpoena power to demand that Schiavo be brought before a congressional hearing, saying removing the tube amounted to "barbarism." The attorney for Schiavo's husband shot back at a news conference, calling the subpoenas "nothing short of thuggery."
"It was odious, it was shocking, it was disgusting, and I think all Americans should be very alarmed about that," George Felos said.

Meanwhile, Republican congressional leaders said in a statement that they planned to work through the weekend to try to save Terri Schiavo's life.
The removal of the tube signals that an end may be near in a decade-long family feud between Schiavo's husband and her devoutly Roman Catholic parents, Bob and Mary Schindler. The parents have been trying to oust Michael Schiavo as their daughter's guardian and keep in place the tube that has kept her alive for more than 15 years.
Michael Schiavo says his wife told him she would not want to be kept alive artificially. Her parents dispute that, saying she could get better and that their daughter has laughed, cried, smiled and responded to their voices. Court-appointed physicians testified her brain damage was so severe that there was no hope she would ever have any cognitive abilities.
Michael Schiavo was at his wife's side shortly after the tube was removed, Felos said.
"This is what Terri wanted. This is her wish," the husband said late Friday, making his first comments after the tube removal on CNN's "Larry King Live." He said he was angry that "government has just trampled all over my personal life."
The family is still hoping for a long-shot legal victory to have the tube re-inserted.
It is unclear how much time the family will have. The effects of such feeding tubes being removed can be seen by the third or fourth day, when the patient's mouth begins to look dry and the eyes appear sunken. From days five to 10, respiration becomes irregular with periods of very fast and then very slow breathing. By the final days, kidney function declines, toxins begin accumulating in the body, and multiple organ systems fail from lack of nutrition.
Court-appointed doctors have said Schiavo will not feel any pain given her state, but her parents' doctors dispute that.
Several right-to-die cases across the nation have been fought in the courts in recent years, but few, if any, have been this drawn-out and bitter.
The case has garnered attention around the world and served as a rallying cry for conservative Christian groups and anti-abortion activists, who flooded members of Congress and Florida legislators with messages seeking to keep Schiavo alive.
Outside Schiavo's hospice, about 30 people keeping vigil dropped to their knees in prayer when word spread of the judge's ruling calling for removal of the tube.
White House spokesman Scott McClellan said President Bush (news - web sites) discussed the case with his brother, Florida Gov. Jeb Bush, and members of the state's congressional delegation during his swing through Florida on Friday to discuss Social Security (news - web sites) reform.
"We're continuing to monitor developments," McClellan said. "The president believes when there are serious questions or doubts in a case like this that the presumption ought to be in favor of life."
Gov. Jeb Bush said the judge's decision "breaks my heart" and noted that it often takes two decades for a death row inmate's appeals to go through the system.
"There's this rush to starve her to death," Bush said.
But Rep. Henry Waxman (news, bio, voting record) of California, senior Democrat on the Government Reform Committee, called the subpoenas a "flagrant abuse of power" and said they amounted to Congress dictating the medical care Terri Schiavo should receive.
"Congress is turning the Schiavo family's personal tragedy into a national political farce," Waxman said.
Schiavo suffered severe brain damage in 1990 when a chemical imbalance apparently brought on by an eating disorder caused her heart to stop beating for a few minutes. She can breathe on her own, but has relied on the feeding and hydration tube to keep her alive.
Both sides accused each other of being motivated by greed over a $1 million medical malpractice award from doctors who failed to diagnose the chemical imbalance.
The Schindlers also said that Michael Schiavo wants their daughter dead so he can marry his longtime girlfriend, with whom he has young children. They have begged him to divorce their daughter, and let them care for her.
The tangled case has encompassed at least 19 judges in at least six different courts.
In 2001, Schiavo went without food and water for two days before a judge ordered the tube reinserted when a new witness surfaced.
When the tube was removed in October 2003, her parents and two siblings frantically sought intervention from Gov Jeb. Bush to stop her slow starvation. The governor pushed through "Terri's Law," and six days later the tube was reinserted.
That set off a new round of legal battles which culminated in September 2004 with the Florida Supreme Court (news - web sites) ruling that Bush had overstepped his authority and declared the law unconstitutional.
The U.S. Supreme Court has been unwilling to hear arguments in the case.
On Feb. 25, Circuit Judge George Greer gave Michael Schiavo permission to order the removal of the feeding tube Friday.
"I have had no cogent reason why the (congressional) committee should intervene," Greer told attorneys in a conference call Friday, adding that last-minute action by Congress does not invalidate years of court rulings.
The attorney for the parents said he would likely file a new appeal early next week with a federal appeals court. He also said he hoped lawmakers in Washington or Tallahassee could agree on legislation that would force the tube to be reinserted. Similar efforts have failed in the past.
"I'm hopeful these men and women can get a strategy, get a focus, because we're running out of time," said attorney David Gibbs.

Now you are taking the word of a husband who has a girlfriend and young children over a women who cannot communicate to anyone. If the women wanted to die then she should have signed the right to life papers.
I guess you are in favor of a Dr. Kovorkian type of demise but with this one it is going to take two weeks. How would you like to starve to death?

'Another wife'
Bobby Schindler told WND he's astonished Schiavo has been allowed to remain as Terri's guardian while having, de facto, another wife.
"Michael claims he loves Terri, and he has said it on numerous occasions, but he treats her in a way I don't think most of us would treat our own pets," Schindler said.
Among the family's complaints are that Michael Schiavo:
Has not allowed therapy or rehabilitation since 1992, despite medical records indicating Terri is responsive.
Has prevented swallowing tests or swallowing therapy since 1993, despite medical testimony Terri can be taught to eat.
Ordered caretakers not to clean Terri's teeth since 1995, resulting in removal of five teeth in April 2004.
Placed Terri in hospice in 2000, despite the fact she is not terminally ill.
Refuses to allow Terri to leave her room. She has not been outside since 2000.
Has refused to fix her wheelchair since 2000.
Refuses to allow Terri to practice her Catholic faith by attending weekly mass.
Ordered Terri's shades down at all times.
Ordered doctors not to treat Terri when she had a life threatening infection in 1993 and 1995.
Removes family pictures from Terri's room, denies flowers from family and friends, denies certain CDs to be played for Terri, and refuses to allow her to listen to music with headphones.
Refuses to release medical information to parents since 1993 despite court order requiring him to do so.
Has limited the visitors list, requiring they must first be approved by him and removes visitors at own discretion. Schiavo removed the Schindlers from the visitors list a total of eight months between 2001 and 2004.
Denies all requests for Terri to attend nursing home functions and refuses to allow therapeutic animals to visit with her, knowing that she is an animal lover.
Imo, the above is NOT the way you treat someone you love.

"If it is removed, it will inaugurate a dangerous social policy concerning a severely disabled person's right to live, a policy founded on irrational fears of disability," she said.
Tada said the "individual liberties of severely disabled Americans--especially their right to life--would be inextricably tied to the whims of a guardian who may not have their best interest at heart."

Terri's case HAS NOT BEEN GIVEN the same Federal review that every convict on death row receives. Period......and she has done nothing...committed no crime...etc.
She's just in her husbands way...and rather than divorcing her...he wants her dead.

Well she wasn't given a review BECAUSE she committed no crime.
And bush did NOT review appeals when he was governor....he just did whatever Gonzales told him to do as far as death row inmates were concerned.
Why are you not worried about all the innocent people HE put to death who weren't sick or disabled in any way???????
AND, my husband(and I have one) knows that my wishes are that if I was ever like that woman to let me die....her condition is not LIFE.
And I would be very angry at the very selfish self-centered people who would want me to suffer just so THEY could be around me.

We are taking the word of a man, who hasn't been a husband for quite some time. Who has a "wife" "girlfriend" or whoever she is, and small children. Why doesn't he move on, get a divorce and marry and take the children off of the illegitimate status. Of course he wants her to die so that he can claim the insurance check and then he would be free to marry.
You didn't answer my question. How would you like to starve to death.? How would you like to sit and watch your daughter die of starvation. I guess since you have no children you wouldn't know.
This is not a Bush thing or a Republican thing it is the right to life. No I don't agree with abortion either. I believe every child conceived has a right to life.

You have authority over your life and nobody else does. Just because your married doesn't give your husband jurisdiction over your life and vise versa. When Terri had her stroke there was no living wills.

Crowfarm, historically in this country the spouse of a person living in a vegetative state was the person to make the decision to pull the machines and let that person die.

All the more reason to have a living will. IMO, the family needs to let go. Even if she survives, her chances for ever leading a normal and productive life are slim to none. How many of you would want to live your life in a vegetative state, a strain on your family and friends? The Lord took her a long time ago. It's only due to the medical community and her family that she lays where she does.

A friend of mine's sister lives near Michael Schiavo. The community there is much more sympathetic to Michael. He has nothing due to the insurmountable hospital bills adding up, with interest, for 15 years. Last I knew, Catholics didn't believe in divorce. And we can all "love" someone and know there is no future. Should he have sat by her bedside for 15 years, while his in-laws are doing everything in their power to make his life a living hell? I do not believe "starving" her is the answer either. I believe someone should intervene in some cases, as some have no one looking out for them.
Too many "gray" areas in this one....But once the Supreme Court hears it, it should be over.

Appears there are MANY things about this case that you have no knowledge of. figures....
Medicaid pays her hosptial bills and she's been in a HOSPICE facility for almost all these years - you can't pay...they don't charge. Her husband has allowed NO TESTS to be done...like MRI's...PET scans...etc. heck he won't even pay to get her teeth fixed - let alone receive therapy to see if her condition could be improved. He's spent almost all the money the court awarded for HER care on fighting for his right to kill her. The money the court awarded HIS for loss of marital relations.....he refuses to account for. [his right].
And I'd bet cheryl would feel much differently if she could put herself in this situation. Where initally you, as a parent were told therapy very well might improve your daughters condition....but your son-in-law constantly refused ANY treatments for her.
twig...the USSC has twice refused to hear this case. Once to save her life before...and once when Florida passed Terri's Law and then it was ruled unconstitutional. There's not enough time left for Terri for them to try to appeal to the USSC again. She's suffering a very painful way of dying....starvation and lack of any fluids...husband won't even allow ice chips.
IMO, UNLESS there is no disagreement in the family OR if a 'notice of intention' has been signed by the patient themself....that anyone, husband or not, has the right to decide to take a life. And that's exactly what they're doing.
Torturing her...until she dies rather than turning her care over to her family who want to care for her.

No...it's the husband that hasn't followed Florida law. For the past three or four years he hasn't presented the court with the REQUIRED yearly notification of what her health treatments will be. Had this judge, that's so willing to end her life, followed the LAW....because the husband was not doing as the court requires....guardianship SHOULD have been given to someone who would follow the law in regards to her care.

Doctors removed the tube Friday despite an extraordinary, last-minute push by Republicans on Capitol Hill to use the subpoena powers of Congress to keep the brain-damaged woman alive.

Outside the hospice, the Rev. Patrick Mahoney of the Christian Defense Coalition said activists planned to try to enter the hospice Saturday morning "to try to give Terri a cup of water."

Both sides accused each other of being motivated by greed over a $1 million medical malpractice award from doctors who failed to diagnose the chemical imbalance.
The Schindlers also said Michael Schiavo wants their daughter dead so he can marry his longtime girlfriend, with whom he has young children. They have begged him to divorce their daughter, and let them care for her.
The tangled case has encompassed at least 19 judges in at least six different courts.
In 2001, Schiavo went without food and water for two days before a judge ordered the tube reinserted when a new witness surfaced.
When the tube was removed in October 2003, her parents and two siblings frantically sought intervention from the governor, who pushed through "Terri's Law," and six days later the tube was reinserted. The Florida Supreme Court (news - web sites) ruled in September 2004 that Bush had overstepped his authority and declared the law unconstitutional.
On Feb. 25, Circuit Judge George Greer gave Michael Schiavo permission to order the removal of the feeding tube Friday.

Even if you could PROVE this, the HUSBAND and husband alone has the right to decide if she should have the plug pulled. Certainly not some vote seeking Repugs who love putting people to death as fast as possible.

I have some questions that I am not clear on.
Court-appointed physicians testified her brain damage was so severe that there was no hope she would ever have any cognitive abilities.
I understand the above statement is saying that Teri is brain dead, is it not?
I am confused as I hear from others statements that she responds to her parents....shows emotions....
I don't think we put the mentally ill people to death, do we, just because they are mentally impaired?
But... if it is Fact that Teri has no brain function and no chance of recovering , and if it is true that her body is only able to survive with the aid of machines...that to me is only preserving the flesh of the person who is dead..
There are to many gray areas..about her prognosis...for me to even form an opinion.
Would it not help to have a team of medical experts hold a press conference right now to clarify her prognosis.. without a shadow of doubt..
Or are they not able to do this?

It looks like we all NOW NEED a living will to protect us from the right to life crowd along with the religious right. Back when Terry got brain damage we didn't need one because it was always the decision of the spouse to shut down medical care.
NOW UNDER THIS WHITE HOUSE AND THIS WHITE HOUSE ONLY. WE ALL NEED PROTECTION FROM THE RIGHT TO LIFE AND RELIGIOUS RIGHT PEOPLE ABOUT PERSONAL MATTERS. NOW UNDER THIS WHITE HOUSE THE REPUBLICANS WANT TO CHANGE LAWS ABOUT WHAT HAS ALWAYS BEEN A PERSONAL DECISION MADE BY THE SPOUSE ABOUT MEDICAL CARE.
We can all see where laws like this will lead. Hey people you better watch what this White House and its supporters are doing to ya.
