Washington Post...New York Tmes...

The initial reports of a Bush victory in the Supreme Court are GREATLY exaggerated. All the USSC has done is send the case back to Florida for clarification as to their legal reasoning. They probably want to know whether the Florida Supreme Court relied on the State Constitution and held the state procedure violated the State Constitution(which would thus violate the US Constitution), or whether the Florida Court analyzed the State Constitution merely as an aid to interpret the intent of the legislature. In an unsigned
decision, the justices said there was uncertainty about the Florida court's grounds for issuing its ruling that allowed hand-recounted votes to be added to the total. "This is sufficient reason for us to decline at this time to review the federal questions asserted to be present" by Bush's appeal, the justices said. "After reviewing the opinion of the Florida Supreme Court, we find that there is considerable uncertainty as to the precise grounds for the decision," the court added. Given the holding that there is "sufficient reason for us to decline" reviewing Bush's issues, how anyone can report a Bush victory is beyond me. --T.D., 12/4/00

krs: On our local news here in Sarasota, they reported it as a setback for Bush.

The Federal Supreme Court sort of "spanked" the Florida Supreme Court. The Florida court is not too happy about being lied to by the Gore lawyers who used some case in their arguments that proved to be untrue. It will be interesting to see how the Florida court explains itself to the Supreme Court.

This whole things needs to stop...Gore wants to win at any cost, regardless of public opinion and the already overcounted ballots. He will not win this, and needs to back out with what little grace he has left.

Gore DID win, he just didn't count on the Bush league boys corrupting an entire state, let alone the US Constitution is all.

Count the whole damn state, or throw out the state, but don't let some illiterate creep win because "it's easier"

What a sham that Gore is getting all the blame for a flim flam mickey mouse operation in Florida.

I really feel for the residents there, they need our blessings.

In a nutshell...the U.S. Supreme Court ruling is:

"The judgment of the Supreme Court of Florida is therefore vacated, and the case is remanded for further proceedings not inconsistnet with this opinion."

In other words, The U.S. Supreme Court turned to the Florida Surpreme Court and said, "HUH"???

Not paranoid anywhere else but here!

IMHO the High Court told the Florida Court rewrite your opinion to remove the Federal Question and in a matter consistent with interpreting the law in Florida and not rewriting it.

Since the Florida Supreme quoted the 1975 Supreme ruling in a similar Florida circumstance rewriting the opinion and interpretation actually just requires rearranging the structure of what they already wrote so it sounds like an intrepretation of the law and not a rewrite of it.

More importantly is the current decision before Judge Sauls in Leon County. And I suspect the Florida Supreme will wait for his ruling and readdress the entire matter after that. Since no matter what he rules they will see that appeal as well.

uaru,

If you'd ever bother to browse the site that you critisize in your cherubic chortling glee you will find accolades aplenty from many national news agencies, some of which are the ones you prefer (as they tell you only what you want to hear). Words like "impartial" "non-partisan", "thorough", and "insightful" are replete in those descriptions.

I did not 'forget' to provide a link, as you know. I provided that link on 11-11-00, for once and for all.

Boookmmark it.

Well we just got Judge Sauls ruling which is 100% in favor of President Elect "George Dubya".

The question now is do you have the lawyers write a appeal of that ruling and send it to the Florida High Court. Where you revert the matter to reflect what will be called a partisan ruling since the Florida High Court is primarily democratic appointees. Or do you, call it quits and let the electorate meet to actually decide the president.

I would hope that Gore at this point would gracefully end the legal manuevering and call for the nation to unite under its new President. Then let the New Senate which is now 50/50 stop the appointment of any and all questionable Bush appointees to include Katherine Harris and others. Then let the American people reshape the House in 2002 and make a run in 2004.

The next two years will allow the rest of the American people to see what a mistake George Dubya was. And it will also let the American people wonder where did the great economy go? And I suspect those people who only can say a return to morals in the White House. Well they'll see that questionable morals are a mainstay of both political parties.

Boies just said that the Florida Supreme Court would be the final arbiter. I assume he speaks for Gore.

I agree with you, networker, completely. I think that we'd all be better off if Gore concedes, as the continuation of this has disrupted the market prematurely and I doubt that it will recover no matter who is president. If Bush is, the coming recession will be viewed as his doing and he won't be reelected, if Gore is, he will be seen as having failed to prevent the recession and would not be reelected.

As for us, dump net stocks yesterday and get cash liquid. Watch the housing market plummet and buy when it's low enough to be confortable, nevermind the increased interest rates.

Aside; It's a rocky road ahead, and ebay sales will follow people's confidence in tomorrow's money.

I just love the Bush <spit> "morals" thing.

Where did he get morals?

From his dad?, or was it Ollie North?

I sure hope he picks a good team of advisors and what not. I am waiting to see who this democrat is going to be that is offered a cabinet position. I betcha its a current Senator.

Besides we just had 8 years of stories about sex and womanizing, we can live with a few years of stories about boozing.

In fact, the foreseen adverse economic effects are being presented by Cheney as a problem attributable to Gore's campaign:

manic alcoholic depressant

Interesting new medical term, which I'll try to translate into standard English.

Has GWB actually been diagnosed as manic-depressive? Is he on medication for the same?
