Vendio may offer e-mail services, wikis, reviews, ratings, bulletin board services, chat areas, news groups, forums, groups, personal web pages, calendars, image hosting, photo albums, file cabinets and/or other message or communication facilities or services (collectively, "Communication Services").
1.1. Limits on Use. You agree to follow the directions of Vendio staff members. You agree to use the Communication Services only to post, send and receive messages and material that are proper and, when applicable, related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not engage in any of the following:
a) Deception. Impersonate another member, celebrity or other public figure, or Vendio staff member or attempt to access other members' passwords, account information, or private information.
b) Advertisements. Advertise products or services (forums only). Third party representatives may answer questions about services in a strictly factual and non-promotional manner if asked; however, Vendio may end a discussion if we believe that a third party or any of its representatives initiated or are perpetuating the discussion, are promoting its services, or that ending the discussion is otherwise appropriate. Your signature line may contain a link to your personal web page, your email address, your user id, a non-profit organization, an email list, or a website not in competition with Vendio (as determined by Vendio in its discretion). Post a link to any transaction to promote the transaction or discuss the seller/buyer.
c) Inappropriate Content. Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent or unlawful topic, name, material or information or private information about any person that is not readily available to the general public. This includes, but is not limited to, phone numbers, addresses, full names, email addresses, and user ID.
d) Spam. Use the Communication Service in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise).
e) Abuse. Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
f) Discrimination. Publish, post, upload, distribute or disseminate any topic, name, material or information that incites discrimination, hate or violence towards one person or a group because of their belonging to a race, a religion or a nation, or that insults the victims of crimes against humanity by contesting the existence of those crimes.
g) Infringement. Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consents to do the same.
h) Viruses. Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, scripts or any other similar software or programs that may damage or unduly burden the operations of other computers.
1.2. Disclosure. Vendio reserves the right at all times to disclose any information as Vendio deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Vendio's sole discretion.
1.3. Personally Identifiable Information. Always use caution when giving out any personally identifiable information about yourself or your children in any Communication Service. Vendio does not control or endorse the content, messages or information found in any Communication Service and, therefore, Vendio specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service.
1.4. Authorized Use. You acknowledge that only you are authorized to use your account. You agree not to resell Communications Services and you agree to be fully liable for the use of your account, including any unauthorized use of your mailbox by a third party. You agree to notify us immediately if you become aware of any unauthorized use of your account.
1.5. Size Limits. Vendio will not process any message with attachments that exceed 16 megabytes or a message body that exceeds 64 kilobytes.
1.6. Cancellation. If your account is cancelled for any reason, Vendio will have no obligation to retain any e-mail, including any attachments. Vendio may, in its discretion, recycle your email address within two weeks following the cancellation.
1.7. Virus and Spam Scanning. Through third party service providers, Vendio may have your incoming emails scanned for viruses and spam. Vendio disclaims any representation or warranty regarding the accuracy or efficacy of such scans. Refer to the 'Third Party Services' section of our Terms of Use.
1.8. Security. Emails sent using Vendio's services have the same security limitations as other conventional Internet email.
