I hope that poor buyer paid with a CC. And I can't believe ebay won't NARU the seller. There's a difference between a buyer misunderstanding and a seller deliberately misleading people.

For example: How about I sell car batteries with a lifetime warranty? When someone brings back a dead battery for a refund, I tell them, "warranty is over - that's the end of its lifetime."

Or dripless candles "It's your fault. They didn't drip when I sold them to you, did they?"

Can someone invite that buyer to come to this thread? I would like to know if he took recourse on what that "seller" did. That is so so wrong.

These are the sellers that ruin it for the rest of us... Blatantly dishonest. The seller claims that he sent exactly what was described, but he worded the auction deceitfully so that bidders would expect a full PlayStation 2 "IN" its original box... Not "JUST" the original box. Who in their right mind would sell a cardboard box?

People like this seller make my friends say, "Oh, that ebay just has a bunch of junk and rip-offs."

What amazes me most is they defended their auction. Takes all kinds doesn't it? Ever wonder why lots of folks STILL think auctions are a scam waiting to happen???

HOLY MOLEY!!! Technically, the seller is right but WHAT A RIP-OFF for the price!!! A responsible seller would have stopped the auction when it became apparent his ad was misleading due to the high bidding for what HE KNEW was just an empty box. And to call his buyer a liar is salt to the wound. I wonder if ebay can or will do anything about this transaction or this type of transaction.

Look I'm not defending this seller but to me if you can read at a grade 3 level then it says you are purchasing a box with a receipt.

This is all it says in the auction:

"This is a auction for the playstation 2 original box and receipt"

There is no punctuation that would think you are getting the PS2, the box, and the receipt.

And this is what it says in the title.

"Playstation 2 Original Box And Receipt"

Where is the confusion? This is not hidden in a pile of text - that is all he says! If he would of stated.

"This is a auction for the playstation 2, original box and receipt" or "Playstation 2, Original Box And Receipt".

Then you would think you are getting the PS2 console as well.

Remember last week there was a thread "Buyers Just Don't Read" - well I think this is a prime and unfortunate example of that. A reputable seller would probably make sure that the buyer does know they are not getting the console because it sold for so much so that is the only complaint I have.

I don't think what he used was a play on words like the examples given in this thread (lifetime warranty, all you can eat ect.). The buyer did not read and did not e-mail the seller before shelling out $425 to someone with 3 feedbacks.

READ!

but instead it says
'Playstation 2 original box receipt'

Who in their right mind would sell an empty box with a receipt???

It reminds me of that commercial on tv, about "learn pc skills FREE!!! Just send 5.99 shipping and handling for this wonderful FREE cd".

Im a very firm believer in karma. That seller, someday, will get burned thrice over...and then he/she will maybe understand what the bidder felt. And I hope it happens SOON.

Wish the bidder WOULD come here. And the seller.

Zazzie, the person who would do this did it for one reason...ulterior motive to MAKE it looke like the winner would get what the seller was INSINUATING.

Pretty sneaky, leaving the tape on the box so it appears to be a SEALED box.

Why would he want to sell just the box for something like that anyway? It was a very dumb auction. He did make it seem like it would be for more than just the box and receipt. He started it way to high for just an empty box anyway. There are deffinitly some stupid people out there.

Sorry Chris...I see what you are saying, but in this case I must disagree. Playstation was (and probably still is) a very hot item. Look at the bid history...not one single bid retraction! This was very misleading. I also hope this bidder used a CC for this purchase.

And, btw, look at this persons past auctions....has done it at least twice before!

I do believe this auction is a "joke".

Take a look at all the bidders. Not one bidder has feedback more than (10).

Some have (0), (-1), (1), (3), (7), (9 - Naru'd), (10).

Looks to me like someone is just trying to get some attention by making up a stupid auction like this and then bidding on his own auctions with other ID's.

The legal interpretation would be "Playstation 2, Origional Box, Receipt."

If the seller really wanted the correct and non-misleading title: "Playstation 2's Box and receipt." Notice the apostrophe.

I'd sue this thief, and file a police report for fraud.

This seller has committed fraud, plain and simple. Yes, the commas weren't there. However, by listing this in the category of:
Photo & Electronics:Electronic Games:Sony PlayStation2:Systems, Accessories
the seller is implying that it is the system he is selling. You can't tell me an empty box and a receipt count as "accessories". PLEASE!

If the seller was honestly just selling off his empty boxes, then why didn't he choose a category for empty boxes (if there is such a thing). No, he listed it with the Playstations, set a $9.99 opening bid (unrealistic for a used, empty box) and put up a picture with the tape seal across the opening of the box.

There were around 39 bids on this auction, so it isn't just that this buyer is a doofus ---or do you spell it dufus?---anyways.....

This is fraud. I hope the buyer takes whatever legal steps he can.

GOOD NEWS: The seller has another auction up for Playstation games. The current bidder has a feedback of -1. That should be fun to watch.

Invite the buyer too.

A receipt is only good for warranty purposes--why would one need a receipt for an empty box.

They should also make a claim to EBAY

That is outrageous. Being legally-challenged, I may be out of line, but I'd say that's bordering on false advertisement. Guy's also a retalitory-feedback-leaver. He got over $400 for an empty box. What's to be so upset about?

I also disagree with Chris97's theory.... if this person were to be so grammatically correct, he would have known to state, "This is an auction", as opposed to "This is a auction".

And here I was feeling guilty about my bidders not realizing the shipping charges over one of my auctions.

I cant believe the seller left a neg for the buyer ....you would think ripping him off would be enough.

Heck no it's probably all hits from people like us.


The buyer had a bid on another Playstation (most likely a legit one) that had ended just a few minutes before (or after) the "box" he ended up winning.

I don't think the auction is a joke - why would asyone in his right mind give himself a negative?

As for the auction - I totally agree that the seller probably put this stuff up for sale to "see what happens" but aside from the picture of the sealed PS2 unit I don't think the auction was misleading. I'm not sure if you are legally bound to show the actual item up for sale on eBay. I have sold many of the same items and have used the same photo for each so I hope this is not the case.

If the buyer payed through Paypal I would chargeback for sure.
